What If Youre Still Not Ready To Go Back To Work

If youre on short-term disability, your benefits will end when your predetermined time period is over or when you return to workwhichever comes first. But what if youve already maxed out your short-term disability benefits and you still cant head back into the office?

Lets return to our example of missing out on work for major back surgery. Your doctor determined that youd need six months to fully recover, and your short-term disability plan approved you for that amount of time.

However, you had some pretty significant complications with your surgery and your recovery. As the end of those six months draw near, its evident that you arent physically capable of sitting at a desk for eight hours each daythis is a problem that will plague you for a lot longer, perhaps even permanently. Now what? Are you just out of luck?

If you have long-term disability benefits, it should be straightforward enough to transition into those benefits if you meet the new definition of disability for your long-term plan. The definition for disability under a long-term plan is typically subtly different than the definition for short-term disability.

Some insurers require new paperwork from the claimant and new medical records before they will begin paying a long-term disability benefit, says McDonald.

I want to apply for disability but I’ve heard it takes a long time. My employer is trying to be understanding and has let me take breaks, but even so I don’t know if I can keep working until I’m approved. But I need the income until I’m able to get benefits. How To Find Your Work History

Can you work while on Disability?

Each year the Social Security Administration provides a breakdown of your earnings, including your earnings for the previous year as well as a detailed report of your earnings history. You should receive a copy of this report by mail, but if you need a copy sooner than when it is sent out, you can request a Social Security Earnings report online or by phone.

Your earnings report will detail the years you worked, how much you made each year, the amount you paid into SSDI and the amount of money you would receive if you were to become disabled based on your earnings history through the last complete year of data.

You can contact the Social Security Administration for more information about the information found in your earnings report. Its a good idea to verify that the information included is accurate because this is what will determine your eligibility for SSI benefits and the amount you will receive.

In the event that you haven’t worked enough to qualify for Social Security Disability benefits, you’ll be able to get Supplemental Security Income benefits. Social Security has two programs to assist people who are incapable of working due to a debilitating condition .

Social Security Disability Insurance

Can you work while receiving CPP disability?

Social Security Disability Insurance is for people who qualify as disabled and have paid enough Social Security taxes through past employment to reap additional benefits.

SSDI recipients are also allowed to work, and the rules are more lax because they have paid taxes into the system for much longer.

This program isnt for low-income people, per se. But there are monthly limits on how much income someone can earn from a job: $1,260 a month or $2,110 for blind workers. Income and assets outside work earnings are unlimited.

The benefits for the SSI folks are different because they didnt pay into the system, says Paula Vieillet, CEO of My Employment Options, a national employment network and advising company for people on Social Security assistance.

If You Become Disabled While You Are Employed

  • There is a seven day waiting period for which no benefits are paid. Benefits begin on the eighth consecutive day of disability . If you have been disabled more than seven days, your employer must give you a Statement of Rights under the Disability Benefits Law within five days of learning that you are disabled .
  • A day of disability is a day on which you were prevented from performing work because of disability and for which you have not received regular wages or remuneration. You are ineligible for disability benefits if you perform any type of work for which you receive wages or profit, even if performed at home.

What Is The Trial Work Period

The SSA allows you to test your ability to work without losing your SSDI benefits. This trial work period allows you nine months in a five-year period to work without worrying about risking your benefits. The nine months do not have to be consecutive.

It is important to note that only a certain amount of money will trigger a month of service. For the year 2017, if a person earns more than $840 a month, that month will count as a month of service toward the total of nine months. This means any months that you make below this amount do not count as part of your trial work period.

Concurrent Benefits: Qualify for SSI and SSDI Simultaneously

When filing for Social Security disability benefits, you must establish two things for the Social Security Administration . First, you must show that you are disabled according to their stringent definition of disability. Second, you must show that you are eligible for Social Security programs.

In the case of Social Security Disability Insurance , this is based on how much you have worked in recent years. For Supplemental Security Income , this means you must show that you have a financial need .

Filing for Social Security disability benefits without a strong work history is more difficult, but not impossible. While the SSA does require that you have worked, earned income, and paid into FICA in order to qualify for SSDI, the work requirements are not as stringent as you may think.

If you do not have a work history, you may still qualify for Supplemental Security Income . SSI is based on financial need, not on work history, allowing those who have not worked still qualify for benefits.

Regardless of your work history, you will still need to meet the medical requirements to qualify for Social Security disability benefits. This means you will have to meet the qualifications listed in the Blue Book for the condition you are experiencing.

Are My Benefits Subject To Income Tax

If you qualify for benefits under the Plan, the amount you receive will be subject to income tax. At the end of each year, the Insurer will send you a form indicating the total amount of benefits paid to you during that particular year. Prior to January 1, 2015, withholding income taxes from DI benefit payments was an option a Disability Insurance Plan member could select. Effective January 1, 2015, the Canada Revenue Agency has made it mandatory for income taxes to be withheld from all DI benefits. Therefore the ensurer, in accordance with the Canada Revenue Agency, will automatically deduct income taxes at source. The monthly premiums you pay while you are employed are not tax deductible from earnings. If you become eligible for benefits, the total amount of the premiums you have paid from the time you became a member of the Plan may be deducted for tax purposes from the amount of the disability income you received from the Plan. If the total amount of premiums you have paid under the Plan exceeds the benefits you receive during the first taxation year in which your benefits begin, you can carry over the excess amount to the following year.

Theres a special rule for when you work part of the year but then retire. Regardless of your total earnings, youre still entitled to get Social Security checks for any month in which youve officially retired.

As an example, say you retire early at 63 and decide that youre going to quit your $200,000-per-year job at the end of June. Youd forfeit all of your benefits for the first six months of the year because of your high earnings, but, starting in July, you could still get checks for the remaining six months even though your total annual earnings were well above the annual limit.

Can I Work While my Disability Case is Pending?

To be eligible for either program, the Social Security Administration first determines if applicants are disabled using a specific definition.

According to the SSA, disabled means applicants:

  • Are totally disabled .
  • Cant do work they previously could before the disability.
  • Are unable to adjust to other work because of a medical condition.
  • And the disability has lasted for at least one year or will result in death.

Beyond this definition, the programs vary greatly.

Sometimes even beneficiaries dont get the distinction between the two, says Kathleen Romig, a Social Security policy expert at the Center on Budget and Policy Priorities. And the work rules are totally different.
