It Usually Makes Sense To Take Va Disability Compensation But In Some Cases Dod Military Retirement May Pay More

If you are being medically retired from the military due to being found unfit for service, then you will need to choose what pay to receive, disability compensation from the VA or medical retirement pay from the Department of Defense . Under Title 38 of the United States Code, Sections 5304 and 5305, you cannot receive both. Often what happens is that the amount of medical retirement pay you are owed will be deducted from any disability compensation you are eligible for through the Department of Veterans Affairs . This is called the VA disability offset to military retirement pay.

Additional Ways To Receive Smc

There are also other ways to increase your VA disability rating pay over 100% and receive SMC. For example, if your service-connected condition causes blindness or deafness, or it is severe enough to cause paralysis or a bedridden state. Another qualifying factor is if your service-connected condition makes you homebound, or unable to leave your house. There are many disabilities that are related to your limbs that may make you eligible. Missing or paralyzed limbs are common. However, the rules surrounding SMC are complex and many people misunderstand the nature of what kind of disability qualifies.

Provide Complete Medical Evidence

Do not assume the United States Department of Veterans Administration will understand the seriousness of your disability. You should submit all existing medical records with your application, including treatment from VA Medical Centers as well as care youve received at a private facility. If you dont believe your disability is adequately described in your medical records, you can include letters from people you served with, family members, friends, clergy members, or law enforcement that describe your disability and how it developed as part of your supporting evidence.

You may be required to attend a VA medical exam as part of the application process. If you do not attend this appointment, your application will not be approved.

Veterans can read through the rating criteria and determine how their symptomology lines up with what is listed. Furthermore, veterans can have private doctors evaluate the severity of their conditions in relation to what is listed in the rating criteria. Veterans can then submit their private doctors opinions to VA. this may be beneficial in developing a more convincing case for a 100 percent disability rating.

The difference between a 100 percent VA disability rating and a 90 percent VA rating is over $1,000 a month. The jump from a 90 percent VA rating to a 100 percent VA disability rating is hard to do on the combined ratings table. If you are currently at 90% and want to appeal, make sure you entitled before going through the lengthy appeal process.

What if I cant work from my service-connected conditions?

If you are having trouble getting a 100 percent VA disability rating, but cant work, there are other options. File For A Rating Increase For A Worsened Condition

If you feel that your initial rating is no longer satisfactory due to your condition having gotten worse, you may file a claim for an increased rating based on new and relevant evidence that shows that your disability has worsened. The VA treats claims for increased ratings the same way it treats original claims and will assign a rating based on the evidence you submit. As such, the VA could either increase or decrease your rating.

Not All Va Disability Ratings Are Awarded At The Maximum

All that said above, you may not be awarded the maximum amount of compensation for a specific medical issue, or you may have been awarded the maximum amount for an issue as-is without added complications.

In those cases, when the condition gets worse or begins showing signs of complications, you may be fully justified in getting your case reviewed by the VA to see if more compensation and treatment are needed.

If you dont know the maximum VA disability rating for your condition in its current state or whether certain complications may increase your eligibility for more care and disability pay, you should definitely review the VA Schedule For Rating Disabilities at the VA official site to see what your options are.

How To Get A Range Of Motion Test For Back Pain

To assess VA disability for back problems, the VA most often uses the General Rating Formula for Diseases and Injuries of the Spine to evaluate them. Their rating is determined most commonly by assessing your range of motion. Their formula looks at the flexion at the waist and determines if it is limited by injury.

According to the VA, flexibility must be fairly limited to even get a 20 percent disability rating. This will be determined on whether there is forward flexion greater than 30 degrees but less than 60 degrees. Meaning that if you are significantly limited in your ability to bend at the waist, you might qualify for the 20 percent rating. Usually, previous diagnoses from doctors or therapists will be used to determine this.

The range of motion method of determining your VA benefits rating generally will end up as one of the following:

Of course, a limited range of motion is not the only way to get VA disability for back problems. It is also possible to obtain at least a 20 percent rating if you are regularly experiencing muscle spasms severe enough to develop an abnormal walking gait. They will also evaluate you for the following abnormal spinal contours:

  • abnormal kyphosis
  • scoliosis
  • or reversed lordosis .

What Are Va Disability Ratings

VA disability ratings are percentages assigned to service-connected conditions based on the severity of the conditions. VA uses the VA Schedule for Rating Disabilities to assign diagnostic codes and disability ratings for service-connected conditions. The VASRD is located in Part 4 of Title 38 in the United States Code of Federal Regulations. The VASRD explains how conditions will be evaluated for purposes of receiving a VA disability rating.

Each rating criteria will describe symptoms and/or treatment for the specific condition, and VA will assign a percentage, ranging from 0 to 100, according to each set of criteria. These ratings are assigned at 10 percent increments. Overall, VA disability ratings are meant to compensate veterans for the average impairment in earning capacity caused by their service-connected condition. Generally, the more severe a disability is, the higher the VA disability rating will be.

Each percentage increment corresponds to a dollar amount. In other words, the higher the veterans disability rating, the more compensation they will receive each month. When a veteran has multiple service-connected conditions, each with its own individual rating, VA does not simply add them together they are combined using VA Math.

% Disability Rating For Knee Replacement Surgery

Va Disability Pay Chart 2021

Sometimes a knee injury can become so severe that it warrants knee replacement surgery. If you suffer extreme knee pain daily, experience pain when you move your knee, or cannot move it at all, knee surgery might be necessary. Regardless of what your disability rating was prior, you are automatically entitled to receive a disability rating of 100% if youve had knee surgery. This rating runs for the first year following your knee surgery, according to the 38 CFRsection 4 knee rating chart.

A year after the knee replacement surgery, your knee condition will be re-evaluated by the VA and receive a new rating. The minimum rating following knee joint replacement surgery is 30%. A 60% disability rating is given for one year following the surgery if motion in the knee continues to be painful.

Partial knee replacement surgery doesnt have a minimum rating. The rating will depend on the symptoms you experience. However, for partial knee surgery, you should receive a rating of 100% for a year following the procedure.

While 60% is generally the highest rating the VA will assign for knee amputations, you may be able to increase your rating if you experience symptoms of phantom limb pain.

Back Pain For Veterans

Spine impairment is one of the leading causes of disability among veterans. Because most of those serving in the military frequently carry and lift heavy loads or engage in quick shifting and running in the line of duty, there is repeated stress and trauma on the joints which affect the health of the spine.

Fortunately, this fact has become more recognized by the VA and those creating policies for the VA. However, it is still important you know how to communicate your pain in order to receive the best possible benefits. Understanding the rules used to determine VA disability for back problems and their ratings will be helpful as you pursue help.
