Age 65 Or Older Or Disabled Exemptions Frequently Asked Questions

Translation:

There are several types of exemptions you may receive.

You may apply to the appraisal district up to one year after the date you become age 65 or qualify for disability or up to two years after the taxes are due. If your application is approved, you will receive the exemption for the entire year in which you become age 65 or become disabled and for subsequent years as long as you own a qualified homestead. Beginning in 2005, if your date of birth was on your original homestead application or other written correspondence to the appraisal district about your homestead you will automatically receive the age 65 or older exemption without applying, if you are entitled to the general homestead exemption.

You are eligible if you qualify to receive disability benefits under the Federal Old-Age, Survivors and Disability Insurance Program administered by the Social Security Administration. Disability benefits from any other program do not automatically qualify you. To prove your eligibility, you may need to provide the appraisal district with information on your disability. Contact your local appraisal district for information on what documents are required to prove eligibility.

How Do I Claim The Exemption

To claim the exemption, you must file an application with the appraisal district. The application must include documentation of your disability. The application form is entitled “Application for Residential Homestead Exemption.” This form can be obtained from the Information and Assistance Division for the Harris County Appraisal District. In it, you should complete all applicable information. Be especially certain to mark the box that recognizes your claim for the disability exemption. You must also provide medical documents verifying that you meet the definition of disability given above. The most common reason for denial of this exemption is failure to include adequate documentation.

Social Security Disability Insurance benefits vary depending on a number of factors. If your claim is approved, you will receive cash payments in amounts that depend on your personal earnings record. This could average anywhere from $800 to $1,400 a month.

Once you collect benefits for a full 24 months, you will automatically become eligible for Medicare. If you have a low enough income, you can also qualify for Medicaid prior to qualifying for Medicare.

Disability Evaluation In Texas

Once Social Security determines that a claimant in Texas meets basic eligibility criteria for either SSI or SSDI, the agency sends the claimant’s file to Texas’s Disability Determination Services agency. Texas’s DDS is a part of the Department of Health and Human Services. Claims examiners who work at DDS review medical information in the claimant’s file and decide whether the claimant has a condition that meets Social Security’s definition of disability.

DDS has just one office, in Austin. Its mailing address is: Division of Disability Determination Services, P.O. Box 149198, Austin, TX 78714-9198, and its telephone number is 252-7009.

Social Security Disability Evaluation Process

While there are some conditions that the Social Security Administration considers so severe that they automatically render an applicant disabled, many conditions require careful screening, including answering these five questions:

  • Are you currently working? If you are working, you are not blind, and your earnings average more than $1,310 per month in 2021, then you will not be considered disabled. If you are not working, or if your income falls below Substantial Gainful Activity limits, move on to question two.
  • Is your condition severe? If Social Security determines that your condition does not interfere with basic work-related activities, then you will not be considered disabled. If your condition does interfere with basic work-related activities, move on to question three.
  • Is your condition found in the list of disabling conditions? Social Security maintains a list of disabling medical conditions that automatically qualify you as disabled. If your condition is not one of these, then Social Security will determine if it is severe enough to qualify. If so, you will be considered disabled, and your application will be approved. If not, move on to question four.
  • Can you do the work you did previously? If your condition does not interfere with your ability to do the work that you used to do, then you will not be considered disabled. If it does, move on to question five.
  • In addition, qualifying conditions must be expected to last at least one year or result in death.

    What Are My Back Benefits

Every Social Security Disability case takes time to prepare, file and process.

It can take as much as a few weeks or months from the day you apply to receive a Final Decision.

If you need to appeal your case to a Social Security Administrative Law Judge, it can take more than a year to have a hearing. Recent numbers from Texas put the wait at almost 14 months.

During all that waiting time, though, you still have serious health problems, and you still cant work.

The Social Security Administration recognizes this, so for Social Security Disability cases, it awards you back pay covering the time since the day it determined your disability began.

This back pay can add up starting a year before your application date.

In the other disability benefits program run by Social Security, Supplemental Security Income or SSI you get back pay covering the period starting the month after you submitted your application until the day your benefits are approved.

Your chances of winning benefits are better if you have a professional representing you.

Youre already dealing with serious health problems and money stress. At the Makris Law Firm, were glad the system is designed to save you from financial risk in working with a lawyer.

Seriously Do You Really Need To Understand Your Short

Heres the short answer: yes. While its not exactly a fun topic to think about, its important that you familiarize yourself with the details of your planso you dont have to get up to speed when you actually need the benefit.

However, wading through our own plan documents is a step that most of us skip. That informational booklet is immediately relegated to our desk drawer or filing cabinet.

Do you remember the first day you started your job? Its kind of a firestormyou cant focus well or often, says McDonald. So we dont spend a lot of time achieving clarity about the benefit in the beginning. We only acquire an understanding of it when we are in deep need of the benefit.

But particularly if you have an existing problem or condition, youre going to want to know the ins and outs of the benefit thats available to you.

Anybody who goes into a new job and has any kind of serious medical condition that could at some point in time render them unable to work, I think its a good idea to be able to see the actual short-term and long-term disability plan documents to see how they define disability and how they handle pre-existing conditions, adds Bartolic.

Ideally, youll never have to take advantage of your short-term disability benefits. But in the event that the unexpected happens, youll be glad that you took the time to understand whats offered to you. This explainer is a good place to start, but you also need to read through the details of your specific plan.

    Adults Disabled Before Age 22

An adult who has a disability that began before age 22 may be eligible for benefits if a parent is deceased or starts receiving retirement or disability benefits. We consider this a “child’s” benefit because it is paid on a parent’s Social Security earnings record.

The disabled “adult child” including an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild must be unmarried, age 18 or older, have a disability that started before age 22, and meet the definition of disability for adults.

    Example

It is not necessary that the disabled “adult child” ever worked. Benefits are paid based on the parent’s earnings record.

    • A disabled “adult child” must not have substantial earnings. The amount of earnings we consider “substantial” increases each year. In 2021, this means working and earning more than $1,310 a month.

How Much Can Family Members Receive In Ssdi

Social Security also provides payments for spouses and children of workers who qualified for SSDI benefits.

The amounts that family members can receive including widows, widowers and adult children with disabilities depend on how much the worker with a disability worked and earned.

In late 2017, spouses of workers with disabilities received an average of about $329 per month, according to SSA numbers. Children of workers with disabilities received an average of $358 per month.

Benefits For Disabled Widows Or Widowers

If something happens to a worker, benefits may be payable to their widow, widower, or surviving divorced spouse with a disability if the following conditions are met:

    • The widow, widower, or surviving divorced spouse is between ages 50 and 60.
    • The widow, widower, or surviving divorced spouse has a medical condition that meets the definition of disability for adults and the disability started before or within seven years of the worker’s death.

Widows, widowers, and surviving divorced spouses cannot apply online for survivors benefits. However, if they want to apply for these benefits, they should contact Social Security immediately at 1-800-772-1213 to request an appointment

To speed up the application process, complete an Adult Disability Report and have it available at the time of your appointment.

We use the same definition of disability for widows and widowers as we do for workers.

    Average Indexed Monthly Earnings

First, the SSA will determine your AIME. To do this, the SSA will adjust, or index, your lifetime earnings to account for the increase in general wages that happened during the years you worked. This is done to make sure that the payments you get in the future mirror this rise.

The SSA will use up to 35 of your working years in the calculation. The SSA takes the years with the highest indexed earnings, adds them together, and divides them by the total number of months for those years. The average is then rounded down to reach your AIME.

You can see an example of how the SSA calculates an AIME on its website.

Get The Maximum Benefits You Deserve

Until you win your disability claim, its impossible to say exactly how much money youll get, but we can show you how to get a pretty close estimate.

Getting benefits is not easy, which is why most people hire an attorney to help them. Most people get denied on their first attempt and give up.

If that happens to you, you should appeal because thats when many people do finally get their benefits. Work with an attorney who knows Social Securitys complicated process and take some of the burden off yourself as you apply or appeal.

Makris Law Firm has over 40 years of experience helping Texans when they need it the most. We fight to get the maximum possible benefits for you.

Health problems stopped you from working. Youre struggling with a loss of income. Hiring a lawyer for your Social Security Disability claim sounds expensive.

    But its not.

In fact, the Social Security system is designed to make it easier for you to afford help with your disability application or appeal:

    • You pay no attorneys fee up front.
    • You dont pay any fee unless you win.
    • You never pay a fee out of your pocket. When you win benefits, the money for your attorney comes from back benefits that Social Security awards you.
    • Social Security sets a cap limiting how much your attorney can collect from those back benefits.

Social Security Disability attorneys fees are governed by federal regulations. So just about every disability lawyer works the same way.

Early Retirement: Should You File for Disability or Retirement Benefits?

When you take advantage of your short-term disability benefit, your time off is paidbut that doesnt necessarily mean youll be getting your full paycheck.

The amount youll earn is dependent on your specific plan. Some plans offer full salary replacement, but most dont. Instead, they offer a percentage of compensation with a dollar amount cap.

There are also programs that award you different amounts based on your longevity with the company, says McDonald. If you are there for 10 years and have a 26-week disability period, you might get three months at 100% and then three months at 50%.

If you live in one of the five states where short-term disability benefits are mandated, then the amount youll be compensated will be regulated as well.

    • Medicare Part A helps pay for inpatient hospital stays, care in a skilled nursing facility, hospice care, and some home health care. The taxes you paid while you were working financed this coverage. Its provided at no cost to you.

Most people have both parts of Medicare. If you have questions about this coverage, you can contact Medicare toll-free at 1-800-MEDICARE to speak to a Medicare Customer Service Representative. TTY users should call 1-877-486-2048.

Special Rules For People Who Are Blind Or Have Low Vision

We consider you to be legally blind under Social Security rules if your vision cannot be corrected to better than 20/200 in your better eye or if your visual field is 20 degrees or less, even with a corrective lens. Many people who meet the legal definition of blindness still have some sight and may be able to read large print and get around without a cane or a guide dog.

If you do not meet the legal definition of blindness, you may still qualify for disability benefits if your vision problems alone or combined with other health problems prevent you from working.

There are a number of special rules for people who are blind that recognize the severe impact of blindness on a person’s ability to work. For example, the monthly earnings limit for people who are blind is generally higher than the limit that applies to non-blind disabled workers.

In 2021, the monthly earnings limit is $2,190.
