However, ADA rules and guidelines can be a bit murky. The ADA considers substance abuse to be a disability but, much like the FMLA, contains exceptions for substance abuse.

The ADA offers protection to employees to qualified alcoholics. These are addicts who can perform their job with or without any extra reasonable accommodations.

An employee suffering from alcoholism may claim reasonable accommodations under the ADA. As a general rule, reasonable accommodations typically consist of unpaid time off for the purpose of treatment. Employees may seek unpaid leave for the purposes of treatment. They may also request modified work schedules to attend treatment programs.

Why Do Offsets Exist

Disability policies have language about offsets to ensure you will receive a percentage of your pre-disability earnings from all sources. This allows the insurance company to pay less money if you are receiving payments from other income sources.

Many disability insurance carriers also argue that offsets help keep policy premiums low.

While many policyholders think offsets may not apply to them for example, if they are not receiving Social Security Disability, State Disability Insurance, or workers compensation benefits their policy language may state otherwise.

Who Gets Long Term Disability

Long term disability is a type of insurance some employers offer their employees as a group benefit.

Many employers who offer LTD to their staff pay all of their employees monthly premiums, while some employers require that their employees contribute to all or part of their LTD coverage.

It is optional and not required for Ontario employers to offer long term disability to their employees. There is no law requiring long term disability insurance in Ontario. Moreover, employers who offer LTD are not required to pay for it. Employers can technically pass on all the costs of an LTD plan to their employees.

Generally speaking, in my experience, group long term disability benefits are more likely to be offered by larger corporations and public employers and less likely to be offered by smaller employers.

Nevertheless, individual employees can buy long term disability on their own if their employer does not offer a group plan. In this case, individuals should contact a licensed insurance advisor for more information.

Disability And Leaving The Public Service

You should immediately notify your manager if your physician has certified that your illness is continuing and you are unable to return to work. Your manager may grant you leave without pay for a period sufficient to enable you to make the necessary adjustments and preparation for separation from the public service.

How Much Does California State Disability Insurance Pay In Benefits

Your weekly benefit amount is calculated using a base period consisting of 12 months. SDI then takes that 12-month base period and divides it into four quarters. The quarter when you earned the most money is the quarter they use to decide your benefit amount.

You must have earned at least $300 in your base period, and you must have paid SDI taxes on those earnings . Your base period does not include wages paid at the time your disability begins.

Your weekly benefit amount is about 60 to 70 percent of wages earned, up to the maximum weekly benefit amount. The minimum benefit amount is $50 per week up to a maximum of $1,357 per week.

Filing A Claim For Sdi

You can file a claim online at the SDI Online page of EDD’s website or you can file Form DE 2501, Claim for Disability Insurance Benefits, which you can request be mailed to you from the EDD website. You have only 49 days from becoming disabled to file a claim. You’ll also need to ask your doctor to fill out a medical certificate of disability or register online and certify your disability online.

If the EDD approves your application for SDI benefits, you will be sent a notice of eligibility, which will include an estimate of your weekly benefit amount.

The General Design Of An Std Policy

Most STD policies have the same general design. You, or your employer, pay a monthly premium to be covered.
