Veterans who are Florida residents and were honorably discharged with a service-related total and permanent disability may be eligible for a total exemption from ad valorem taxes on property they own and use as their homesteads. A similar exemption is available to disabled veterans confined to wheelchairs.

Valuation Appraisals For Hst Tax

Due to regulations instituted by the Province of Ontario on the 1st of November 2004 all vehicles over 20 years of age will now require a HST appraisal or insurance document to allow registration of the vehicle in your name.

Payment for retail sales tax on the greater of the wholesale value or purchase price from the bill of sale. Please note that for a passenger and light commercial vehicle 20 years or older, the Retail Sales Tax is payable on the greater one of the following: the purchase price, the replacement value for insurance purposes, or the appraised value. An appraisal document or insurance document showing the value of the vehicle must accompany the bill of sale.

Personal Property Disabled Veteran Tax Exemption

Section 6 of Article X of the Constitution of Virginia was amended effective January 1, 2021 to establish the exemption from local property taxation for one vehicle used primarily by or for a 100% service-connected, totally and permanently Disabled Veteran. The vehicle may be owned by the Disabled Veteran or their spouse .

Disability

  • The United States Department of Veterans Affairs must have determined that the veteran has a 100% service-connected, total and permanent disability or a total disability rating based on individual unemployability due to a service-connected disability.
  • Documentation from the Department of Veterans Affairs must be provided with the first request.

Personal Property Ownership

  • The motor vehicle must be owned by the veteran and/or spouse.
  • Once a vehicle has been selected to receive the exemption, another vehicle can only be selected if the original vehicle is disposed or sold.
  • In February each Disabled Veteran is mailed a form on which he/she can designate a different vehicle to receive the exemption for that tax year.
  • Leased vehicles and vehicles owned by a business will not qualify.

Who Qualifies For Veteran Exemption

In order to qualify for this exemption, the claimant may not own property, real or personal, worth more in aggregate than $5,000 if the claimant is single. If married, the couple may not own property worth more than $10,000. In addition, the claimant must have lived in California on the lien date, January 1.

How to Avoid Sales Tax on a Car Legally

Veterans with a service-connected disability may be eligible to receive financial assistance from the U.S. Department of Veterans Affairs towards the purchase of a vehicle. Eligible veterans must have VA approval prior to making the purchase. The VA will pay the approved amount directly to the seller and the approved veteran is responsible for paying any remaining cost of the vehicle to the seller. The portion of the vehicle’s purchase price paid by the approved veteran is subject to sales or use tax. The portion of the vehicle’s purchase prices paid by the VA is considered a sale to the U.S. Government and not subject to sales or use tax.

ExampleYou are an eligible service member and were approved by the VA for a $5,000 allowance towards the purchase of a vehicle. The total purchase price of the vehicle is $10,000 you and the VA each pay $5,000 directly to the seller. Sales or use tax applies to the portion you paid to the seller i.e., $5,000.

Yes for some disabled veterans and families. The following are eligible for the exemption:

  • Veterans receiving Disability Compensation at a rating of 50% or higher
  • Veterans receiving Non-Service Connected Pension
  • Veterans collecting permanent military retirement pay for a medical military retirement
  • Surviving spouses of veterans who had received the exemption Application

The exemption level varies from town to town. State law mandates a minimum $10,000 exemption, although towns are given the option of increasing the exemption to $40,000. The exemption reduces the appraised value of the home prior to the assessment of taxes. For example: An eligible veteran lives in a home valued at $200,000. The veterans town provides a $20,000 exemption. The veterans home will be taxed at $180,000. Veterans who would like to have their town increase their exemption must go through their towns local procedures for having a measure placed on an election ballot for town voters to consider.

The exemption only applies to homes that are owned by the veteran or survivor and is the primary residence. Veterans or survivors who rent their homes can not pass this exemption on to their landlord.

Sales tax. Chapter 64H, Section 6, disabled veterans do not need to pay sales tax for one passenger vehicle or pick-up truck. It must be owned by the veteran and used for non-commercial purposes. To be eligible, the veteran MUST obtain DV plates for the vehicle.

Motor Vehicle Sales And Use Tax

Cars, vans, trucks and other vehicles are subject to motor vehicle sales and use tax. Motor vehicles are exempt from tax if they are modified to be used by someone with orthopedic disabilities to help them drive or ride in the vehicle.

The modified vehicle must be used at least 80 percent of the time to transport, or be driven by, a person with an orthopedic disability.

This exemption does not apply to trailers or other vehicles not designed to transport people.

100 Percent Disabled Veteran A veteran owning or co-owning a vehicle is exempt from payment of vehicle license tax or registration fee, if the veteran is certified by the Department of Veterans Affairs to be 100 percent disabled and drawing compensation on that basis.

Reduced Vehicle Tax Rate For Qualifying Disabled Veterans

The Fairfax County Board of Supervisors adopted a lower Vehicle Tax rate of $0.01 per $100 of assessed value on one motor vehicle owned and regularly used by a qualifying disabled veteran in accordance with the Code of Virginia §58.1-3506.

The reduced Vehicle Tax rate is subject to adoption by the Board of Supervisors during their deliberation on the Countys annual budget process.

  • Qualified disabled veteran shall be defined to mean a veteran who meets the disability definition in Virginia Code §58.1-3506 and is not eligible for a motor vehicle tax exemption authorized by state law.
  • Only one vehicle may be taxed at the lower rate for each qualifying disabled veteran.
  • Disabled veterans need only apply once, but must contact our office to receive the lower rate on a different vehicle should the approved vehicle be otherwise moved, sold, or disposed.
  • Co-ownership does not prevent a disabled veteran from qualifying for the lower rate. The reduced rate, however, does not apply to a vehicle owned solely by a spouse or a surviving spouse.
  • Applicants will be required to provide official documentation from the U.S. Department of Veterans Affairs that verifies the disabled veteran has been rated by such agency to have a “100% service-connected, permanent, and total disability and has either lost, or lost the use of, one or both legs, or an arm or a hand, or who is blind.”

In 1992 the Board of Supervisor approved a reduced tax rate for Disabled Veterans on one motor vehicle owned and regularly used by the veteran. This reduced rate is available to taxpayers who qualified under provisions of Code of Virginia, Title 58.1.3506 and Roanoke County Ordinance 121592-11. These provisions are as follows:

However – if you currently have a Disabled Veterans license plate on your vehicle issued by the Department of Motor Vehicles we do not need the above letter from the Department of Veterans Affairs to qualify you for the Disable Veterans Personal Property tax rate.

Vehicles Exempt From Sales Tax

There are several vehicles exempt from sales tax in New Jersey. To claim your exemptions you must visit a motor vehicle agency. If you wish to claim exemptions other than the ones listed below, contact the MVC Sales Section of the New Jersey Division of Taxation at 984-6206.

Sales Tax Exemptions

Exemption #1 â For vessels only:

  • Purchaser is a non-resident of NJ, is not engaged in or carrying on in NJ any employment, trade or business in which the vessel will be used.

Exemption #2 â Vehicle is acquired by:

  • Federal government or one of its agencies.
  • State of New Jersey or one of its agencies or political subdivisions.
  • United Nations or any other international organization of which the United States is a member.

Exemption #3 –

  • Vehicles used directly and exclusively for production or the sale of farm products.
  • School buses used for transportation of school children.

  • Used mobile homes .
  • Limousines
  • Low Speed Vehicles if certified by the Commissioner of the New Jersey Department of Environmental Protection .
  • 100% Zero Emission Vehicles – Exempt Use Certificate required.
  • Resident service member .
  • Vehicles for tax-exempt organizations with a 9-digit exemption number from the New Jersey Division of Taxation.

Exemption #4 –

  • The vehicle was purchased by a leasing or rental company from a non-registered vendor. To be a valid exemption, you must be registered for New Jersey sales tax.

Exemption #5 –

  • Vehicle was acquired by an heir, legatee or trust beneficiary.
