Once a medical professional determines that the employees total temporary injury has healed, the employee can return to work and will no longer receive disability benefits. Payment For Lost Wages

If the doctor says that you are unable to return to work due to your injury or you are off work recovering from a surgery, you may be entitled to temporary total disability benefits. If the doctor states that you can perform light or modified duty work and your employer offers you such work, you may not be eligible for TTD benefits. Benefits are available for survivors of air ambulance pilots, air ambulance registered professional nurses, emergency medical technicians, firefighters, law enforcement officers, and volunteer firefighters, and, for deaths occurring on or after August 28, 2018, for survivors of air ambulance registered respiratory therapists, flight crew members, and public safety officers who are killed in the line of duty when:

  • Death was caused by an accident or the willful act of violence of another
  • The deceased person was in the active performance of his or her duties in his or her respective profession and there is a relationship between the accident or commission of the act of violence and the performance of the duty, even if the individual was off duty; the deceased person was traveling to or from employment; or the deceased person was taking any meal break or other break which took place while that individual was on duty

  • Death occurred within three hundred weeks from the date the injury was received
  • However, death in the line of duty does not include death resulting from willful misconduct or intoxication of the deceased person

Qualifying For Total Permanent Disability

A person will;not likely qualify for permanent total disability benefits;until the associated;medical condition is fixed and stable. What this;means is;as long as there are additional, curative treatment options available, or a;doctor thinks you may improve;over time, an insurance company;will not call a person;permanently and totally disabled. Being in this situation doesn’t necessarily mean someone won’t eventually receive TPD benefits, but;it does mean;that a person will have to wait until their;medical treatment is complete.
