What Are Va Disability Ratings And Who Assigns Them

VA assigns disability ratings to veterans with service-connected conditions. A disability rating is based on how severe the veterans condition is and how the disability impairs their earning capacity. VA disability ratings range from 0 to 100 percent using VAs Schedule for Rating Disabilities . When a veteran has multiple service-connected conditions, each with its own disability rating, VA combines them together using VA Math. Importantly, a veterans combined disability rating determines the amount of monthly compensation they will receive.

As of December 1st, 2020 the VA disability rate benefit amounts are as follows:

• 0 percent disability rating: $0.00 per month
• 10 percent disability rating: $144.14 per month
• 20 percent disability rating: $284.93 per month
• 30 percent disability rating: $441.35 per month
• 40 percent disability rating: $635.77 per month
• 50 percent disability rating: $905.04 per month
• 60 percent disability rating: $1,146.39 per month
• 70 percent disability rating: $1,444.71 per month
• 80 percent disability rating: $1,679.35 per month
• 90 percent disability rating: $1,887.18 per month
• 100 percent disability rating: $3,146.42 per month

Many veterans pursue 100% disability ratings because of the amount of compensation and additional benefits associated with it. Therefore, it is important to note that there are multiple types of 100% VA disability ratings that veterans can obtain.

I Am Rated 40% By The Va For One Disability And 10% For Another Why Isnt My Overall Rating 50%

If a VA compensation claim results in a benefit approval, the VA will assign a disability rating. A VA benefit award can result in a combination of several disabilities, which are rated at different percentages.

For example, a veteran can have one rating of 40% for a back injury, a rating of 10% for tinnitus, and a rating of 20% for a knee injury. The combined rating is not the sum of the individual ratings.In this example, the combined rating is not 70% . Rather the combined rating is 60%.

The combined rating is based upon a series of calculations, which the VA describes as the efficiency to perform work factor. The calculations begin with sorting the individual rating percentages descending from the highest to the lowest rating. In the example under consideration, you sort the percentages descending from 40% to 20% to 10%. Then, subtract the highest from 100% .

When the VA establishes that the veteran is 40% disabled for the back injury, that veteran has a remaining efficiency to perform work at a 60% level. Then, looking at the example, the veteran is 20% disabled from the knee injury. The next calculation takes this efficiency into account. According to the VA, the veteran can only perform 20% times the 60% of the remaining efficiency, which is 12%. The VA adds this remaining efficiency rating to the first rating of 40%, which results in a combined rating of 52%.

Specifically, if you have multiple non-compensable service-connected disabilities, the VA may assign you a 10% disability rating if the disabilities clearly interfere with your normal employability. Disabled veterans would be able to obtain some compensation through this method.

There are many veterans in the United States who have multiple non-compensable service-connected disabilities which affect employability, yet are not receiving any disability compensation that they are entitled to. In addition, there are many disabilities which cannot receive a rating code higher than 0%, and therefore are always non-compensable. Finally, there are many disabilities which can be compensable, but, as explained above, a veteran does not manifest specific ailments or symptoms required for a higher rating than 0%, and therefore, receives a 0% non-compensable disability designation.

Why Your Rating And Benefits Could Decrease

Before you ask for an increase in your VA rating, be sure youre making the request strictly because you believe your disability has become worse. You shouldnt request an increase if:

• You need more money to keep up with the cost of living,
• You have additional financial responsibilities,
• You are suffering sudden financial hardships

The VA wont award an increase for these reasons. But if you believe your condition has truly deteriorated, you can complete and file a form 21-526b, Veteran’s Supplemental Claim for Compensation or a form 21-526EZ to the VA Regional Office stating why you believe the increase is proper and appropriate along with medical evidence that supports the worsening state of your disability.

It seems logical that if youre awarded a higher disability rating, you will receive a larger monthly check from the VA. However, the process doesnt always work that way. Its possible that a small increase added to your rating will have little impact on the amount of your compensation.

For example, if your rating is already at 60 percent, an increase of 10 percent may not impact the bottom line. The VA uses complicated formulas and combined ratings tables to decide the percentage. % Total Disability Based On Individual Unemployability

Total disability based on individual unemployability is a benefit that allows veterans to be compensated at VAs 100% disability rate, even if their combined schedular disability rating does not equal 100% as outlined above. In this way, it is an alternative path to receiving maximum benefits. TDIU is awarded in circumstances in which veterans are unable to secure and follow substantially gainful employment as a result of their service-connected conditions. Here, substantially gainful employment refers to whether a veterans annual income meets or exceeds the federal poverty threshold for a single person.

VA outlines TDIU regulations under 38 CFR § 4.16, which encompasses subsections and . Each subsection describes the ways in which veterans can meet the eligibility requirements for TDIU. In order to qualify for TDIU under 38 CFR § 4.16, or schedular TDIU, a veteran must have:

• One service-connected condition rated at 60% or higher or
• Two or more service-connected conditions, one of which is rated at 40% or higher, with a combined rating of 70% or higher

It is important to note that any service-connected condition, physical or mental, can contribute to TDIU. VA looks at the combined effect of all service-connected conditions. Therefore, veterans do not need to show that one service-connected condition alone prevents them from working.

Calculating Multiple Va Disability Ratings

Multiple disability ratings are a little tricky to calculate and are beyond the scope of this article. But well give a brief overview. In short, the VA uses a special method for calculating multiple disabilities.

Here is a simplified example:

Example: If you have a 30% disability rating, the VA would multiply that against 100%, which is assumed to be good health. This gives you 30%. Subtract that from 100% which leaves you with 70% . Then subtract 70% from 100% and you are left with 30%. If that is your only disability, then your final VA Service-Connected Disability Rating is 30%.

If you have multiple ratings, you continue with the process, using your final number each time as your starting point. Continuing with our example, if your next rating is 10%, you would multiply 10% against 70%, which is 7%. You subtract that from 70%, which leaves you with 63%. Subtract 63% from 100% and you get 37%. Your disability rating is 37%, which rounds up to 40%.

% Schedular Disability Rating

As mentioned above, VA will assign a disability rating based on the severity of a service-connected condition. 100% is the highest possible schedular disability rating there is. There are two ways in which a veteran may be assigned a 100% schedular disability rating. Either the veteran has one service-connected condition that meets the 100% rating criteria specified for that condition, or the veteran has multiple service-connected conditions whose individual disability ratings combine to 100%. Importantly, if a veteran does have a 100 percent schedular rating, either for one condition or multiple conditions, they are fully entitled to continue working. In other words, there are no limitations in terms of employment.

Overall, meeting the criteria for a 100% schedular disability rating can be exceptionally difficult to do. Pursuing this evaluation through another avenue may be more suitable depending on the circumstances of your case.

You can ask the VA to assign you different ratings for different periods of time while your application was pending. This is called “staged ratings.” You can ask the VA to look at the medical evidence and assign you a higher rating for the period during which your symptoms worsened and met the criteria for a diagnostic code with a higher rating. Staged ratings can help you get a higher retroactive benefit payment when it has taken years for your claim to get awarded.

How Does The Va Assign My Rating

To rate your disability, the VA will start at the body system category, locate your diagnosis, and then find the diagnostic code which best matches with your symptoms. The VA is required to carefully review the medical evidence in your file when assigning a rating.

Even if one disability could satisfy more than one diagnostic code, you can only get rated under one code. Where two or more codes apply, the VA must choose the diagnostic code that will give the highest rating.

Sometimes the VA does not apply the rating criteria correctly. Other times, you may feel your disability is more severe than the VA says it is, but it actually has been correctly rated under the criteria in the Schedule of Rating Disabilities.

Va Disability Ratings Are Based On Your Service

The Department of Veterans Affairs assigns disability ratings, based on the severity of the individual condition. The percentage your disability is assigned affects not only how much compensation you may be entitled to receive, but also determines your eligibility for other VA benefits.

Some service-connected injuries or medical conditions dont rate high enough to qualify for certain services or programs that may be provided to those with higher VA disability ratings. For veterans with multiple conditions, the final rating involves a VA-proscribed formula for calculating the percentages as a whole.
