Example Three: Heart Attack

Long Term Disability Insurance Claims – Pre-Existing Conditions

Lets say that our hypothetical person went out of work, again in April of 2017, due to a heart attack. The insurance company gets all the medical records, and they go back to October, November, and December 2016, to see if the person was getting any kind of treatment for a heart problem, and found that the person was taking blood pressure medication for high blood pressure. The insurance company is going to argue that this treatment was relating to a heart condition, or that the individual took drugs or medicines prescribed or recommended by a physician for treatment of that type of condition, and they may deny the claim because you were experiencing blood pressure problems during the lookback period.

In that type of case, weve argued that theres a distinction between high blood pressure and ultimately stopping work due to a heart attack, that you should pay benefits because they are not the same condition. Its a new and materially different condition that they stopped working because of. Youll need to identify either a condition that you did not get treatment for during the lookback period, or that your condition is so materially different than what you received treatment for back during the lookback period, that you should still be entitled to benefits. Thats where things can get a little bit tricky.

What Are Disability Insurance Exclusions

Disability exclusions are specified conditions listed in your policy that the provider has stated they will not cover. Some exclusions are general and will apply to all applicants, while others can be related to a pre-existing condition. Theyll only provide coverage for conditions unrelated to listed exclusions.

An example is if you have lingering back pain. The company can offer you a disability plan that excludes any claims related to back pain.

If your back pain gets worse and youre unable to work, the company wont pay any benefits. But if you break your leg and have to miss work, the company will pay your disability benefit.

Policy Brief & Purpose

Our short-term disability policy refers to the companys provisions for paid leave to employees who are medically unable to work for a short time. The company believes that its employees should receive some benefits during an unfortunate time when they will not be able to work. That way we can ensure that they will not struggle to live or spend all their savings to do so.

The company will respect any legal guidelines that may be in effect so the present policy is complementary to the law. It is designed to clarify details and procedures related to short-term disability benefits that the company may offer through relevant short-term disability insurance.

What Qualifies For Short Term Disability Insurance

Short term disability insurance covers temporary injuries and illnesses that are less serious in nature. Like long term coverage, what qualifies for short term disability depends on the definition of disability, which varies from policy to policy. In general, eligibility for benefits is tied to your ability to perform the duties of your current occupation.

Your short term disability insurance policy may also require that you lose a certain percentage of earnings due to disability. During your short term disability leave, you may be required to provide the insurance company with updated medical information to verify your disability and continued eligibility for benefits beyond the initial approval of your claim.

In addition to injuries and illnesses that limit your ability to work, surgical procedures that are deemed medically necessary will qualify you for short term disability benefits. Some policies will provide benefits for bariatric weight-loss surgeries. Organ donation is usually covered as well. Purely cosmetic procedures will likely not be covered.

You may also qualify for benefits if prescription medications or medical procedures cause side effects that keep you from working.

Exclusions In Long Term Disability Policies

Can My Long Term Disability Claim Be Denied for a Pre Existing Condition?

Carefully reviewing your long-term disability policys exclusions can help you be better prepared when it comes time to file a claim for benefits. Besides pre-existing conditions, the following limitations could be noted in your policy:

  • Mental/nervous limitation
  • Alcohol and substance abuse limitation
  • Other exclusions
  • Aircraft injuries
  • War injuries or acts of war
  • Attempts of suicide
  • Injuries on the job
  • Intentionally causing a disability

Again, insurance companies take a wide-approach when it comes to denying claims over exclusions. Consulting a disability lawyer for any of the above limitations will be in your best interest when filing a long-term disability claim.

  • $135 per month for the same policy, only with a $3,500 monthly benefit .
  • $129 per month for the same policy, only with a 12-month benefit period.
  • $43 per month for the same policy, only with a 30-day waiting period.

What Is The Reconsideration Period

The reconsideration period is a specified amount of time you have to try and remove an exclusion from your policy. An exclusion can be removed if you demonstrate that your condition has improved and is no longer affecting you.

You will have to provide documentation from a doctor to your insurance company stating that your condition has improved enough to have it removed as an exclusion. It can take a few months to a couple of years to determine your health status.

The reconsideration period for Social Security disability is slightly different. This is when you can appeal a disability claim denial if you believe it was wrongly denied.

How Can I Get Disability Insurance With A Pre

Short

Getting coverage will depend on your situation and policy.

Here is a brief overview of when you can get disability insurance with a pre-existing condition, when you might be able to and when you cant.

  • When you can get coverage. State temporary disability programs will sometimes cover pre-existing conditions without a waiting period. Insurance companies are more comfortable offering broad coverage in this situation because its collecting a premium on a large group of people, so theres less risk for the company.
  • When you may get coverage. The insurance company will offer you a policy even though you have a pre-existing condition. However, it will exclude that pre-existing condition from any type of coverage. This means that if you have a disability that can be related to your pre-existing condition, the company will deny the claim. However, it will pay for any new covered disability that is not directly related to your pre-existing condition. The insurance company might only exclude coverage on your pre-existing condition during the probationary period, which is typically one to two years from the start of your policy.
  • When you cant get coverage. Some insurance companies will deny your application if you have a pre-existing condition. They put in place strict underwriting guidelines to avoid any risks of paying out benefits for pre-existing conditions in the long term.

Disability Insurance With A Pre

If you have a pre-existing condition, whether you qualify for disability insurance and how much you pay for coverage will vary by insurance company. It also depends on the severity of the condition and whether the condition is covered by the policy.

Some pre-existing conditions will automatically disqualify you from coverage if youre still suffering from the condition when you apply for disability insurance. Cancer is one of these conditions, but insurance companies may still offer you coverage if youve been in remission for three to five years . In this case, you can get disability insurance, but you won’t be able to claim due to cancer.

You could also be declined for disability insurance if you have a mental or behavior conditions, such as anxiety. If your anxiety requires medical treatment or medication, your insurer may consider you higher risk and treat it as a pre-existing condition when you apply for disability coverage.

If you dont mention your pre-existing conditions when applying, and the underwriters somehow dont find out about them, they may cause you to be denied benefits when you do file a claim.

The best way to ensure that youll receive disability insurance benefits when you become injured or ill and cant work is to lay everything out when you apply. If you have a pre-existing condition, a licensed agent at Policygenius can help you get disability quotes and find a long-term disability policy that meets your needs.
