Get Help From A Board Certified Attorney

Social Security Disability and Type II Diabetes

You should get legal advice from an attorney if your claim is denied. However, you should not settle for a general practice lawyer that only accepts a handful of SSDI claims a year. The board certification program for Social Security Disability Advocacy by the National Board of Trial Advocacy will help you find a lawyer that is experienced with SSDI law. The NBTA is not a referral service, but you can trust that an attorney who has completed the board certification process has the ability and experience to handle your claim with the SSA.

To earn certification as a board-certified lawyer in social security disability law by the NBTA, an attorney must provide substantial involvement in cases related to this specialty area of the law by spending at least 30 percent of his or her time in the specialty area during each of the last three years, being involved in at least 100 SSDI hearings, filing at least 20 appeals council briefs and 10 federal court briefs, and fulfilled certain educational and CLE requirements related to the SSAs disability law.

Contact Ortiz Law Firm today to schedule your free consultation. During your consultation, we will get additional information about your diabetes and any related medical conditions, walk you through the SSDI and SSI benefits claim process, and discuss the many benefits of forming an attorney-client relationship with the firm. Diabetes And Social Security’s Disability Listings

In 2011, Social Security removed its disability listing for endocrine disorders, including diabetes, from its Blue Book, a list of impairments that automatically qualify for disability. As a result, it’s no longer possible to get approved for disability based on a disability listing specifically for diabetes, but you may be able to “meet” other listings in the Blue Book depending on the severity of your symptoms. For example, a person can match the requirements for Listing 11.14 for peripheral neuropathy, when he or she, in spite of treatment, experiences involuntary movements, tremors, or partial paralysis in two extremities that makes it difficult to walk or use his or her hands. Diabetic retinopathy that causes less than 20/200 vision in the better eye would meet Listing 2.02.

Other complications related to diabetes, from kidney failure to cardiovascular issues to amputation of a limb, could also meet or “equal” one of the Blue Book listings.

Note that diabetic children under 6 who require daily insulin or 24-hour supervision will be automatically found to meet Listing 109.08 until they reach age 6.

Type 1 Diabetes Disability And The Role Of Legislation In Advocacy

9 Apr 2021, 11:48 a.m. in Global Stories by Pramita Jasuja

Every new type 1 diabetes diagnosis can be intimidating, both for the person and the family members. Many people with T1D are told they should be able to live a “normal” life and that they can do everything that a person without diabetes can do.

As a newly diagnosed child with blood sugar levels of over 570mg/dl, all that was on my mind was T1D. But a year post-diagnosis, when daily needles became the new normal, I was told by my family that I was completely fine and that there was no need to tell anyone about my medical condition. I am normal was stuck in my mind and I took it very seriously. So much so, when my endocrinologist asked me as the “patient to sit near her chair, I replied: “I am not a Patient. Both my parents and the endo smiled.

Insulin is like water. Someone with T1D can not live without it, but medical insurance in India does not cover it, and not every type of insulin is subsidized. So for those with T1D and financial struggles, there are the worries about the price of life-giving insulin and medical supplies.

After considering these facts, lets look at the definition of person with a disability under the Rights of People with Disabilities Act 2016 that was enacted after India ratified CRPWD: a person with long term physical, mental, intellectual, or sensory impairment which, in interaction with barriers, hinders his full and effective participation in society equally with others.”

Plea Asks For Type 1 Diabetes To Be Considered As Disability Kerala Hc Seeks Centre And State Response

The Public Interest Litigation, highlighting the plight of the children and their parents, was filed by a parent of a child who has the condition.

The Kerala High Court has issued notice to both the Union Government and the state seeking response on a Public Interest Litigation to consider the Type 1 Diabetes in the disability list under the Rights of Person with Disabilities Act 2016.

The PIL was filed by Shihabudheen, a parent of a child who has Type 1 diabetes.

Shihabudheen, who lives in Thiruvananthapuram, is also the Vice President of the Type 1 Diabetes Welfare Society.

The PIL also sought directions to implement other welfare measures.

The petition sought to take appropriate steps including issuance of a notification to include Type 1 Diabetes Mellitus generally called Juvenile Diabetes as a disability under the Rights of Persons with Disabilities Act 2016 for all practical purposes.

The petitioners five year old son was diagnosed with Type 1 diabetes Mellitus at the age of two and half years.

Elaborating further, it adds, If the amount of insulin injected doesnt match the exact amount of body needs, the children could end up with too much insulin in their system which leads to low blood sugar. Because of the pancreatic failure, the pancreas cannot shut off the insulin production very quickly, which results in the lower sugar levels, the petition submits.
