  • Are unable to work because of a medical condition that is expected to last at least 12 months or result in death: and
  • Have not been denied disability benefits in the last 60 days. If your application was recently denied for medical reasons, the Internet Appeal is a starting point to request a review of the medical determination we made.

Rules If Somebody Else Helps Pay For Your Food And Shelter

If you are single and pay for your own food and shelter, you get up to $841 per month in SSI benefits. Shelter expenses can include rent, mortgage payments, property taxes, heating fuel, gas, electricity, water, sewer service, and garbage collection. To qualify for this benefits amount if you live alone, you cannot get help paying for these expenses. If you live with other people, you must pay your fair share without getting help.

If someone else pays for some or all of your food and shelter, Social Security may reduce the maximum SSI benefits amount you can get. This is called in-kind support and maintenance and how Social Security counts it depends on your situation.

Does A Medical Condition Have To Match The Listing

An applicant filing for Social Security disability benefits doesn’t necessarily have to satisfy the exact listing requirements for a particular illness or condition to be awarded disability benefits based on the condition. You can be awarded disability benefits if Social Security considers aspects of your condition medically equivalent to the criteria in the listing or a related listing. This is called “equaling a disability listing.”

Alternatively, you can be eligible for disability benefits if you don’t meet or equal the criteria for the medical listing, if your condition limits your functioning so much that you can’t work. Social Security will consider the effect of your condition on your capacity to perform routine daily activities and work and will then determine whether there is any kind of job you can safely be expected to do. This is called qualifying “vocationally” for disability benefits. For more information, see our section on how Social Security decides if your limitations make you disabled.

From there, if the application has to be reviewed at a hearing, it can take up to 12 months just to get scheduled before a judge, Geist said.

“Apply as early as possible, because it is a long process,” Geist said.

A 2020 Government Accountability Office report found that about 1.3% of applicants filed for bankruptcy while waiting on their appeals, and 1.2% died before receiving a final decision.

“Many particularly those without legal representation end up wrongfully denied on multiple occasions before finally being approved with a lawyer’s help,” said Rebecca Vallas, senior fellow that the Century Foundation. “Untold numbers spend what savings they have to try to stay afloat while waiting for an appeal to be heard and countless more lose their homes in the process.”

There are about 8.2 million disabled workers collecting benefits, according to the Social Security Administration. Their average monthly benefit is $1,277.
