How To Speed Up Your Social Security Disability Claim

By Melissa Linebaugh, Contributing Author

Florida, unlike some other states, does not provide short-term disability benefits to those who can’t work. If you live in Florida and you aren’t able to work due to a medical condition, unless you have disability insurance through your employer, the federal disability programs administered by the Social Security Administration are likely your only chance to get disability benefits.

The SSA provides two programs that pay disability benefits: Social Security Disability and Supplemental Security Income . SSDI is available to people who have a qualifying work histories with employers who paid taxes to the SSA. SSI is for people who do not have a qualifying work history and have low income and assets. The definition of disability is the same for both programs, and it is not easy to meet .

Musculoskeletal System And Connective Tissue

The SSA reports that the largest category of diagnoses among disabled workers receiving disability benefits was diseases of the musculoskeletal system and connective tissue. These disabilities, which represented 32.3 percent of the diagnoses, involve damage to ones nerves, muscles, tendons or ligaments. Examples of this type of disorder include:

  • ArthritisAn individual with rheumatoid arthritis, a disorder of the immune system, must experience significant limits on his or her ability to work to qualify for benefits under this medical diagnosis. Rheumatoid arthritis is sometimes referred to as a connective tissue disorder.
  • Back pain Abnormal curvature of the spine may affect an individuals ability to walk as well as the function of other body systems. The intensity of back pain and the limitations on an individuals ability to function are considered in a disability diagnosis related to back pain.
  • FibromyalgiaFibromyalgia is a complex syndrome in which a person has widespread pain in the joints, tendons, muscles and soft tissues that lasts for more than three months. Claims reviewers will try to assess whether there is adequate evidence to show that the condition limits a persons ability to perform any type of gainful work.
  • Reflex Sympathetic Dystrophy RSD describes a range of symptoms that may occur from injury, diseases or surgery. RSD is characterized by intense burning or aching pain typically caused by trauma to a single extremity.

Disability Resource Queen: HUGS of Florida, Inc. Annual Event

Earlier this year, state Rep. Allison Tant, D-Tallahassee, introduced a bill to new specialty license plates including the Florida State Parks Specialty License Plate.

Having gotten that bill over the finish line, Tant is calling on Floridians to preorder the new plates.

I am excited that this plate is now available for Floridians to order. This plate will provide the funding for much needed updates to our state parks to bring them up to ADA standards and to make our parks more accessible for everyone, said Tant at the end of last week. In order for the plate to go into production, it has to receive 3,000 preorders. I encourage everyone to go out and get one of these plates. It is a great way to show your pride for our award-winning state parks.

The new plate can be ordered here.

Tant was elected to the Florida House for the first time in 2020 and represents parts of Leon County. She served as the chairwoman of the Florida Democratic Party.

Benefits Of Working With A Disability Lawyer

Many people think that if they have a good case for eligibility for disability benefits asking an attorney to help you thorough the process is not necessarily required. However, taking into consideration that 60% of claims are denied it is worth hiring a lawyer who will increase your chance of approval. This is because the attorney knows how the SSA deals with applicants due to having dealt with many cases before.

The right documentation is the key to a successful disability benefits claim so a disability attorney will be able to sieve through your documents to check to make sure they are acceptable. If any amendments are required or if any documents are missing your attorney will ensure all your documentation is in order before your initial claim for disability benefits is submitted to the SSA.

If you applied without a lawyer and have been denied it is not too late, contact a lawyer to aid you in the appeal process. There is always a chance of winning disability payments at this reconsideration stage if a lawyer helps you through the process.

Common Examples Of Partial Disability

Whether your disability will be classified as total or partial depends on the rating given by your doctor. The doctor, in turn, will look at not just the disability itself but on how it affects your capacity to work.

For example, am encoder who lost a leg to amputation may still be able to do their job without much hiccup. But if the same disability happens to a construction worker, it can severely impact their working capability.

But in general, the following impairments are considered as a partial disability if the worker is still capable of earning a living:

  • partial amputation
  • loss of vision in one eye
  • post-traumatic stress disorder
