I suggest that if you have someone seeking to collect a debt you advise them you have your Social Security money and unless they meet one of the five exceptions above then they are out of luck.

    Why not wait until you are actually out a year? Simple. It could take up to two years or more for your claim to finally be granted after the hearing and appeals process. Also, you will be paid retroactively to the time of your filing of a claim so waiting too long could jeopardize benefits.

    If you apply and then return to work before the year requirement is met, no problem you can just drop your claim. But then again, if you cannot continue to work you may be eligible anyway!

    Starting in 2018, you also have the right to take time off under New York’s paid family leave law. This new law gives you the right to job-protected leave for eight weeks , ten weeks , or 12 weeks . The benefit amount will be increased over time, from 50% of your average weekly wage in 2018 to 67% percent of your average weekly wage in 2021.

    The New York State Workers’ Compensation Board, under the New York State Department of Labor, oversees short-term disability benefits. New York State law requires that every covered employer provides insurance to cover short-term disability benefits for their employees. Under the Workers’ Compensation Board, the New York State Insurance Fund provides insurance to a vast majority of employers in New York State.
