Please Answer A Few Questions To Help Us Determine Your Eligibility

If you’re eligible for Social Security Disability Insurance benefits, the amount you receive each month will be based on your average lifetime earnings before your disability began. Unlike veterans compensation, workers’ comp, or Supplemental Security Income payments, SSDI isn’t based on how severe your disability is or how much income you haveeverything depends on those lifetime earnings.

Most SSDI recipients receive between $700 and $1,400 per month. But if you’re receiving disability payments from other sources, your payment may be reduced.

Working And Receiving Ssdi Through The Trial Work Program

Recipients of SSDI benefits may take advantage of several programs that allow them to test their ability to work, or to continue working, and gradually become self-supporting and independent.

Under SSDIs Trial Work Period, you can test your ability to work for at least nine months and receive your full disability benefits, regardless of how much you earn. The nine months does not need to be consecutive. It will last until you accumulate nine months within a rolling 60-month period. Overall, an SSDI recipient can spend nine years testing their ability to return to work and maintain eligibility for benefits.

After you complete the trial work period, you begin your Extended Period of Eligibility , which lasts 36 months. During this period, the Social Security Administration will evaluate your work and earnings to determine whether you can work at the substantial gainful activity earnings level.

When the medical expert conducts your WPI assessment, they will typically review your injuries, whether you have any residual medical problems, and whether you have any difficulty performing your daily activities, or Activities of Daily Living. The expert will thereafter make their determination according to specific American Medical Association guidelines. Your Permanent Disability Percentage will usually be assigned after the medical expert finds that your injury is permanent and stationary. What this means is that you have reached Maximum Medical Improvement or the point where your condition has stabilized and is unlikely to improve or change substantially within the next year either with or without medical treatment.

Permanent Disability Percentages are calculated based on a formula that includes the medical experts impairment rating, and it is adjusted for your occupation, your age when you were injured, and your diminished future earning capacity. Your final Permanent Disability Percentage can range from zero percent to one hundred percent. A zero percent rating means that you have no reduction in your earning capacity whereas a one hundred percent rating represents total disability or Permanent Total Disability. If your percentage is between zero and one hundred, your rating is considered to be Permanent Partial Disability.

You Can Work As Long As Your Countable Income Doesn’t Go Above The Ssi Income Limit

By Melissa Linebaugh, Contributing Author

One of the basic requirements for getting approved for disability benefits is that your medical condition is so severe it prevents you from performing a substantial amount of work. The Social Security Administration defines a substantial amount of work, which it calls substantial gainful activity , as earning $1,310 a month from working . Therefore, if you are earning this much from work when you apply for benefits, you will be denied.

However, once you get approved for SSI, the SSA no longer determines whether you are making over the SGA amount. But the SSA will reduce your SSI benefits if you are working by subtracting part of your income from your payment. If you go over the SSI income limit, the SSA will terminate your benefits. In general, though, the SSA encourages SSI recipients to try to go back to work and has created a number of work incentives that let a person work without losing their eligibility for benefits.

Average Indexed Monthly Earnings

In 2019, the average Social Security disability payment totalled $1,234 per month, with some high income earners receiving as much as $2,681. The Social Security Administration will use your earnings history to determine the exact amount youâll receive, but this is a good number to start with.

In order to arrive at the amount youâll receive on a monthly basis, the SSA will use your Average Indexed Monthly Earnings and Primary Insurance Amount to determine the exact amount. Itâs a complicated series of calculations, which is why many people use the average amounts to gauge how much they will receive.

Your AIME is based on up to 35 working years of your earnings history. The SSA will take the highest indexed earnings over the years, add them up and divide them by the number of months in those years. The resulting average is rounded down, and this is your AIME.The SSA will also use your PIA to calculate your disability payments. Your PIA is based upon three fixed percentages – 90%, 32% and 15% – of your AIME. The resulting figures are your âbend pointsâ, which represent the base amount of your benefits.

If this information is overwhelming, the SSA provides the exact amount you would receive if you became disabled in your Social Security Administration statement. You should receive a copy of this document each year, or you can log into the SSA website to access it.

Importance Of The Permanent Disability Rating

States use yourpermanent disability rating to determine the amount of monetarycompensation you will receive to compensate you for your permanentimpairment due to your industrial injury or occupational disease.

In some states, the permanent disability rating corresponds to a certain number of weeksof wages worth of income you will be paid. For example, in California, a10% permanent disability amounts to 30 weeks worth of wages.

Inother states, your permanent disability rating corresponds to an exactdollar figure. For instance, a 8% left knee impairment may equal $4,572.You would receive $4,572, either in installment payments or in a lumpsum.

It is important toremember that permanent disability awards are made near the end of yourworkers compensation claim, after you have reached maximum medicalimprovement and your permanent disability has been evaluated.

Is Your Condition Found In The List Of Disabling Conditions

For each of the major body systems, we maintain a list of medical conditions that we consider severe enough that it prevents a person from doing substantial gainful activity. If your condition is not on the list, we have to decide if it is as severe as a medical condition that is on the list. If it is, we will find that you are disabled. If it is not, we then go to Step 4.

We have two initiatives designed to expedite our processing of new disability claims:

  • Compassionate Allowances: Certain cases that usually qualify for disability can be allowed as soon as the diagnosis is confirmed. Examples include acute leukemia, Lou Gehrigs disease , and pancreatic cancer.
  • Quick Disability Determinations: We use sophisticated computer screening to identify cases with a high probability of allowance.

Vieillet says the intricacies of each program are confusing, even to the experts. For the average person, it can be downright overwhelming.

When letters from Social Security start coming in the mail, they scare the bejesus out of people, says Teresa Nier, benefits and employment manager with My Employment Options.

For disabled workers, joining a free work-incentive program and employment network can help. Ticket to Work offers benefits protection for recipients who want to test the employment waters. And organizations like My Employment Options have certified benefits counselors on staff to help applicants trudge through the paperwork and fine print all while finding a job that fits their unique needs.

To avoid unexpected benefits cuts or having to return overpayments to the agency, people need to keep Social Security updated with phone numbers and addresses, Nier says. Open those letters. Ask questions.

For James, the idea of not working is unsettling. He doesnt want to be a burden.

Im more of an entrepreneur, he says. Im a very social person. Im very outgoing.

I want to try to make this work. Somehow.

Keep in mind that the mere fact that you’re working, even if you are making somewhat less than $1,350 per month, may influence whether a disability claims examiner or a disability judge believes you’re disabled, especially if you’re working more than 15 or 20 hours a week. For this reason, many disability lawyers and representatives will advise their clients not to work while their case is pending.
