Employment Insurance Sickness Benefits

EI sickness benefits are a temporary disability benefit. They are paid through the federal governments employment insurance program. EI pays 55% of your salary for 15 weeks.

To qualify, you must have paid into the EI program recently. You pay through deductions from your paycheque. These are automatic. So, if you got an official paycheque, you paid into the EI program.

You apply for EI benefits online through Service Canada. You can apply from home or at any Service Canada office. Your doctor needs to fill out a form to confirm that you cant work for the 15 weeks that EI covers. And finally, your employer will need to issue a Record of Employment to confirm your sick leave.

What Is The Disability Tax Credit

The disability tax credit is a non-refundable tax credit that helps persons with disabilities or their supporting persons reduce the amount of income tax they may have to pay. An individual may claim the disability amount once they are eligible for the DTC. This amount includes a supplement for persons under 18 years of age at the end of the year.

The purpose of the DTC is to provide for greater tax equity by allowing some relief for disability costs, since these are unavoidable additional expenses that other taxpayers dont have to face.

Being eligible for the DTC can open the door to other federal, provincial, or territorial programs such as the registered disability savings plan, the Canada workers benefit, and the child disability benefit.

Types Of Disability Benefits For Depression

If you become unable to work because of depression, you have a few options. You might be eligible for disability benefits from the government, your employer, or your insurer.

Is My Employer Required By Law To Offer Disability Leave

Only in certain situations. An employer can establish attendance and leave policies that are uniformly applied to all employees, regardless of disability, but may not refuse leave needed by an employee with a disability if other employees get such leave. An employer also may be required to make adjustments in leave policy as a reasonable accommodation for a worker with a disability. The employer is not required to provide additional paid leave, but accommodations for a disability may include leave flexibility and unpaid leave.

A leave policy that is uniformly applied to all employees does not violate the ADA just because it has a more severe effect on an individual with a disability. However, if an individual with a disability requests a modification of such a policy as a reasonable accommodation, an employer may be required to provide it, unless it would impose an undue hardship for the employer.

Work-related injuries must be evaluated on a case-by-case basis to determine if a worker is protected by the ADA. Only injured workers who meet the ADA’s definition of an individual with a disability will be considered disabled under the law, regardless of whether they are eligible to receive benefits under workers’ compensation or other disability laws. An employee also must continue to be qualified to be protected by the ADA.

Is Depression A Disability In Canada

Yes. All disability benefits providers in Canada recognize depression as a disability. Its a condition that can qualify for benefits.

However, a diagnosis on its own wont qualify you.

Providers pay benefits to people who can prove their conditions keep them from working. When reviewing claims for depression, providers focus on the seriousness of your symptoms. They will consider the medical treatment youve had and future treatment plans. They look at how your symptoms affect your work and how hard you tried to keep working.

A. Injured workers who return to the job as soon as medically possible have the best outcomes. They recover from their injuries faster and suffer less wage loss. Your decision about returning to work will be influenced by your doctor, your employer and the claims administrator. Communicate honestly and frequently with them for the best results.

If your doctor decides you cannot return to work while recovering from your injuries you cannot be required to go back to your job.

Your Rights Under The Ada

Many people with bipolar disorder are able to maintain a job. Bipolar disorder is one of the many conditions covered by the Americans with Disabilities Act . This law is designed to protect people with disabilities from discrimination in hiring, job assignments, promotions, pay, firing, benefits, layoffs, and all other employment-related activities.

The ADA only applies to businesses with 15 or more employees.

People with bipolar disorder may want to consider that when looking for employment or considering changing jobs.

Your spouse is also protected by the ADA. The Equal Employment Opportunity Commission states that “The Act also makes it unlawful to discriminate against an applicant or employee, whether disabled or not, because of the individual’s family, business, social or other relationship or association with an individual with a disability.” For example, if your husband has bipolar disorder, you are protected if he requires emergency hospitalization and you must be away from work without warning because of this. The ADA is administered by the EEOC.

Other employees may not understand the rights a person with bipolar disorder has under the ADA. Often people think of disability only as physical impairment. Everyone should learn how the law applies so they know why accommodations may be required.

You Can Apply For Both Ssdi And Unemployment But Be Careful

As the jobs picture in many parts of Louisiana continues to be depressed due to COVID-19 closures and stay-at-home orders, many of my clients are filing for disability but have also applied for unemployment benefits.

In many of my hearings, my SSDI clients are being asked by judges if they have filed for unemployment benefits.

The issue for your disability case is this: when you file for state unemployment, you are asserting that you are ready, willing and able to work, but when you apply for disability you are stating that your medical condition prevents you from being able to work.

What If I Work Many Hours For Someone Else

Generally, your monthly income matters most for your eligibility. However, working too many hours could affect your case.

For example, maybe youre working close full-time hours even though you dont earn over $1,260 per month. The SSA might consider you able to work a full-time job and deny you for benefits. It will be harder to convince Social Security that youre disabled if you can work many hours.

To Work Or Not To Work

If youre going to a job a few days a week, the SSA might have a hard time believing your disability is severe enough to award benefits to you. Working while you wait for your benefits to begin is not forbidden. However, its a good idea to consider the type of work you do and where you do it while the Social Security Administration decides your condition and benefits.

The SSA is on the lookout for SGA . While they dont want you to have a disability that keeps you from working, if youre applying for benefits, you need to have a disability that keeps you from maintaining SGA.

If your part-time job looks like its providing you with too much income, you wont qualify for disability benefits. To avoid breaching the substantial gainful activity threshold:

• Non-blind individuals can earn no more than $1,260 per month
• Blind individuals can earn no more than $2,110 per month

The SSA monitors your earnings to make sure you arent exceeding the maximum each month. In some cases, when you earn too much money in a month, you could receive a lower benefit payment that month.

Disability Tax Credit For Depression

The disability tax credit is a type of benefit that lowers your taxable income. To qualify, you must have a severe and prolonged impairment as defined by the program. But, this program has a higher standard than others.

Qualifying for this credit can get some of your previous taxes refunded. It depends on the timeline of your condition. You apply by filling out a T2201 form and sending it to Revenue Canada.

You cant receive EI sickness benefits and short-term disability at the same time. In fact, if you do receive both, you will need to pay some back.

For example, imagine you got EI sickness payments for 2 weeks. Then, you get approved for short-term disability, and they will pay you for those same 2 weeks. This creates an overlap. If theres an overlap, then youll need to pay back the EI program.

After youre approved for short-term disability, youll receive a back payment. Then, you can refund EI using that money.
