Va Permanent And Total Disability Letter Part #: Explain Why And How Your Disability Conditions Should Be Considered Static Permanent And Total

In Part #2, youll want to explain WHY and HOW your disability conditions meet the definition of Static, Permanent, and Total.

Its helpful to include the exact definitions and legal authority when writing your VA permanent disability letter.

  • A static disability is a disability that is considered to be permanent by its nature, history, and severity. A static disability exists when there has not been material improvement for 5 years or more .
  • A permanent disability exists when it is reasonably certain, based upon medical evidence, that the level of impairment will continue for the rest of the veterans life .
  • Total disability exists when there is present any impairment of mind or body which is sufficient to render it impossible for the average person to follow a substantially gainful occupation .
  • Permanent total disability exists when such impairment is reasonably certain to continue throughout the life of the disabled person . Reasonably Certain generally means greater than 50 percent likelihood or the more likely than not standard of proof.

How Is The Rating Decision Structured

As mentioned above, a Rating Decision is typically included with the VA award letter. The Rating Decision will usually, but not always, be structured as follows:

  • IntroductionThe first section will generally provide information regarding the veterans service, such as branch of service and dates of service. It can also include information about the veterans claim, such as the process leading up to the decision.
  • Then comes the decision section, which lists exactly what conditions the veteran is service connected for, what ratings have been assigned, and what the effective dates are.
  • EvidenceThe evidence section generally contains all the prior evidence that has been submitted to the record. This section can be lengthy, depending on how much evidence has been submitted to support the claim.
  • Reasons for DecisionIn the Reasons for Decision section, there will be bolded sentences explaining what decisions were made and then under the bolded sentence will be the reasoning that decision was made.
  • For example, if a veteran receives a rating for PTSD, the bolded sentence may read Evaluation of posttraumatic stress disorder currently evaluated as 70 percent disabling. Then, under that sentence, it may explain that the veterans Compensation and Pension exam, and other submitted evidence, reveals that their symptoms qualify them for the 70 percent rating. It may list out symptoms such as distressed mood, sleep impairment, and anxiety.
  • If You Disagree With Your Va Decision Letter

Service Disabled Veteran Owned Small Business

If you disagree with the decision that the VA assigned your claim but you dont have additional evidence to submit, you can choose to seek a higher-level review or HLR.

In a HLR, you are not allowed to submit any new information to support your claim, you are simply requesting that the decision be reviewed by a higher level official within the VA.

If you initiate a HLR, you can also request a 5-min informal phone call with the DRO, Decision Rating Officer, to explain why you disagree with the decision before they make a new rating decision on your claim. The DRO is a more senior rater who may see things the original rater overlooked.

The bottom line is, if you disagree with the decision in your VA disability rating decision letter, there are options for you to exercise and ways to receive a different decision if your condition and the evidence supports it.
