Can I Receive Disability Benefits In Maryland

How to Apply for a Disabled Placard in Maryland

If you or a loved one are unable to work because of a medical condition, our workers’ comp attorneys can help you apply for various disability programs that provide monthly financial support.

The application and approval process can be quite complex and legal in nature. Small mistakes in any of the documents can be used against you, ultimately leading to reduced or denied benefits.

With an experienced disability benefits attorney at your side, these concerns are mitigated, allowing your case to have an unobstructed chance at earning you the compensation you deserve. This is especially important in Maryland, given that the rate of initial application approvals is lower than the national average.

Your Disability Is Based On Drug Addiction Or Alcoholism

The SSA will deny benefits to someone whose drug addiction or alcoholism is a contributing factor to his or her disability. The key factor a DDS medical consultant must consider when making a DAA determination is whether or not the SSA would still find you disabled if you stopped using drugs or alcohol.

For more information, see Nolo’s article on when drugs or alcohol will prevent you from getting disability.

File A Disability Claim

A member filing for ordinary or accidental/special disability benefits must properly complete and submit to the Maryland State Retirement Agency the forms and materials listed here.

  • leave/attendance records for the last two years and
  • performance evaluations for the last two years.
  • If, during the application process, your employer places you on a medical unpaid leave of absence, you also should file a Application to be Placed on a Qualifying Approved Leave of Absence. This form preserves your death benefit while on medical unpaid leave.

Do I Qualify For Social Security Disability Benefits

To be considered disabled by the Social Security Administration, you must have a disease or condition which has lasted, or is expected to last, at least 12 months, or result in death. This disease or condition must make you unable to do any of your past work.

Additionally, this disease or condition must make you unable to do ANY job.

Medicine is not an exact science. Many people have medical problems. Some of these people go to a medical provider. A medical provider may not have a definitive diagnosis or label for the problem you present. It may take your medical provider time to make a definite diagnosis.

While waiting for time to pass or test results your medical provider may mention you could have one or more possible conditions. There are many people who hear they may have such and such condition and then feel even sicker than they felt before they heard the label or name of the possible condition. In fact, many people on hearing the name of a possible condition will carry that name with them and without confirmation of the diagnosis adopt it as their disease. Subsequently, they may tell other physicians they have in fact been diagnosed with a disease for which they have never received confirmation or a definite diagnosis. At that point, the disease may even appear in the medical record, for example, as part of the past medical history.

Your Disability Won’t Last Long Enough Or Isn’t Severe Enough

Applying for SSDI Benefits in Maryland – Updated for 2021 | Citizens Disability

To qualify for SSDI or SSI benefits, the Social Security Administration must believe that your impairment is severe enough to last at least 12 months or result in your death. The only exception to this duration requirement is for blind SSI applicants.

Many claimslike those based on bone fractures resulting from acute trauma, such as automobile or motorcycle accidentsare denied because they are not likely to cause disability for 12 months. Almost all bone fractures heal in less than a year. However, if you have severe bone fractures that aren’t healed after six months, the SSA is then likely to think your impairment will last a year. Each case is evaluated on an individual basis.

In addition, your medical condition must cause you severe limitations to qualify for SSDI or SSI. Most claims are denied simply because the applicant’s impairment was not severe enough .

    How Do I Apply

You can do it through the local Social Security Administration office or state agencies .

You can apply in person, over the phone, by mail, or online. DDS will get information from your doctors to decide if your diabetes qualifies as a disability.

If you donât qualify, your case is kept on file in case you decide to appeal.

The process isnât quick. It can take 3 to 5 months to get a decision, depending on how long it takes for DDS to get your medical records and other information they need.

Itâs not unusual to be turned down the first time you apply. Up to 80% of first-time applications are rejected. If you appeal, it can take another 3 to 5 months to get a decision. If that appeal gets denied, you can appeal once more before an administrative law judge. That process can take as long as 2 years.
