9 Red Flags When Choosing a VA Disability Lawyer or Representative

It is important to know that your long-term disability insurance policy can contain limitations you may not be aware of until you have already been injured. Under certain circumstances, your claim may be denied for not being fully compliant with the terms of your policy, or the type of injury you suffer may not be covered in your policy. When accident victims have questions about getting insurance benefit compensation for their claims, especially about whats fair and reasonable under the circumstances, a personal injury lawyer can help to clarify the terms of your policy. In some cases, you may require some assistance in recovering the maximum benefits under your policy.

If you carry long-term disability coverage and have questions about recovering benefits, or the limitations or exclusions in your policy, choosing an experienced personal injury lawyer is a vital first step to protect your rights. A lawyer who specializes in long-term disability claims can tell you how long you have to file a claim, walk you through the process, and make sure you receive the financial support you need to continue living a healthy, productive life.

This can be especially true if a claimant suffers from mental illness along with drugs or alcohol abuse. If this is your situation, ask the attorney about his or her approach to these types of cases and the success rate for winning them.

    High Volume Or High Quality

Advertising on TV and radio generates a lot of clients. Some firms have multi-million dollar annual ad budgets! Of course these firms can be both good lawyers and good marketers, but keep in mind a high volume firm may not be able to devote as much time and attention to your file, especially if their objective is to bring in as many cases as possible. Some of these firms rely heavily on law clerks, junior lawyers, and students to keep up with the high volume.

Every attorney, not just disability attorneys, should have a client communication policy, and be able to express that to you, the client.

With SSDI or SSI disability claims, the communication seems to be heavy at the beginning of the relationship and then heavy again right before the hearing. That does not mean a law firm should go silent in between.

You should probably be in contact with your law firm or representative about every other month. Why? Your representative will need updates on recent medical treatment, new doctors or medications, or changes in your diagnoses. Many firms wait until its time to prepare for the hearing before requesting this information. When this happens, it is too easy to forget potentially important details such as occasional urgent care visits, referrals, and medication changes.

For cases at the Appeals Council and Federal Court levels, frequent communication is not as vital because you are usually not providing any NEW medical evidence.

Answer from us: You will hear from someone on our team about once a month to once every other month. If you dont like to talk on the phone , we can contact you via text, email, or by letter. As noted above, communication is much less frequent with Appeals Council cases.

    Confirm Your Attorney’s Experience

If you need to appeal a denial, an attorney who handles federal disability retirement claims before OPM, but who has never represented employees before the MSPB, is like a car without wheels. Given the fact that, as a practical matter, the MSPB is the last chance you have to get your disability retirement granted, you want to make sure that your attorney knows MSPB procedures and how a disability retirement appeal differs from other types of appeals to the MSPB. How do you find out if the attorney has handled disability retirement appeals before the MSPB? Ask him or her. Don’t be impressed by the big fancy law firms — they aren’t always the best. I took a case a few years back in which a high-profile attorney was originally my client’s representative before OPM. The client paid a lot of money and came very close to losing her case because the attorney didn’t get to know the rules of the MSPB forum. Also, don’t be afraid of small firms and sole practitioners. One of the best attorneys I know continues to work out of his house.

How Is A Social Security Disability Attorney Paid

When you retain a disability lawyer for your Social Security Disability claim, you will not need to pay anything out of pocket or upfront. Instead, the Social Security Administration has regulations that establish how a disability lawyer is paid. Disability lawyers take claims on a contingency basis, which means that your lawyer doesn’t require a payment for his or her services until you are awarded disability benefits.

When you are awarded benefits, the SSA has laws that indicate how much the lawyer can charge. However, these specifics should be indicated in your agreement with the attorney when you retain his or her services.

The SSA indicates that the lawyer cannot charge more than 25 percent of your back pay, but that figure is capped at $6,000. So, if you were awarded $38,000 in backpay, your attorney will not be paid more than $6,000 per SSA guidelines.

Most attorneys will pay for the costs associated with obtaining the evidence and documentation that you need to get your claim on track. Medical providers will charge for copies of medical records, and this can add up to several hundred dollars depending on the extent of your medical history and the care that you received.

When you have a lawyer working with you from early on, you may be able to garner an approval earlier and get awarded the benefits that you need. Complete the Free Case Evaluation on this page to have your claim reviewed by an attorney or advocate that takes cases in your area!

Be Candid And Open About Attorneys Fees

There are many good attorneys who handle federal disability retirement applications and applications. Unlike attorneys who help with Social Security disability claims, all of us charge different types of fees. Those fees can be fixed fees, hourly fees, monthly fees, and so on. Some attorneys charge low fixed fees for the application, but very high hourly rates for an MSPB appeal. Some attorneys charge only for the application, but do not represent before the MSPB. Others only represent applicants before the MSPB. Make sure you know what you are getting and that you are comfortable that the price you pay is a fair price you can live with, even if you lose. Be candid with the attorney you want to hire — if you cannot afford the fees, tell the attorney what you can afford and propose some different fee arrangements.

Most important, don’t make your decision on the spot. Sleep on it and make sure you are comfortable with your attorney’s experience, reputation, fees, and understanding of your case. That way, even if you lose your case, you will feel that you got your “day in court.”
