Va Disability Counts As Income For Child Support & Alimony

VA disability payments count as income for purposes of calculating child support and maintenance – the fact that they are tax-free payments means they are invisible to the IRS, but not invisible to other agencies or for other purposes.

In Rose v. Rose, 481 U.S. 619 , the U.S. Supreme Court found that VA disability payments were intended not just for the veteran, but as the law stated, to provide reasonable and adequate compensation for disabled veterans and their families.

From this, the Court concluded: “Congress clearly intended veterans’ disability benefits to be used, in part, for the support of veterans’ dependents. Although Rose concerned garnishment of VA disability payments, in that case the disability benefits comprised most of the obligor’s income considered by the state court. While the decision did not explicitly address the fact that the state court counted the disability as income, had the Court taken issue with counting it, the justices certainly had the opportunity to correct the state court.

In a 1991 decision, the Colorado Court of Appeals rejected a husbands argument that counting VA disability payments as income was effectively a backdoor, improper division of the disability payments themselves. In re: Marriage of Nevil, 809 P.2d 1122, 1123 . The Courts reasoning was:

Who Assigns Va Disability Ratings

Typically, VA disability ratings are assigned by Rating Officers, such as Decision Review or Higher-Level Review Officers, at the Regional Office level, or by Board Members at the Board of Veterans Appeals. The type of rating official issuing a disability evaluation depends on the level at which your case resides . To rate each service-connected condition, adjudicators use the VA Schedule for Rating Disabilities . Under that schedule, each disability is assigned to a specific diagnostic code and rated in increments of 10 percent.

How Do I Calculate My Combined Va Rating

If you have one disability, then the rating for that disability and the rating for your total disability will be one and the same.

However, most veterans have more than one service-connected disability.

So how does the VA determine your combined VA rating percentage?

If you receive several ratings for corresponding disabilities, they will not just be added together in a cumulative nature.

If you are rated at 70% for PTSD and 50% for Headaches, you wont be 70% + 50% = 120% disabled.

Why?

Well, because its physically impossible to be more than 100% disabled.

Instead, the VA starts with your highest overall rating, multiplies the next highest rating into the previous one, adds it on, and so on.

In the example I just gave, the VA would take the highest rating first, the 70% for PTSD.

According to that number, the VA assumes that 100% 70% = 30% of you is still healthy.

Then they multiply that remaining 30% by the rating for your Headaches, which is 50%.

Take 50% of 30% and you wind up with 15%.

Add that 15% onto the original 70%, and you wind up with an 85% total disability rating, which would be rounded up to a 90% combined VA disability rating.

The process continues for each disability remaining from highest to lowest.

Lower/less Severe Va Ratings

0% Rating

The VA rates sleep apnea at a 0% rating if your condition is asymptomatic, but you have a documented history of sleep disorder breathing.

Under this rating, its nearly impossible to gain any benefits from the VA as a disability.

30% Rating

It is best to apply for VA compensation before your final out-processing appointment, but this is not always possible.

In any case, service members will need to supply copies of discharge paperwork such as the DD Form 214 for active-duty military members, medical records, supporting documentation for the medical claim, and a completed VA Form 21-526.

Depending on the type of claim you are making, you may need supporting evidence that shows how your condition affects your ability to work, socialize or pursue hobbies.

You may need to gather medical records and personal statements from yourself, family and co-workers. You might also need to show how your condition has worsened over time. Submit all medical records pertinent to your condition as evidence.
