Even if you’re receiving regular treatment from a psychologist or psychiatrist who supports your disability claim, your LTD carrier is likely to deny your initial application and force you to plead your case on appeal. In these difficult cases, it is critical to hire an experienced disability attorney who can guide you through the appeals process and, if necessary, file a lawsuit against your insurer.

How Can I Get Disability For Depression
To get disability for depression, your condition must be severely debilitating and must qualify for the Social Security Administrations criteria. You need to make sure your condition is well documented and your medical records support your case.;
The SSA relies mostly on medical and clinical records to determine if you qualify for the disability plan or not.;
You must be diagnosed with persistent clinical depression that has lasted at least one year or almost one year. Your depression can also be intermittent but severe.;
The SSAs criteria include an impairment listing on depressive disorders set by them. Listing 12.04 is used to determine the severity of your depression. If your depression is severe enough to interfere with your functioning and prevents you from doing your daily activities, you can apply for disability benefits.;;
You can apply online at ssa.gov or call at 1-800-772-1213 to start the disability application process. It usually takes between 3-5 months to get an initial decision regarding your claim from the SSA.
Residual Functional Capacity For Depression
If you cannot show that you meet the listing for depression, you may still qualify for benefits if the Administrative Judge finds that your residual functional capacity prevents you from working. To determine your residual functional capacity, the Administrative Law Judge will look at all of your impairmentsmental and physicaland determine what sort of work you may be able to do.

With depression, a persons ability to concentrate and stay on task during the workday is often affected. If the Administrative Law Judge finds that youre going to be having unexcused absences or be off task while at work due to mental illness, they may find you disabled for these reasons as well.

Having a supportive treating family physician, psychiatrist, or psychologist is very important for these types of claims.

In general, your chances of receiving LTD or SSDI based solely on a mental illness are roughly similar, but your LTD insurer is much more likely to terminate your disability benefits after you’ve been approved. Length And Levels Of Depression
Your depression or bipolar disorder must have lasted or be expected to last for at least a year, and must be at a level at which you would be unable to perform a job on a consistent and regular basis. The SSA does not require that you be depressed every day of the month, but you must show your depressive symptoms occur frequently enough to prevent you from working.
Quite often, your medical treatment records for a particular visit will say that you are “feeling better” or that your depression has “improved.” The SSA might use these records as a reason to deny you disability benefits. If your medical records include such notes, you can explain at a hearing before an administrative law judge whether you have good days and bad days with your disorder, and how often each occurs.

If you request a hearing before an administrative law judge , the likelihood of receiving benefits goes up dramatically. Government statistics from 2007-2015 show that nearly six in ten applicants who listed mood or anxiety disorders as their primary impairment were approved after a hearing.
Several factors contribute to the better outlook at hearings. For one thing, it takes a long time to get to a hearing. While the wait can be frustrating, it can help you build stronger evidence. This is particularly critical with mood and anxiety disorders. If you can show that your mental condition has continued to be severe and to keep you from working, a judge is more likely to be convinced that you’re eligible for disability benefits, and that your condition isn’t short-term.
Our survey points to another important reason for the higher approval rate at hearings: More applicants enlist the help of a lawyer at this stage in the process. Nearly three-quarters of all readers who went to a hearing were represented by an attorney, compared to 30% at the initial application stage. And applicants with lawyers had a much greater chance of winning disability benefits .
Identifying Individuals At High Risk For Permanent Disability From Depression And Anxiety

Mental illnesses, among which depression and anxiety are most common, are the leading cause for permanent disability. It is of interest to know what case characteristics determine if a person returns to the work force in spite of mental illness to tailor specific interventions. So far, there has been little research into this field. In the present study a sample of 202 workers who had permanent disability due to depression/anxiety were followed-up on. 22% started some kind of work during follow-up in a period of 30 to 75 months. Logistic regression analyses showed that quick progression into disability, short period of disability, younger age, adequacy of income replacement through insurance benefits and no previous disability predicted return to work. These findings also allow to identify individuals at high risk for progression into permanent disability that can benefit from supporting interventions.
