Benefits Of Working With A Disability Lawyer

Many people think that if they have a good case for eligibility for disability benefits asking an attorney to help you thorough the process is not necessarily required. However, taking into consideration that 60% of claims are denied it is worth hiring a lawyer who will increase your chance of approval. This is because the attorney knows how the SSA deals with applicants due to having dealt with many cases before.

The right documentation is the key to a successful disability benefits claim so a disability attorney will be able to sieve through your documents to check to make sure they are acceptable. If any amendments are required or if any documents are missing your attorney will ensure all your documentation is in order before your initial claim for disability benefits is submitted to the SSA.

If you applied without a lawyer and have been denied it is not too late, contact a lawyer to aid you in the appeal process. There is always a chance of winning disability payments at this reconsideration stage if a lawyer helps you through the process.

Your manager will review your situation to determine if your needs can be accommodated in his/her organization. They will consult with departmental human resources who will coordinate your return to work with your manager and caseworker, if you are receiving benefits through disability or long term disability.

Your manager will inform the Pay Centre of your return to work or rehabilitation schedule, once it has been approved by the employee, manager and human resources, if it differs from your pre-illness schedule. Your manager will also inform your departmental human resources, who in turn will advise the Pay Centre when you are no longer on a rehabilitation schedule. You will be required to provide the Pay Centre with a copy of the approved rehabilitation schedule from your insurer.

How Do You Get Disability For Listed Medical Conditions

If your disability is listed in Social Security’s Listing of Impairments, the first step is to get a diagnosis of the condition from your doctor. A mere diagnosis will get you an automatic disability approval for only a few conditions, however, like ALS, an organ transplant, or certain serious cancers, such as esophageal cancer, mucosal melanoma, anaplastic carcinoma of the thyroid gland, or small-cell carcinoma . For all other conditions, the next step is to determine if your medical condition meets the specific criteria for that condition. The listing requirements are often quite complex our illness-specific articles simplify the medical criteria in the listings so that you can understand whether your condition will qualify for disability.

If you haven’t had the clinical or laboratory tests required in the listing, you can ask your doctor to perform them. Or you can wait for the SSA to pay for a consultative exam, but this makes your claim take longer. It’s generally better if the test results are already in your medical record before you apply. Then you can check to see if your test results meet the requirements of the listing, and if they match the criteria or are close, you can apply for disability.

Make A Plan For Transitioning From Employment To Sick Leave

Once you have your doctors support, you can start the transition from employment to being on sick leave. It is important that you carefully manage this transition to protect your employment, your workplace pension, and your group medical plan.It is common for there to be tension between you and your employer in the months leading up to you going on a sick leave. Some employers are not friendly or understanding to employees who are ill and disabled. For this reason, its important to get your doctor to write a note for your employer to confirm that your illness and disability are the reasons for your poor work performance and/or your need to take a sick leave from work. Some employers will pressure you into resigning or to accept a severance package. This may seem like a good idea, but if you sign off on that deal theres a good chance youre also signing off on your right to make a claim for long-term disability benefits! This is almost always in the fine print, and the money you get from the severance will pale in comparison to what you would receive from disability benefits. Dont retire from employment. You may be eligible for early retirement, but most disability insurance plans have a clause that says they dont have to pay you if you retire. This is mistake you absolutely must avoid.

    How Long Will It Take

The SSA can take three to six months to determine if you meet their disability qualifications. At that time, they will notify you on whether youve been approved or if your application has been rejected.

If your application is rejected, dont lose hope. Many, if not most, disability applications are denied the first time. However, once an application is denied, you have a short window of time to file an appeal. You should consider hiring a lawyer who is experienced with disability claims.

In fact, you may want to contact one early in the process to help improve your odds of a quick approval. A lawyer is well versed with some of the most common causes of initial rejections and can help you take a proactive approach to filing for disability.

Special Rules For People Who Are Blind Or Have Low Vision

We consider you to be legally blind under Social Security rules if your vision cannot be corrected to better than 20/200 in your better eye or if your visual field is 20 degrees or less, even with a corrective lens. Many people who meet the legal definition of blindness still have some sight and may be able to read large print and get around without a cane or a guide dog.

If you do not meet the legal definition of blindness, you may still qualify for disability benefits if your vision problems alone or combined with other health problems prevent you from working.

There are a number of special rules for people who are blind that recognize the severe impact of blindness on a person’s ability to work. For example, the monthly earnings limit for people who are blind is generally higher than the limit that applies to non-blind disabled workers.

In 2021, the monthly earnings limit is $2,190.

How Often Will You Receive Payments

This is another area that can vary. Fortunately, your payment questions should be answered clearly within your plan documents.

Be aware that if your employer works with an insurer to offer short-term disability benefits, then payments will usually be administered through the insurance company. That means they might arrive on a schedule different from the payroll timing youre used to .

Meaghan Tiernan, a senior copywriter for a marketing agency in San Francisco, used her short-term disability for maternity leave. She was given a debit card that her short-term disability payments were added to.

I think it was one lump sum every two weeks on an regular basis, she explains. They even include weekends, so it was typically every 14 days that I was paid. Then youd have to transfer the funds from that debit card to your bank account if that was your preference.
