Can you file for both unemployment and Social Security Disability Benefits?

This article discusses how work can affect a personâs eligibility for Title II disability benefits, commonly referred to as âSocial Security Disability.â The next Voice article will discuss preserving Medicare and Medicaid benefits when a Title II disability recipient begins to work.

Title II of the Social Security Act provides three types of insurance benefits for individuals with disabilities. Some people receive Title II disability benefits on their own work history . Others receive Title II disability insurance on the account of a deceased spouse or former spouse s Benefits or DWB). Some adult children receive Title II disability benefits on the account of a disabled, retired or deceased parent . Title II disability benefits are a type of insurance and are not affected by a personâs assets or unearned income.

Does Ssi Affect Unemployment Benefits

It is possible that applying for SSI can affect your unemployment claim. Because you are stating you are ready, willing, and able to work, applying for SSI may suggest the opposite. Your employer may use your disability application against you.

The bottom line here is that if you are applying for both types of benefits, you should really speak with an SSI lawyer before doing so. This will help you to avoid destroying both of your claims.

So What Happens If I Lose My Job While On Disability

Typically, long-term disability benefits can be paid through age 65 or 67. However, this does not mean that you will keep your employment throughout your disability. Indeed, we inform our clients receiving LTD benefits that their employment is likely to be terminated at some point.

It is natural to wonder if a termination of employment will affect their monthly disability payments. Namely, we are regularly asked whether benefits will stop if employment is terminated. The answer to this question is as follows:

  • If disability benefit payments are made by an insurance company, the simple answer is no, benefits will not cease.
  • If disability payments are made by an employer, benefit payments may cease upon the loss of employment in rare situations. A review of the disability insurance policy is required to determine whether your benefits are at risk.

If you have any concerns regarding the effects of a termination of benefits, please give our experienced disability insurance lawyers a call. Consultations are free.

Your Duty to Continue Medical Treatment

If your employment is terminated you may also lose your health insurance coverage. This may make it difficult for you to continue to see your doctors on a regular basis. However, it is imperative you continue to treat with your doctors. Indeed, disability insurance policies generally require you maintain regular treatment with a physician. If you do not, your disability benefits may be terminated.

If you are able to find another job and start working again after filing early for Social Security benefits, your earnings have the potential to reduce your Social Security retirement benefits until you reach full retirement age. If you earn over a certain amount each year, your retirement benefits will be reduced according to a formula found on the Social Security website. Check the website to find out exactly how much you can earn without this happening and how much your benefits will be reduced if you earn more than this amount each year. Answering Your Questions About Social Security Disability and COVID19 Unemployment Benefits

Vieillet says the intricacies of each program are confusing, even to the experts. For the average person, it can be downright overwhelming.

When letters from Social Security start coming in the mail, they scare the bejesus out of people, says Teresa Nier, benefits and employment manager with My Employment Options.

For disabled workers, joining a free work-incentive program and employment network can help. Ticket to Work offers benefits protection for recipients who want to test the employment waters. And organizations like My Employment Options have certified benefits counselors on staff to help applicants trudge through the paperwork and fine print all while finding a job that fits their unique needs.

To avoid unexpected benefits cuts or having to return overpayments to the agency, people need to keep Social Security updated with phone numbers and addresses, Nier says. Open those letters. Ask questions.

For James, the idea of not working is unsettling. He doesnt want to be a burden.

Im more of an entrepreneur, he says. Im a very social person. Im very outgoing.

I want to try to make this work. Somehow.

Social Security Disability Attorneys Break Down Ssdi Background And Its Relationship With Unemployment

As a bit of context, the Social Security Disability claims process is a long and winding road. With few exceptions, most Claimants do not get favorable decisions without waiting approximately two years for a hearing date before a U.S. Administrative Law Judge . Even then, according to Social Securitys own statistics, only about 45% of Claimants actually succeed. That number is far greater, by the way, with highly skilled social security disability attorneys by ones side.

At hearing, the experienced social security disability attorneys will know how to shape the presentation of hundreds, if not thousands, of pages of relevant medical evidence alongside sworn testimony of how the Claimants medical conditions interfere with daily life and prevent the performance of substantial gainful activity, a legal term of art under the Social Security Act that could itself be the subject of lengthy discussion.

At bottom, substantial gainful activity translates to work, and a judge will generally want to account for all medical evidence and testimony before determining whether a particular claimant can or cannot sustain an 8-hour workday, five days a week in a competitive work environment.

Can I Apply For Both Unemployment & Long

Yes, you can apply for unemployment benefits and long-term benefits at the same time, but it is typically not a good idea. When you file your applications for benefits, you are contradicting yourself. On the unemployment application, you state you can work. On the disability application, you state you cannot work.

The state unemployment office may deny your application based on your assertion that you cannot work. Likewise, the Social Security Administration or the private disability insurance carrier may point to your unemployment application or benefits as proof that you can work.

Because SSI is a means tested program, it would be unusual that you would be able to collect both SSI and unemployment compensation. In most cases, if you receive unemployment benefits you will not qualify for SSI during that time period. However, if your unemployment compensation runs out, you may qualify for SSI at a later date.

Keep in mind that because SSI uses the same definition of disability as SSDI, you may have the same problems we discussed above. There may be a conflict in saying you are able to work for unemployment while claiming you are unable to work for disability.

How Much Does Disability Pay Each Month

The payment disability claimants receive depends on which Social Security program they qualify for. The Federal Social Security Disability Insurance Program pays benefits based on your average lifetime earnings. The Federal Supplemental Security Income program pays benefits based on the SSI Federal benefit rate less any countable income you may have.

The AIME determines your monthly benefit amount. Generally speaking, the more you have in qualified earnings, the more your benefit will be. The max monthly payment for SSDI in 2021 is $3,148.

Maximum Federal Supplemental Security Income payment amounts increase with the cost-of-living increases that apply to Social Security benefits. The latest such increase, 1.3 percent, became effective January 2021. For 2021, the maximum benefit is $794 monthly for individuals, and $1,191 for eligible couples.

How To Qualify For Ssi Benefits

17 Best images about Social Security Disability on ...

You can get Social Security disability benefits even if you do not have enough work credits to qualify for SSDI. The SSA offers the SSI program to disabled adults and children who have limited financial resources. As we mentioned before, if you do not have enough work credits to qualify for SSDI, you could qualify for SSI.

You have to meet the same medical disability standards as a person does for SSDI. Your income must be low, and your countable assets cannot exceed the limit for SSI. SSI is a safety net so that people who cannot work for a living but cannot collect SSDI can pay for essential items, like food, clothing, and shelter.

    SSI has these requirements:

    • You have a severe illness or injury that meets the benchmarks of the SSAs Listing of Impairments, also called the Blue Book.
    • Your disability prevents you from supporting yourself through gainful employment.
    • You must have very little income. This number can change every year. Because SSI is a joint program of the federal and state government, the income limit varies by location.
    • Your countable assets must not exceed the SSI limit. This number can also change every year. Your home and the land it is on do not count as assets. Most cars do not count toward your resources. The asset limit is $2,000 for an individual and $3,000 for a couple.

You must satisfy all of these elements to be eligible for SSI benefits.
