If you are terminated while on disability, you may be able to collect unemployment. However, as long as you are unable to perform your job duties, you will be unable to collect unemployment benefits. All 50 states have the same requirements for a person to be eligible for unemployment compensation. First, the individual must be physically able to work. Second, the person must available for duty. Third, the person must be actively interviewing for jobs.
In most cases, those who are terminated from employment while out on short term disability will be able to go on and receive unemployment benefits. This is because they are likely to recover from their disabling condition sooner rather than later and, therefore, be able to perform their job duties. Those who are terminated while on long term disability, however, may remain unable to work. Because of this inability to retain substantially gainful employment due to disability, a person would be unable to collect unemployment.
Should you be terminated while on disability and be eligible for unemployment benefits, you should file for these benefits as soon as you recover. Because the amount of wages you earned in the year you seek to collect benefits may be affected by your disability leave, you may be able to use an alternate base year. The alternate base year set by your date of disability will allow you to qualify for unemployment benefits based on what you made in a normal year that was not affected by your disability.

What If I Attempt To Return To Work But I End Up Needing To Go Out On Disability Again
If you return to work and are able to perform your regular or customary job for more than 60 days, then your disability benefit period is considered ended.; If you stop working again due to disability, you must file a new claim for SDI, and re-establish your eligibility for benefits as of the date of the new claim. If you are eligible for SDI as of the date of your new claim, you are entitled to a new benefit period of up to 52 weeks.
If you return to work for more than 60 days, but do not perform your regular or customary work due to your disability for example, you work only light duty or only part-time you may be able to continue your prior disability claim. You will need to show EDD that you did not perform your regular or customary work when you attempted to return to work.
If you return to work for fewer than 60 days, and stop working due to the same disability, you are considered to be within the same disability benefits period. You may continue receiving benefits under your original claim and the 7-day waiting period required by these claims will be waived.

Can I Collect Disability Insurance Benefits If I Am Collecting Unemployment Benefits
It is challenging for a disabled claimant to obtain either short or long term disability benefits when they are receiving or have received unemployment benefits. It is not impossible to get STD or LTD benefits, but a claimant would be much better off not seeking unemployment. One of the criteria to be eligible for unemployment benefits is that the employee must be able to work, available to work and actively seeking work. In a situation where a person has an own occupation policy, then it could be possible to receive unemployment and disability benefits. Vacation pay does not impact an employees eligibility for SDI benefits. With this process, an employee could receive up to 100 percent of his or her normal gross weekly wages for the benefit period. Employers must notify the EDD by telephone or mail if they choose to offer this option to employees.

The State of California requires all employees to pay into its short-term disability insurance program through payroll deductions. When employees become unable to work due to disability, they can collect weekly benefits from the program until they are either ready to go back to work or the benefits expire. The program is administered by California’s Employment Development Department .
What Are Employment Insurance Sickness Benefits
The Employment Insurance program offers temporary financial assistance to unemployed workers. This assistance includes providing sickness benefits to people unable to work because of sickness, injury, or quarantine.
If you cannot work because of sickness, injury or quarantine, but you would otherwise be available to work, you could be eligible to receive up to a maximum of 15 weeks of EI sickness benefits.

Yes, you can apply for unemployment benefits and long-term benefits at the same time, but it is typically not a good idea. When you file your applications for benefits, you are contradicting yourself. On the unemployment application, you state you can work. On the disability application, you state you cannot work.
The state unemployment office may deny your application based on your assertion that you cannot work. Likewise, the Social Security Administration or the private disability insurance carrier may point to your unemployment application or benefits as proof that you can work.;
Who Is Eligible For New York Short
In order to be eligible for short-term disability benefits, you must have become injured or ill while not at work but must be employed, or recently employed, at the time of illness or injury. Additionally, pregnancy is covered under short-term disability.
The employees who are covered by disability include:
- An individual who is working or has recently worked at least four consecutive weeks at a job that is considered to be owned by a “covered employer.”
- Individuals who change from one covered employer to another covered employer. As long as your employment was continuous, coverage for short-term disability starts on your first day of work.
- Domestic workers who work 40 hours or more for one employer. An example of this would be a nanny or personal assistant.
- Individuals who are not employed by a covered employer but elect for voluntary coverage.

Eligibility For Disability Insurance
Disability insurance benefits can be paid only after you meet all of the following requirements:
- You should be incapable to do your regular work for at least eight consecutive days.
- You must be employed or keenly looking for work at the time you become disabled.
- You must have lost wages because of your disability or, if jobless, have been enthusiastically looking for work.
- You must have earned at least $300 from which SDI deductions were withheld during a previous period.
- You must be under the treatment and care of a licensed doctor or recognized religious practitioner during the first eight days of your disability. You must remain under care and treatment to carry on receiving benefits.
- You must complete and mail a claim form within 49 days of the date you became disabled or you may lose benefits.

Interaction With Ei Sickness Benefits
You cant receive EI sickness benefits and short-term disability at the same time. In fact, if you do receive both, you will need to pay some back.
For example, imagine you got EI sickness payments for 2 weeks. Then, you get approved for short-term disability, and they will pay you for those same 2 weeks. This creates an overlap. If theres an overlap, then youll need to pay back the EI program.
After youre approved for short-term disability, youll receive a back payment. Then, you can refund EI using that money.
What If I Stop Working In The Middle Of The Year
Theres a special rule for when you work part of the year but then retire. Regardless of your total earnings, youre still entitled to get Social Security checks for any month in which youve officially retired.
As an example, say you retire early at 63 and decide that youre going to quit your $200,000-per-year job at the end of June. Youd forfeit all of your benefits for the first six months of the year because of your high earnings, but, starting in July, you could still get checks for the remaining six months even though your total annual earnings were well above the annual limit.
