How Do I Determine My Va Disability Compensation
To determine your disability compensation, you need to file a claim with VA. The VA rates your disability by severity after reviewing every piece of evidence in your claim.
You may only receive compensation for a single diagnostic code per condition, even if that condition satisfies more than one diagnostic code. However, those with more than one condition may receive additional compensation based on the combined rating system.
You may receive additional compensation if:
- You have very severe disabilities or loss of limb
- you have a spouse, children, or dependent parents
- you have a seriously disabled spouse

What Is A Va Permanent Rating

Because the condition wont change, the rating and payment also remain the same for the veterans life.

They can receive guidance counseling, tutors, etc. If achild has been in school and then the veteran receives a retroactive benefitthat includes the school dates, then the student can file for reimbursement forthe months that he/she qualified on the retroactive date.

Additional Va Ratings Above 100 Percent
Under the traditional rating scale for compensation, 100 percent is the highest rating you will receive for either an individual service-connected condition or combined service-connected conditions. However, there are certain circumstances in which veterans can receive additional forms of compensation due to particularly severe conditions. For example, special monthly compensation is awarded to veterans who have severe disabilities that bring them above and beyond the schedular rating criteria.
Va Ratings For Cancer: Temporary Total
If you are service-connected for an active cancer, VA should automatically assign a 100 percent disability rating. This rating continues for as long as your cancer is active, and then for another six months following the successful completion of a treatment program, such as chemotherapy, radiation, or surgery. Six months after your cancer treatment ends, VA will schedule you for a Compensation & Pension examination to evaluate the current status of your condition.
If the examination shows that your cancer is no longer active and is in remission, VA will evaluate the cancer based on its residuals. For example, erectile dysfunction and urinary incontinence are common residual symptoms of prostate cancer. If prostate cancer is no longer active, VA will likely reduce the disability rating for that condition and assign new ratings based on the severity of the veterans erectile dysfunction and urinary incontinence if present.

What Is 38 Cfr Permanent And Total Disability
According to 38 CFR § 3.340Total and Permanent Total Ratings Permanent and Total disability exists when:
- Such impairment is reasonably certain to continue throughout the life of the disabled person. This is the most common reason why the VA grants Permanent and Total disability status.
- The permanent loss or loss of use of both hands, or of both feet, or of one hand and one foot, or of the sight of both eyes, or becoming permanently helpless or bedridden constitutes permanent total disability.
- Diseases and injuries of long-standing which are totally incapacitating will be regarded as permanently and totally disabling when the probability of permanent improvement under treatment is remote.
- Permanent total disability ratings may not be granted because of any incapacity from acute infectious disease, accident, or injury, unless there is present one of the recognized combinations or permanent loss of use of extremities or sight, or the person is in the strict sense permanently helpless or bedridden, or when it is reasonably certain that a subsidence of the acute or temporary symptoms will be followed by irreducible totality of disability by way of residuals.
- The age of the disabled veteran may be considered in determining permanence.
Va Pension Total And Permanent
VA Pension is a needs-based program similar to Social Securitys Supplemental Security Income . Similarly to SSI, to be eligible for pension benefits, a veteran must have wartime service, low income, and a Permanent and Total disability. The Permanent and Total disability does not need to be connected to the period of military service. Disabled veterans aged 65 years or older can receive Permanent and Total disability for pension. Civilian Health And Medical Program Of The Department Of Veterans Affairs
CHAMPVA provides benefits for the children and spouses of veterans. A veterans children and spouse are eligible to receive healthcare under CHAMPVA if that veteran has a P& T rating. Healthcare benefits will also be provided to surviving children and spouses of P& T disabled veterans who died as a result of a service-connected disability.
What Is A Total Disability For Va Rating Purposes
A Total disability exists when there is any impairment of mind or body which is sufficient to render it impossible for the average person to follow a substantially gainful occupation.
Total disability may or may not be Permanent.
Total ratings will not be assigned, generally, for temporary exacerbations or acute infectious diseases except where specifically prescribed by the rating schedule.
Total ratings are authorized for any disability or combination of disabilities for which the Schedule for Rating Disabilities prescribes a 100% evaluation or, with less disability with the requirements of the rating schedule.

Can I Apply For 100 Percent P& t
While you dont really apply for P& T, there are some steps you can take to secure Permanent and Total Disability status. If you have a 100 percent VA disability rating and believe your level of impairment is reasonably certain to continue throughout your life, you can write a letter to your VA Regional Office requesting a permanent VA rating. With your letter, you should include medical evidence showing that your medical condition cannot be expected to improve in the future. You may be able to obtain a VA permanent disability letter from your doctor as well, which highlights in their medical opinion, whether your disabilities are likely to improve in the future. You can also open a new claim inside eBenefits or VA.gov and type the disability of Request for 100% Permanent and Total VA Disability and upload medical evidence, buddy letters, and a letter from a doctor.

First, lets break down each word in the phrase permanent and total. Permanent means that a veteran has a disability that has no chance, or close to no chance, of the disability improving.
The Department of Veterans Affairs considers a disability to be permanent when the medical evidence shows that it is reasonably certain the severity of the veterans condition will continue for the rest of the veterans life. In determining this, the VA is allowed to take into account the veterans age.
Ratings are assigned to disability based on the VAs rating schedule. A rating is meant to represent how much the disability leads to functional impairment. In other words, the rating reflects the severity of the disability. Total means a veterans disability is rated at 100% disabling.
While the VA has the final say on whether a VA claim warrants permanent and total disability, some common conditions associated with this type of rating may include loss of use of both legs, total blindness, or a condition that causes a veteran to be bedridden.
If a disability is rated at 100%, then that indicates the veteran is completely or totally disabled. Of course, the higher a disabled veteran is rated, the higher the VA disability compensation awarded.
However, when a veteran has a disability that is considered permanent AND total, there are certain disability benefits that come into play.

Veterans with a 100 percent rating can present their Veteran Health Identification Card to gain entry to Department of Defense and Coast Guard installations, some commissary stores/commissaries, exchanges, and Morale, Welfare, and Recreation retail activities where they can shop at discounted rates.

What Is The Difference Between 100% And P& t
The key difference between a 100% schedular rating and a P& T rating is the ongoing evaluation because of anticipated changes in the condition.
A 100% rating is likely to include follow-up medical appointments because the veterans condition may improve. If the condition improves, the VA can drop the rating and the payment amount.
P& T ratings are not expected to change, therefore they are paid at 100%, but without medical re-evaluation. The condition is not expected to improve or change for the remainder of the veterans life.

If a disabled veteran has a permanent and total disability rating, they do not have to worry about getting scheduled for VA re-examinations.
