New Rules for Back Injury and Social Security Disability

While applying for a Social Security Disability claim, you need to submit a few medical documents along with your application if demanded. How Much Work Do You Need

In addition to meeting our definition of disability, you must have worked long enough and recently enough under Social Security to qualify for disability benefits.

Social Security work credits are based on your total yearly wages or self-employment income. You can earn up to four credits each year.

The amount needed for a work credit changes from year to year. In 2022, for example, you earn one credit for each $1,510 in wages or self-employment income. When you’ve earned $6,040 you’ve earned your four credits for the year.

The number of work credits you need to qualify for disability benefits depends on your age when your disability begins. Generally, you need 40 credits, 20 of which were earned in the last 10 years ending with the year your disability begins. However, younger workers may qualify with fewer credits.

What Is The Disability Determination Process

Most disability claims are initially processed through the network of local Social Security field offices and State agencies. In Louisiana, the state agency is called Disability Determination Services . Subsequent appeals of unfavorable determinations may be decided by Hearing Officers in the DDS’s Hearing Units or Administrative Law Judges in SSA’s Office of Hearings and Appeals.

Does Your Condition Equal A Listing

If your impairment doesn’t match the requirements of the listing, the claims examiner will determine if your impairments can be considered equivalent to a similar listing, in terms of severity. The SSA allows you to “equal” a listing because it can’t include every form or variant of a severe disability in its impairment listings. The SSA also recognizes that there are various ways to diagnose and document the same illness. For instance, the listing might require a specific result on a specific lab test, and you weren’t given that test, but you did take a test that shows the same results as the test required by the listing.Another way to equal a listing is by having a combination of impairments that by themselves aren’t severe enough to meet a specific listing, but combined, their severity equals that of a listed impairment. What Is A Medically Determinable Impairment

A medically determinable physical or mental impairment is an impairment that results from anatomical, physiological, or psychological abnormalities which can be shown by medically acceptable clinical and laboratory diagnostic techniques. A physical or mental impairment must be established by medical evidence consisting of signs, symptoms, and laboratory findings — not only by the individual’s statement of symptoms.

Types Of Disability Policies

There are two types of disability policies.

  • Short-term policies may pay for up to two years. Most last for a few months to a year.

  • Long-term policies may pay benefits for a few years or until the disability ends.

Employers who offer coverage may provide short-term coverage, long-term coverage, or both.

Meeting A Disability Listing For Spinal Surgery Or Fusion

There is no specific disability listing for back surgery or spinal fusion, but if the surgery didn’t correct your impairments, you might meet the requirements of a listing based on the impairments that led you to need back surgery or spinal fusion. Or, where surgery causes nerve compression or arachnoiditis, you might qualify for benefits under the listings for those conditions. The two main listings related to the spine are:

Social Security used to have a listing for arachnoiditis, but the agency deleted the listing in April 2021. Arachnoiditis is now evaluated under listing 11.08, the neurological listing for spinal cord disorders. Visit the above links for information on getting disability for those disorders.

Your condition must significantly limit your ability to do basic work-related activities, such as lifting, standing, walking, sitting, or remembering for at least 12 months. If it does not, we will find that you do not have a qualifying disability.

Special Rules For People Who Are Blind Or Have Low Vision

We consider you to be legally blind under Social Security rules if your vision cannot be corrected to better than 20/200 in your better eye. We will also consider you legally blind if your visual field is 20 degrees or less, even with a corrective lens. Many people who meet the legal definition of blindness still have some sight and may be able to read large print and get around without a cane or a guide dog.

If you do not meet the legal definition of blindness, you may still qualify for disability benefits. This may be the case if your vision problems alone or combined with other health problems prevent you from working.

There are several special rules for people who are blind that recognize the severe impact of blindness on a person’s ability to work. For example, the monthly earnings limit for people who are blind is generally higher than the limit that applies to non-blind workers with disabilities.

In 2022, the monthly earnings limit is $2,260.

    I have a question. I am a teacher with several school related incidents / injuries at work concerning my right ankle, as well as a shoulder. At one time I slipped on water from AC unit overhead and shattered my right ankle. Another time, I fell on broken sidewalk when forced to exit the building through a door with no lights, that I wast familiar with exit, grass knew high. The last injury concerns the right shoulder and elbow, as I was trampled at work. I loss the use of my right hand and arm. I have regained use, but will always be weak with right hand due to ulnar nerve entrapment.

    Please keep in mind that my work does not provide me with any workers comp nor does it follow restrictions from the surgeon.

    My ankle restrictions: No moving furniture, no wet floors, breaks when standing , stooping, climbing, lifting, etc. Plus, personal: no running, jumping, moving furniture, no stooping, climbing, repelling, lifting, etc. In both cases, I must wear orthopedic shoes with inserts and an ankle brace at all times. My ankle is not stable, it is bone on bone, totally reconstructed, tendons and ligaments broke away with chipped ankle bone, tibia bossing was removed.

    While a physical health problem is easily substantiated with diagnostic scans, lab tests, and other empirical evaluations, a mental illness diagnosis is initially viewed as a subjective diagnosis by SSA disability examiners. To qualify for SSDI, a mental illness must have prevented the individual from working for at least six months. The inability to work due to mental illness should be supported by extensive documentation proving the person has had and is continuing to comply with psychological and pharmacological treatments.
