Isnt It Always A Crime To Lie About Military Service

How to Report Disability Fraud: 10 Steps (with Pictures ...

In general, no. While it may be morally reprehensible, it is usually not a crime. However, the Stolen Valor Act of 2013 makes it a crime for someone to claim they received certain medals in order to obtain money, property, or some other tangible benefit. The law only bars false claims about certain military awards, including the Purple Heart, Bronze Star, and a few others and ONLY when someone makes a false claim about them to gain money or some tangible benefit a crime. Someone falsely claiming military service in order to brag or impress others is not a crime. However, our office can investigate other crimes as long as it involves forging, altering, or misusing records from NARA in some way.

How To Get A Reward For Reporting Fraud Against The Government

Rewards for Reporting Fraud against the Government

This article tells you how to get a reward for reporting fraud against the government. If you report fraud against the federal government or a State entity you can get a significant monetary reward. But there are very specific rules and requirements you must follow when you report fraud against the government or you will not be eligible for a reward.

This article outlines the basics for how to apply for a reward and how to properly report fraud against the government.

First, you cannot simply call a hotline to report fraud against the government. Even if you report everything you know to a government agent and they use your information to collect millions, you will not get a reward. Thats because you must follow the process in the reward statute to be eligible for a reward.

Specifically, to receive a reward for reporting fraud against the government you must hire an attorney and file a qui tam civil lawsuit that alleges the fraud being committed against the government. This may sound expensive, but most experienced attorneys handling whistleblower reward cases work on a contingency basis for filing your reward application for reporting fraud. But it is important that you select an experienced attorney.

See the link at the bottom of the page below Do I have a case to have Mr. Hesch review your potential case for how to get a reward for reporting fraud against the government.

How To Report A Person Abusing Va Benefits

How to Report Disability Fraud: 10 Steps (with Pictures ...

The United States Department of Veteran’s Administration falls prey to those who employ fraud just as easily as any other agency. And because funding comes from the taxable income of working Americans, waste and abuse within the Veteran’s Administration hurts honest citizens. There is a way to fight the criminals who cheat the VA system. Simply contact the Office of the Inspector General Hotline in Washington D.C.

Compile information. Prepare to make your claim by finding out if the VA facility disbursing the benefits is regional, state or federal. Make sure you have the names of all wrongdoers, victims or witnesses, the date of the event, and the names of people or agencies that may have already investigated the incident. Know the nature of the fraud or waste, and the effects of that activity in terms of lost time or misappropriated funds. Gather evidence if possible.

Decide if you want to remain anonymous, or if you are willing to provide full contact information. If your allegation seems vague and the OIG has no way to contact you to clarify details, they will drop the case. Read More:How to Write a Notice of Disagreement for the VA

Can You Lose Va Disability Benefits From Substance Abuse

A veteran can lose disability benefits is if theyre found to be involved in willful misconduct, meaning they are intentionally engaging in prohibited conduct, without caring about the consequences.8

The VA recognizes that many veterans are dealing with service-connected mental health issues and that drugs and alcohol are often used to help cope with underlying issues. For that reason, and if the disability wasnt caused by substance abuse, they shouldnt lose their disability benefits.

What Is Disability Fraud

Disability fraud is a crime in which someone collects disability benefit payments they’re not entitled to. It can take several forms, including:

  • Misrepresenting or falsifying a diagnosis or symptoms on an application for disability benefits so as to improperly claim eligibility for disability payments.
  • Accepting benefits while also receiving unreported payments through workers’ compensation or a private long-term disability insurance program.
  • Continuing to accept disability benefit payments after recovering from an illness or an injury that made working impossible.
  • Under certain circumstances, working at one or more paying jobs while collecting disability payments.

Note that SSDI recipients may legitimately work at jobs that pay less than their monthly SSDI benefit amount, as long as they report their income to the SSA. Some SSDI beneficiaries may also be allowed to stay in the program while working full time on a trial basis so as to determine whether or not they can handle the demands of a new job.

Recipients of disability benefits aren’t the only ones who can commit disability fraud. When caretakers are entrusted to manage the needs of a person with disabilities , the caretakers also may abuse the system, in instances such as the following:

What We Do With Your Report

We take all reports of suspected fraud seriously and assess every report.

Sometimes you may not see changes to someones situation. This can be because the information you give us does not always result in a change in a persons payment or service.

In some cases we may be unable to take any further action. For example, we may find any of the following:

  • the person you name does not receive a payment or service from us
  • we cannot identify the person
  • the information does not affect the payment or service the person receives
  • the information does not match the persons situation
  • the information provided is not fraud against us where we are the victim

Where we find enough evidence of criminal behaviour we may refer matters to the Commonwealth Director of Public Prosecutions. This may lead to criminal charges and imprisonment.

Investigation of criminal offences can be a lengthy process and it may take several years before details become publicly known, if at all.

Not all investigations find enough evidence to prove a criminal offence. Even if someone receives an ineligible payment through a mistake or error, people must repay the money.

What To Do If You Suspect Abuse Of The Disability System

If you believe you know of a case of disability fraud, you can report it online to the Social Security Administration Office of Inspector General or by calling the OIG at 1-800-269-0271.

The OIG looks into all reports, but gives priority to those that back up charges with evidence. Any of the following information may improve the likelihood of a successful investigation:

  • Name, address, date of birth and Social Security number of the person suspected of fraud.
  • Paperwork that contradicts the medical basis for a disability claim or that demonstrates misuse of SSDI or SSI benefit payments.

When attempting to document disability fraud, make sure you do it legally. Don’t trespass while using your camera or collecting paperwork, and if you want to record a phone conversation without the other person’s knowledge, make sure doing so is legal in your state.

When you report disability fraud, the OIG gives you several confidentiality options:
