A wide majority of private-sector employees are covered in the state. There is an itemized list of exempted employers on the New York State disability website but due to the fact that the exceptions are very specific, it is likely that most private sector employees have coverage under this stipulation.
What Counts As A Disability
There isnt one standard definition for a disability that applies across the board here.
Its all plan- or policy-specific, says Chicago-based attorney Michael Bartolic, whose firm focuses on employee benefits and deferred compensation. As a general observation, its any sort of injury or illness that renders one unable to do their job.
That could include things like childbirth, a major surgery with a long recovery period, an illness that requires frequent treatment, or an injury sustained in some sort of accident. Bartolic explains that the best thing to do is to check your plan documents, as the definition of disability should be clearly spelled out there.
If You Become Disabled While You Are Unemployed
- If you have been unemployed for less than four weeks
- your disability benefits are provided by your last employer’s disability benefits insurance carrier, and
- the seven-day waiting period applies.

Applicable Family Leave Acts
There exist two distinct laws that apply to family leave in New York State: the Family Medical Leave Act the and Paid Family Leave Act . They are meant to offer employment protections and continuing health care access for parents. The statutory regulations will only go in effect in 2018, so new parents can rely on only the federal regulations until then.
Does Short Term Disability Cover Pregnancy And Maternity Leave
Maternity leave is one of the most common uses of short term disability insurance. Many policies pay benefits up to six weeks after a normal delivery. For a C-section, women may receive up to eight weeks of benefits.
Keep in mind that benefits are subject to the policyâs waiting period. If the policy has a seven-day waiting period, benefits start seven days following delivery.
Itâs also very important to understand that pregnancy is considered a pre-existing condition. That means if you were pregnant prior to signing up for coverage and your policy limits benefits for pre-existing conditions, you would receive limited or no benefits for pregnancy-related time off.
If there are complications resulting from the pregnancy or delivery, you may qualify for additional benefits, either before or after delivery. This will require certification from your doctor.
Commuters Coming From The Other States
State labor laws covering maternity leave are relevant to employees based on their location of employment instead of which state in which they live. If a person commutes from outside of the state in order to work within New York, then these laws apply to that person. Meanwhile, their home state’s rules don’t have any jurisdiction.
Understanding Rhode Islands Two Temporary Disability Benefits Programs
Rhode Island employees whose injuries and illnesses arent work-related can apply for the states Temporary Disability Insurance benefits program. Importantly, TDI claimants dont owe state or federal income tax on their temporarily disability benefits. The states Temporary Caregiver Insurance program covers family caregivers or parents wishing to bond with a new child. Qualified TCI applicants can get benefits for up to four weeks. As of July 2020, the minimum payment is $98/week the maximum short-term disability pay amount is currently $887/week. Who Can Apply For New Jerseys Temporary Disability Benefits
Employers who pay workers at least $1,000 per year are covered by the New Jersey Temporary Disability Benefits Law . If youre unable to work due to an illness or injury that isnt work-related, you can file a TBDL claim. Be sure to file your claim within 30 days after your first missed day of work, though. Pregnancy And Maternity Leave
If you are disabled due to pregnancy, you may be entitled to up to 26 weeks of disability benefits.
You will need to submit a medical report completed by a doctor or certified nurse midwife stating your disability is due to pregnancy.

- started more than four weeks before the anticipated birth date OR
- lasts more than four to six weeks after the actual birth date.

- Your employer/insurance carrier may designate a health care provider to examine you. You must submit to requested examinations under the following conditions:
- Exams may occur at intervals, but not more than once a week.
- You do not pay for the exams.
- Exams occur at a reasonable time and place.
What If Im Shopping For Supplemental Disability Insurance
If you already have a group long-term disability policy through your job, you may be looking to supplement it with a private long-term disability policy. In this case, you should look at the benefit youâre already receiving and see what percentage of your after-tax income it covers.
Assuming it doesnât cover at least 60% of your income, you should figure out what your private benefit amount would need to be in order to get you, in total, 60% of your income from your two LTDI policies.
To put that into a formula:Group benefit amount +Private benefit amount =Total benefit amount
There is one huge wrinkle in this calculation, however: group LTDI benefits are taxable if the premiums are paid by your employer. Make sure you factor this into your math.

New York Has A State Temporary Disability Program That Pays Employees Who Are Unable To Work Due To Pregnancy And Childbirth

New York is one of the few states that has a temporary disability insurance program, which requires employers to provide short-term disability insurance for their employees. Employers are required to provide partial wage replacement, for up to 26 weeks, to employees who are temporarily unable to work due to disability. Pregnancy and childbirth are covered under the law.
In 2018, New York will start phasing in its new paid family leave program, which will provide up to 12 weeks of paid benefits to employees who need time off to care for a new child .
Reduction For Disability Payments From Other Sources
If you receive disability benefits from a private source, like a private pension or private insurance benefits, these benefits will not affect your SSDI benefits. If, however, you receive other public disability benefits, they may affect your SSDI benefits. For instance, if you were injured on the job and are receiving workers compensation benefits, the amount of SSDI benefits you receive might be reduced.
Other disability benefits that are not job-related and are paid for by the federal, state, or local government may also reduce your SSDI benefit amount. Examples of these include temporary disability benefits paid by the state, military disability benefits, and state or local government retirement benefits that are based on disability. Some public benefits are not counted toward the 80%, including SSI or VA benefits.
The combined total amounts you receive from SSDI and all other public disability benefits cannot be more than 80% of the average amount you earned before you became disabled. If the amount is more than 80% of what your average earnings were before you became disabled, in most states, the excess amount is deducted from your SSDI benefits.
The interaction between workers compensation and SSDI can be complicated and varies depending on what state you live in. If you qualify for more than one public disability benefit, you may want to speak with an attorney to make sure you do not miss out on any benefits you are entitled to.

Treatment And Return To Work Programs
You might have to do treatment or return to work programs physiotherapy, occupational therapy, and psychological therapy, for example. This is more common with long-term disability plans, but can happen in short-term, too. They cant force you to go, but if you dont, they can stop your payments.
So, if you have been getting benefits for a few months, be aware that you might be sent for treatment soon.
What Qualifies As Short Term Disability

Employers that fall under this act’s purview are one that employ 50 or more workers within 75 miles of the affected individual. There are eligibility criteria, such as hours worked.
If a woman is pregnant and has worked at one place for at least 12 months , the employer is required to guarantee her job for at least 12 weeks from the time she gives birth, under the federal FMLA. Employees are entitled to six weeks of unpaid maternity leave, which runs concurrently with the 12 weeks they’re entitled to under the FMLA.
The federal FMLA also applies to teachers employed by private, nonprofit, and public schools with more than 50 workers within a 75-mile radius.
The Pregnancy Discrimination Act bans workplace discrimination regarding pregnancy, childbirth, or any related medical complaint, while the American with Disabilities Act deals with accommodations that are or are not provided by employers when complications develop.
Qualifying For Temporary Disability Benefits In Hawaii
Hawaiians working at least 20 hours for 14 out of the last 52 weeks may qualify for temporary disability benefits. In addition, applicants must be currently employed when filing a Hawaii Temporary Disability Insurance claim in order to qualify.
