Permanent Total Disability Benefits and Making a Claim

If a Veteran has been granted pensioned disabilities only under the Pension Act and has not been awarded a disability award, then this Veteran would not be eligible to receive the additional one-time lump sum payment.

This was to address concerns that the value of the disability award was less when compared with the value of the disability pension over the lifetime of the Veteran. Also, this change makes the disability award more comparable to other forms of compensation paid in Canada for pain and suffering.

Benefits For Disabled Widows Or Widowers

If something happens to a worker, benefits may be payable to their widow, widower, or surviving divorced spouse with a disability if the following conditions are met:

  • The widow, widower, or surviving divorced spouse is between ages 50 and 60.
  • The widow, widower, or surviving divorced spouse has a medical condition that meets the definition of disability for adults and the disability started before or within seven years of the worker’s death.

Widows, widowers, and surviving divorced spouses cannot apply online for survivors benefits. However, if they want to apply for these benefits, they should contact Social Security immediately at 1-800-772-1213 to request an appointment

To speed up the application process, complete an Adult Disability Report and have it available at the time of your appointment.

We use the same definition of disability for widows and widowers as we do for workers.

Sss Lump Sum Disability Benefit Computation

SSS uses different formulas for computing the lump sum amount for totally and partially disabled members:

Total Disability Benefit:

Whichever of these formulas results in a higher amount:

  • Monthly disability pension x Number of SSS monthly contribution payments
  • Monthly pension x 12

Partial Disability Benefit:

Whichever of these formulas results in a higher amount:

  • Monthly disability pension x Number of SSS monthly contribution payments x Percentage of disability in relation to the whole body
  • Monthly pension x 12 x Percentage of disability

Lets say a partially disabled SSS member wants to claim his lump sum benefit. If he has 10 credited years of service, 40% disability , and 30 paid monthly contributions, heres the lump sum amount computation:

  • PHP 1,200 x 30 x 0.40 =;PHP 14,400
  • PHP 1,200 x 12 x 0.40 =;PHP 5,760

The higher amount from the two computations is;PHP 14,400, which then becomes the lump sum benefit that the SSS member will receive.

How Your Application Is Assessed

If you have made enough contributions to the Canada Pension Plan, we pass your file to our medical specialists for a medical assessment.

Applications are not assessed on the basis of a medical diagnosis alone, or on the basis of which disability or disease you have. Several factors are considered, including:

  • the nature and severity of your medical condition
  • the impact of the condition and treatment on your capacity to work
  • the likely course of your condition
  • your age, education and work history
  • your work performance, productivity and how much you are earning

Service Canada does not consider the availability of suitable employment in the applicant’s region when determining eligibility.

Permanent And Total Disability Va Benefits Pay Some Veterans Over $2900 A Month

Permanent and Total disability VA benefits ratings pay lots of veterans over $2,900 a month. If you receive;Permanent and Total disability VA benefits you may also be able to get monthly compensation for dependent children and parents.

If you have been told by a worker at the VA you are not eligible, you should still apply. If you have been denied, you can file a TDIU Benefit appeal. If you deserve a Permanent and Total disability VA benefits rating, dont give up. Many veterans are denied or wrongly told they dont deserve;Permanent and Total disability VA benefits.

Many veterans also receive back pay when their claim is approved. This is the money the VA should have been paying you which dates back to your effective date. That is not necessarily the date you applied. Many veterans find their effective dates were years before they ever applied.

Mailing Your Documents

If you mail any documents to us, you must include the Social Security number so that we can match them with the correct application. Do not write anything on the original documents. You will get a faster decision when you apply for Social Security Disability Insurance or Supplemental Security Income with the Social Security Administration if you provide:

  • Your Social Security number

What Kind Of Social Security Disability Benefits Are Available To Louisiana Citizens Who Can Get Disability Benefits Under The Social Security Administration

The Social Security Act provides benefits to disabled individuals under Title II and Title XVI .

Under Title II there are three basic categories of individuals who can qualify for benefits on the basis of disability:

  • ;A disabled insured worker under 65.;
  • ;A person disabled since childhood who is a dependent of a deceased;insured;parent or parent entitled to Title II disability or retirement benefits.;
  • ;A disabled widow or widower age 50-60 if the deceased spouse was insured under Social;Security.

Under Title XVI there are two basic categories under which a financially needy person with limited income and resources can get payments on the basis of disability:

  • ;An adult age 18 or over who is disabled.;
  • ;A child under 18 who is disabled.

Adults Disabled Before Age 22

An adult who has a disability that began before age 22 may be eligible for benefits if a parent is deceased or starts receiving retirement or disability benefits. We consider this a “child’s” benefit because it is paid on a parent’s Social Security earnings record.

The disabled “adult child” including an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild must be unmarried, age 18 or older, have a disability that started before age 22, and meet the definition of disability for adults.


It is not necessary that the disabled “adult child” ever worked. Benefits are paid based on the parent’s earnings record.

  • A disabled “adult child” must not have substantial earnings. The amount of earnings we consider “substantial” increases each year. In 2021, this means working and earning more than $1,310 a month.

What Are Va Disability Ratings

The VA uses disability ratings to quantify the severity of your condition. They range from 0 to 100%. At a 0%rating, the VA generally believes your limitations are minimal and thus do not warrant disability compensation. On the other end of the spectrum, a 100% rating signifies a condition so severe as to be totally limiting of ones ability to work.

A 0% rating offers no monthly monetary compensation, but it might make you eligible for ancillary benefits, such as health care. A 100% rating provides the maximum scheduler benefit in monthly compensation. For ratings between 0 and 100%, the monthly benefit increases incrementally with each higher rating.

As of December 1st, 2020 the VA disability rate benefit amounts are as follows:

  • 0 percent disability rating: $0.00 per month
  • 10 percent disability rating: $144.14 per month
  • 20 percent disability rating: $284.93 per month
  • 30 percent disability rating: $441.35 per month
  • 40 percent disability rating: $635.77 per month
  • 50 percent disability rating: $905.04 per month
  • 60 percent disability rating: $1,146.39 per month
  • 70 percent disability rating: $1,444.71 per month
  • 80 percent disability rating: $1,679.35 per month
  • 90 percent disability rating: $1,887.18 per month
  • 100 percent disability rating: $3,146.42 per month

If you are applying by paper, you must complete 1 of the following forms that applies to your situation:

Information on completing the application form

  • Read all instructions, which include steps for completing your application, changes that may affect your benefits, an address page, a checklist and other information about disability benefits
  • Write/type your Social Insurance Number at the top of each page in the form and sign all areas that require your signature
  • If you are a parent or guardian, you can request the;child-rearing provision and the;children’s benefit;
  • If you are unable to fill out the forms, a family member or a friend can help you. Make sure that you sign where necessary
  • Keep photocopies of everything you submit. If you call us, write down the name of the person you speak to and the date and time of your conversation. Keep all the information in one place

If someone is helping you with your application

You must provide consent for someone to help you with your application. You can do this 2 ways:

  • through your My Service Canada Account
  • This does not give the person helping you authority;to:

    • submit your application
    • apply for benefits on your behalf
    • change your payment address
    • request or change the withholding of tax for you

    If you need to apply or act on someone’s behalf

    If someone cannot manage their own affairs, another person or agency may act on their behalf.

    After You Get Your Aid

    Your equipment and/or services approved for BSWD and/or CSG-PDSE funding must be purchased before the end of your study period.

    You must provide receipts as proof of purchase for these equipment and/or services. If you were approved for tutoring or note taking services, you must also provide a time log that matches the receipts provided.

    You may be required to repay all or part of the funding you received and your eligibility for further funding from OSAP could be impacted if:

    • You dont purchase your goods or services before the end of your study period.
    • Your receipts dont match the amount corresponding to the equipment and/or services you were approved for.
    • Your receipts were not received by your financial aid by the receipt deadline.

    How Do You Get Disability For Listed Medical Conditions

    If your disability is listed in Social Security’s Listing of Impairments, the first step is to get a diagnosis of the condition from your doctor. A mere diagnosis will get you an automatic disability approval for only a few conditions, however, like ALS, an organ transplant, or certain serious cancers, such as esophageal cancer, mucosal melanoma, anaplastic carcinoma of the thyroid gland, or small-cell carcinoma . For all other conditions, the next step is to determine if your medical condition meets the specific criteria for that condition. The listing requirements are often quite complex; our illness-specific articles simplify the medical criteria in the listings so that you can understand whether your condition will qualify for disability.

    If you haven’t had the clinical or laboratory tests required in the listing, you can ask your doctor to perform them. Or you can wait for the SSA to pay for a consultative exam, but this makes your claim take longer. It’s generally better if the test results are already in your medical record before you apply. Then you can check to see if your test results meet the requirements of the listing, and if they match the criteria or are close, you can apply for disability.

    You should apply for disability benefits as soon as you become disabled. Follow these easy steps to apply online for disability:

    • To start your application, go to our Apply for Benefits page, and read and agree to the Terms of Service. Click Next.
    • On that page, review the Getting Ready section to make sure you have the information you need to apply.
    • Select Start A New Application.
    • We will ask a few questions about who is filling out the application.
    • You will then sign into your mySocial Security account, or you will be prompted to create one.
    • Complete the application.

    You can use the online application to apply for disability benefits if you:

    • Are age 18 or older.
    • Are not currently receiving benefits on your own Social Security record.
    • Are unable to work because of a medical condition that is expected to last at least 12 months or result in death; and
