When you apply for disability benefits from the Social Security Administration, make sure that you fill out all paperwork and answer all questions in a frank fashion. You should be completely honest and not over or understate your impairment. Part of the application is the Disability Report, which is a form where you explain how your medical condition prevents you from working. If you are an applicant under 50 years of age, this explanation has to elaborate why you are unable to do any jobs that you have done within the past 15 years, as well as why you are unable to do easy full-time jobs.

The application process itself can be done in any one of three ways: online, in person, and via telephone. An online application can be completed anytime at your convenience via the Social Security Administration website. An application for Social Security disability benefits can be completed online, but an application for Supplemental Security Income cannot. You can, however, complete one of the other forms needed for SSI, the Adult Disability and Work History Report, on the website.

If You Become Disabled While You Are Unemployed

  • If you have been unemployed for less than four weeks
  • your disability benefits are provided by your last employer’s disability benefits insurance carrier, and
  • the seven-day waiting period applies.
  • If you have been unemployed for more than four weeks and are collecting unemployment insurance benefits
  • the Workers’ Compensation Board Special Fund for Disability will provide your disability benefits, and
  • no waiting period is required.
  • You may not collect unemployment benefits and disability benefits for the same period of time.
  • What Conditions Are Considered For Disability

    To qualify for Social Security Disability Insurance, an applicant must have a medical condition that is expected to last for at least one year or longer. The disability may, in some cases, be life-threatening. Many of the conditions that would qualify the applicant for disability are listed in the Social Security disability blue book. Conditions in the listing manual for 2020 include:

    â Back injuries and musculoskeletal conditions

    â Heart failure, coronary artery disease and other cardiovascular conditions

    â COPD, asthma, or other respiratory illnesses

    â Sensory or speech issues including blindness or hearing loss

    â IBD or liver disease and other digestive tract problems.

    â Multiple Sclerosis, cerebral palsy, Parkinsonâs Disease, Epilepsy or other neurological disorders.

    â Sjogrenâs Syndrome or Marfan Syndrome and other various syndromes.

    â Depression, anxiety, autism, intellectual disorders, or other mental disorders.

    â Dermatitis and other skin disorders.

    â Cancer

    â HIV/AIDs, lupus, rheumatoid arthritis and other immune system disorders.

    â Genitourinary problems including kidney disease.

    â Hemolytic anemias, disorders of bone marrow failure and other hematological disorders

    If You Become Disabled While You Are Employed

    • There is a seven day waiting period for which no benefits are paid. Benefits begin on the eighth consecutive day of disability . If you have been disabled more than seven days, your employer must give you a Statement of Rights under the Disability Benefits Law within five days of learning that you are disabled .
    • A “day of disability” is a day on which you were prevented from performing work because of disability and for which you have not received regular wages or remuneration. You are ineligible for disability benefits if you perform any type of work for which you receive wages or profit, even if performed at home.

    If you already have a group long-term disability policy through your job, you may be looking to supplement it with a private long-term disability policy. In this case, you should look at the benefit youâre already receiving and see what percentage of your after-tax income it covers.

    Assuming it doesnât cover at least 60% of your income, you should figure out what your private benefit amount would need to be in order to get you, in total, 60% of your income from your two LTDI policies.

    To put that into a formula:Group benefit amount +Private benefit amount =Total benefit amount

    There is one huge wrinkle in this calculation, however: group LTDI benefits are taxable if the premiums are paid by your employer. Make sure you factor this into your math.

    Determine Your Eligibility

    To be eligible for disability benefits, you must have a medical condition that makes it impossible for you to do the work you did before your illness or injury. You must also have paid into Social Security through a previous employer and earned enough work credits.   • The term autism is an umbrella term used by the Social Security Administration that encompasses encompassing three separate types of mental disorders: autism, Asperger Syndrome and Pervasive Developmental Disorders . All three are congenital disorders interfering with the cognitive, physical and communicative abilities of children and adults.

    Children diagnosed with autism are unable or have extreme difficulty communicating verbally and nonverbally. They engage in repetitive behaviors , do not acknowledge the presence of others and may not begin speaking until they reach preadolescence. Asperger Syndrome and PDD-NOS are usually less severe than autism. People with AS are often quite intelligent but suffer from a different set of symptoms involving social skills and empathizing with others.

    The New York State Disability Benefits Law, in accordance with the State of New York Workers Compensation Board, requires that the Research Foundation provide partial income replacement to employees for up to 26 weeks for an off-the-job illness or injury.

    â People who are receiving aid from a charitable or religious institution

    â A corporation that consists of corporate officers who singly or jointly own all stock or hold all of the offices and employ no other employees

    â Golf caddies

    â Students at elementary or secondary school who go to classes during the daytime and work part-time either during their school year or during their regular vacation period

    â Employees who change from one job that qualifies for disability to another that is exempt or ânon-coveredâ and work for more than 4 weeks

    â The spouse of an employer that filed a spousal exclusion form

    Medical Record Fees Limit In New York

    With regards to obtaining medical records to submit with your disability application, New York allows doctors and other medical professionals to charge a reasonable fee for medical records. However, the charge may not exceed 75¢ per page. Additionally, your doctor cannot deny you your medical records because you are unable to pay for them.

Many experts recommend that applicants prepare to wait between 3 to 5 months from the time of application to receive an initial decision about SSDI benefits.
