May a state court order a retiree who waives retirement to receive disability to indemnify the former spouse for the reduction in that spouses share of the retirement?
No, according to a unanimous 2017 U.S. Supreme Court decision, Howell v. Howell,;137 S.Ct. 1400 . SCOTUS made clear that states not only cannot divide disability directly , but cannot do it indirectly either by ordering dollar-for-dollar indemnity.
Prior to Howell, federal law had long prevented states from dividing VA disability payments.;Mansell v. Mansell, 490 U.S. 581 . Colorado has similarly ruled that divorce courts cannot divide VA disability payments, nor require the servicemember to indemnity the spouse for a VA waiver of retired pay that happened prior to dissolution.;In re Marriage of Franz, 831 P.2d 917 .
The majority rule among the states had been that the federal prohibition on dividing VA disability did not preclude a state from ordering the retiree to indemnify the former spouse for the resulting VA waiver, under the theory that once the former spouse has a vested interest in the retirement, the military member cannot unilaterally reduce the other spouse’s share by applying for VA disability. In other words, once the spouses were divorced, if the member then converts a portion of retirement to disability, he/she would owe the former spouse indemnity for any VA waiver.

How To Get 100 Percent Disability From Va
There are two different ways to get disability benefits for a VA 100 percent rating. Combined Rating System For Veterans With Multiple Disabilities
Veterans with multiple disabilities use the combined rating system.
To use the combined rating system, arrange the disabilities in order by severity and locate the intersect of the two numbers on the table below.
The VA rounds the final figure to the nearest to 10 percent.
If the Veteran has more than two disabilities, find the combined value for the first two, without rounding, and repeat with the third disability. Once you have a final number, round to the nearest 10%.
For example, if disability 1’s rating is 40% and disability 2’s is 20%, the combined rating is 52%. That figure gets rounded to the nearest 10%, making the disability rating 50%.
For a three-disability example, if disability 1’s rating is 60%, disability 2’s rating is 30%, and disability 3’s rating is 20%, we first find the rating of 1 and 2. The rating of 1 and 2 comes out to be 72. We then take the first combined rating and find the intersect with disability 3. The final number comes out at an even 80% rating.

What Your Va Disability Rating Means
The VA distributes benefits on a sliding scale based on your level of disability. The more disabling your medical condition, the more money youll receive in compensation.
The VA uses the disability rating system to put a number on what it perceives as your level of disability. The rating schedule runs from 0 to 100 percent in increments of 10. A 100 percent rating is the top of the schedule, indicating total disability. Va Disability Payment Rates
The VA awards a disability rating between 10% and 100%, which, along with the number of family members, determines the amount of the servicemember’s. The VA publishes Veterans Compensation Benefits Rate Tables annually in December.
The minimum disability payment, for a 10% rating and no dependents, is $136/mo. The payments increase $3,261.10 for a veteran with a 100% rating, spouse, and one child .
Note that a members rank, while affecting the retirement payment, does NOT affect the amount of disability paid. So a married member with no children and a 30% disability rating will receive the same $466/mo payment , regardless of whether he was an Army Specialist or a Colonel .
In other words, a 40% disability rating is solely used by the VA to determine the disability payment. It does not mean that the retiree must waive 40% of her retirement in order to receive disability payments.

How The Va Rating System Works
