Not only can they do this, they have. With over 55% of returning Iraq and Afghanistan Veterans utilizing VA health care, its a rate of utilization greater than any other generation of Veterans.

And for those Veterans in crisis, the responders at the Veterans Crisis Line are there to help 24/7. Every day in fiscal year 2012, responders answered approximately 530 calls and rescued nearly 18 Veterans and family members in crisis. Period Of Active Duty Service

There is some confusion as to how much time a veteran had to have spent in active duty service in order to be eligible for any benefits. The rules below pertain primarily to Pension, education benefits and loan guarantees but as a general rule are applied to all benefits. But there are exceptions such as eligibility for Disability Compensation, life insurance and VA healthcare as well as full benefits for survivors of individuals who died on active duty regardless of how long they were in the service.

• Prior to generally each benefit defined its own length of duty service
• After 1981 24 months or more of active duty service or successful completion of the term of commitment for service
• Disability Compensation and DIC are some of a few exceptions from the 24 month rule

To be eligible for most veterans benefits, a minimum period of active duty of 24 continuous months or the full period for which a person is called or ordered to active duty must be completed. This rule has been in effect since October 16, 1981 for new enlistees. Prior to this date, there is no regular rule of length of service duty that applies for benefits and each benefit generally had its own rules.

Here are a few of the exceptions to this minimum period of active duty for benefits. However, there are more rules than just these.

General Rating Formula For Mental Disorders

If the VBA determines that a veteran has service-connected PTSD, then they assign a disability rating, expressed as a percentage. This disability rating determines the amount of compensation and other disability benefits the VA provides the veteran. The disability rating indicates the extent to which PTSD has deprived the veteran of their average earnings capacity.

The VA assigns disability ratings based on criteria set forth in the Code of Federal Regulations, Title 38, Part 4Schedule for Rating Disabilities, often referred to as the âVA Schedule for Rating Disabilitiesâ or VASRD. The rating schedule for mental disorders is called the âGeneral Rating Formula for Mental Disordersâ , which specifies criteria for disability ratings of 0%, 10%, 30%, 50%, 70%, or 100%.

Some argue that by relying on the current Rating Formula, âVA uses decades-old regulations developed for mental disorders that do not resemble PTSDâ, and consequently, ârrelevant criteria ⦠may outweigh ⦠more relevant factors, leading VA to undercompensate veterans with valid diagnoses of PTSD.â Similarly, veterans service organizations have argued, for example, that a â⦠veteran service connected for schizophrenia and another veteran service connected for another psychiatric disorder should not be evaluated using the same general formulaâ and have supported efforts to revise the Rating Formula.

Throughout the years, as the numbers of our married men and women in uniform have grown and as their military missions have become more complex and dispersed, their spouses have made countless personal sacrifices to support the Armed Forces, President Regan noted in his 1984 proclamation. Military spouses play a huge role in not only taking care of things while their loved ones are deployed, but also in providing a backbone of support and care during the tough times. • Disability Compensation and DIC are available to reserve and guard members who were not on active duty but sustained injury and certain medical conditions from active duty for training and injury from inactive duty for training

In June 2015, Congress authorized that approximately 2,000 National Guard flight crews assigned to C123 aircraft that were used to disperse Agent Orange in Vietnam are also eligible for Disability Compensation benefits. Even though these pilots were not on active duty, the planes they flew were considered to be contaminated by agent orange and as such the pilots would be eligible for any agent orange Disability Compensation benefits.

Why Va May Reduce Your Disability Rating For Ptsd

Your VA disability rating for PTSD is based on how your condition affects your ability to work and carry out daily living activities. When you get approved for benefits for PTSD or any other condition, VA assigns you a disability rating between 0 percent and 100 percent in increments of 10 percent.

This rating shows the level of functional impairment caused by your condition, based on VAs review of your medical records and supporting documents.

For PTSD and most mental disorders, you will receive one of six disability ratings: 0 percent, 10 percent, 30 percent, 50 percent, 70 percent, or 100 percent. The criteria to receive each of these ratings are:

The rating you receive is assigned by the VA when your service connection is established. But PTSD can either improve or deteriorate over time. If it does either, VA may attempt to raise or lower your disability rating to match your current condition.

Suppose you return from combat with PTSD so bad that you can barely leave the house or feed yourself, much less work. You apply for disability and submit ample supporting evidence detailing the extent of your condition. VA assigns you a 100 percent rating based on your inability to work or carry out daily living activities.

But then you undergo intensive therapy. One year later, you still have PTSD, but it is now moderate, and you can hold down a job. If the VA decides to re-examine you, it may lower your rating from 100 percent to 50 percent.
