Are School Employees Eligible For Disability Insurance Benefits During School Breaks
School employees are not eligible for Disability Insurance benefits if:
- Full wages were or will be paid to the employee during the contract period when services were performed.
- A period of disability overlaps with a school break and the employee is not scheduled to work, does not have a history of working during the break, or does not have an additional employer.
- The disability period extends through the school break period.
However, if the employee is not receiving wages but would have been working for extra income if not disabled , then the employee may be eligible for benefits to replace the additional income.
What Is The Ideal Situation In Which Id Receive Both Types Of Benefits
An ideal case for receiving both types of benefits is if you are under 62 years of age, currently receiving SSI benefits, and actively pursuing work .
Another case in which a person could receive both Social Security benefits and unemployment benefits is if the recipient is disabled to such a degree that they cannot work full-time and receive SSDI benefits, but are still looking for some work to generate income.
Note: SSDI benefits will only continue if a beneficiarys monthly earnings do not exceed $1,260 per month in 2020. Once a beneficiary receiving both types of benefits finds work and makes over that amount regardless of whether its from unemployment insurance or other sources of income SSDI benefits will be discontinued.

If you’re among those who can collect unemployment benefits while looking for a part-time job, you still need to research how your unemployment benefits might affect any Supplemental Security Income . If you do qualify for unemployment benefits and start receiving monthly payments, those payments can affect your eligibility for the disability program. You can be denied SSI benefits if your unemployment checks cause your monthly income to exceed the limits.
If you go the route of applying for both, you aren’t saying that you can hold down a full-time job but you’re also not saying that you are unwilling to look for a job. In this situation, you state that your disability prevents you from working full-time and that you need unemployment benefits to make up for your lack of a job while you seek other options.
Note that some states require you to be willing to look for a full-time job in order to receive unemployment benefits. You’ll need to check with your state laws ahead of time.

Differences Between Disability Benefits And Paid Family Leave
- Only the birth mother is eligible for disability benefits for the period immediately after the birth of a child.
- Paid Family Leave begins after the birth and is not available for prenatal conditions.
- A parent may take Paid Family Leave during the first 12 months following the birth, adoption, or fostering of a child.
- You cannot collect disability benefits and Paid Family Leave benefits at the same time.

You cant work for your employer if youre receiving PFML benefits unless you are taking leave on a intermittent or reduced schedule.
If you workoutside of the agreed upon schedule,youll lose your leave payments for that week.
Conan was approved for 8 weeks medical leave on a reduced schedule where he took leave 3 days a week . On the third week of leave, his employer asked him to work on Wednesday. Conan worked that Wednesday and reported it as part of his weekly report to PFML. As a result, he was not paid for his medical leave that week. If a payment had already been issued, the next payment would be adjusted.
Adults Disabled Before Age 22
An adult who has a disability that began before age 22 may be eligible for benefits if a parent is deceased or starts receiving retirement or disability benefits. We consider this a childs benefit because it is paid on a parents Social Security earnings record.
The disabled adult child including an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild must be unmarried, age 18 or older, have a disability that started before age 22, and meet the definition of disability for adults.
It is not necessary that the disabled adult child ever worked. Benefits are paid based on the parents earnings record.
- A disabled adult child must not have substantial earnings. The amount of earnings we consider substantial increases each year. In 2021, this means working and earning more than $1,310 a month.

Can I Collect Disability Benefits And Unemployment At The Same Time
Although disability benefits and unemployment payments dont mix much of the time, there are some circumstances in which an individual receiving disability benefits could also be entitled to unemployment. If you are working part-time on disability and you are laid off from your job, you may be able to collect both your SSDI benefits and unemployment at the same time.
The same may be true if you are in a trial work period as a part of the SSAs Ticket to Work Program and are laid off. Keep in mind, however, that requirements and restrictions on how much you can receive from your states unemployment office in addition to disability payments may vary considerably depending on where you live and work. Third, the person must be actively interviewing for jobs.
In most cases, those who are terminated from employment while out on short term disability will be able to go on and receive unemployment benefits. This is because they are likely to recover from their disabling condition sooner rather than later and, therefore, be able to perform their job duties. Those who are terminated while on long term disability, however, may remain unable to work. Because of this inability to retain substantially gainful employment due to disability, a person would be unable to collect unemployment.
Should you be terminated while on disability and be eligible for unemployment benefits, you should file for these benefits as soon as you recover. Because the amount of wages you earned in the year you seek to collect benefits may be affected by your disability leave, you may be able to use an alternate base year. The alternate base year set by your date of disability will allow you to qualify for unemployment benefits based on what you made in a normal year that was not affected by your disability.
