Unlike a leave of absence you might take under the Family and Medical Leave Act , short-term disability doesnt offer any direct job protection. Many people are surprised to hear that you can legally be fired from your job while on leave, and you also arent entitled to the exact same position when you return.

They will consult with departmental human resources who will coordinate your return to work with your manager and caseworker, if you are receiving benefits through disability or long term disability.

Your manager will inform the Pay Centre of your return to work or rehabilitation schedule, once it has been approved by the employee, manager and human resources, if it differs from your pre-illness schedule. Your manager will also inform your departmental human resources, who in turn will advise the Pay Centre when you are no longer on a rehabilitation schedule. You will be required to provide the Pay Centre with a copy of the approved rehabilitation schedule from your insurer.

How Does Short Term Disability Affect Vacation Time

Vacation pay does not impact an employees eligibility for SDI benefits. With this process, an employee could receive up to 100 percent of his or her normal gross weekly wages for the benefit period. Employers must notify the EDD by telephone or mail if they choose to offer this option to employees.

Sick Leave And Short Term Disability

Benefits-eligible employees of the institution may be paid for intermittent or longer-term absences from work which are a result of illness or personal injury, childbirth, or complications of pregnancy. The institution has two types of paid leavesick leave and short-term disability. All extended illnesses beyond 2 weeks will run concurrent with family medical leave . However, the institution reserves the right to qualify illnesses of shorter than 2-week duration under FMLA. Leave is prorated based off of annual work schedule. Annual work schedule is defined by those total annual hours worked as part of a 9-, 10-, or 12- month appointment.

Part-time employees are ineligible for sick leave and short-term disability benefits.

Entitlement to any employer sponsored benefits for all employees coincides with the ability to receive compensation through accrued sick leave and short-term disability as well as applicable COBRA or FMLA law.

Application And Approval Process

An employee who is out of work due to a Disability should file a disability claim by entering an application for leave in the Universitys Workday on-line system:

  • Go to Workday “Time Off and Leave” application,
  • Enter the “First Day of Leave” and the “Estimated Last Day of Leave,” and

The employee will then be directed to download the appropriate forms from the Requesting a Leave of Absence webpage. Please note that the employee’s leave request is not complete until the employee provides the FMLA Administrator with the required information, including an updated Physician Certification Form.

The employee must have the employees physician complete a Physician Certification Form and submit the form to the FMLA Administrator within 20 calendar days of the leave request. A delay in the return of the completed Physician Certification Form may cause a delay in the payment of STD benefits.

On the basis of information received, the FMLA Administrator will determine in a timely manner whether the employees health condition constitutes a Disability that may entitle the employee to STD benefits . If such condition exists and all requirements are met, the FMLA Administrator will provide the effective date of the disability and pay any retroactive short-term disability benefits that are due. FML will run concurrently with any STD benefits to which the employee is determined to be entitled but since FML is unpaid, will not result in any additional benefits.

Paid Family Leave Claims

PFL does not have a benefit waiting period, so wage integration can start on the first day of the PFL claim unless the employer requires two weeks of vacation pay to be used first.

New mothers after a pregnancy-related disability If youre using SDI Online:

  • Under Section 5 â Employer Information, select Yes to the question, Will you continue to receive wages from your employer during the period you are claiming Paid Family Leave benefits?
  • Select the type of pay from the dropdown menu.
  • Provide the beginning and ending pay dates.
  • If youre using a paper Claim for Paid Family Leave Benefits â New Mother form:

  • Answer Yes for question 6, Will your employer continue to pay you wages during your family leave?
  • New father, adoptive or foster parent, or new mother who did not have a pregnancy-related disability claim If youre using SDI Online:

  • Under Section 7 â Additional Questions, for the statement If you will receive any type of pay from your employer during your family leave, indicate type of pay, use the check boxes and dropdown menu to provide the answer.
  • If youre using a paper Claim for Paid Family Leave Benefits form:

  • For question A22, check the box for the type of pay you will receive.
  • Use the field labeled Other and write one of the following on your form:
    • Less Paid Family Leave
    • Coordinated Benefits
    • Regular Pay minus PFL

    Once long-term disability benefits have been approved, an employee can continue to receive benefits for the length of the policy term or until they return to work. Most long-term disability plans provide coverage for 36 months, although some plans can provide coverage for up to 10 years or even for the life of the policyholder.
