Will I Still Get Backpay
The amount of backpay you get is based on your onset date . They often choose the date you last worked, so if you are working the whole time you applied, its impossible to guess what day they might choose! You may get more or less backpay depending on the date.
If you go back to work while applying and then stop again, there is a possibility Social Security will change your onset date to the last day of this new work attempt.
If your onset date changes, this means you may get less backpay, but your future checks will not change. In some cases, working for just a few weeks could mean getting significantly less backpay.
WILL MY FUTURE DISABILITY CHECKS CHANGE?
For SSDI, its difficult to answer this question. Your disability check can go up, because when you work you may be paying Social Security taxes, which will cause your disability check to raise. Its all plan- or policy-specific, says Chicago-based attorney Michael Bartolic, whose firm focuses on employee benefits and deferred compensation. As a general observation, its any sort of injury or illness that renders one unable to do their job.

But thats not the only factor at play heretheres also an emotional and relational element involved when you return to the office after an extended amount of time off.

If you can plan how you can live during the time your application is pending, you might be approved on the record. Extended Period Of Eligibility
So how does SGA affect a personâs eligibility to continue receiving his or her SSDI check? After the individual has accumulated 9 months of a TWP, he or she then has a 36- month period referred to as an âextended period of eligibilityâ . During the EPE, Social Security looks at whether earnings in any given month exceed the applicable SGA amount, after taking into account any gross wage reductions for IRWE or work subsidies. If adjusted net earnings exceed the applicable SGA amount, Social Security will make a determination of cessation of disability. The SSDI benefit amount will be terminated after the third month from the cessation of disability month. If wages drop below the SGA amount in any given month during the 36-month EPE, the SSDI benefit amount will be reinstated.
The importance of the EPE is that an individual can again receive the SSDI benefit amount in any month during the 36-month period when countable earnings fall below the SGA amount.

Lets return to our example of missing out on work for major back surgery. Your doctor determined that youd need six months to fully recover, and your short-term disability plan approved you for that amount of time.
However, you had some pretty significant complications with your surgery and your recovery. As the end of those six months draw near, its evident that you arent physically capable of sitting at a desk for eight hours each daythis is a problem that will plague you for a lot longer, perhaps even permanently. Now what? Are you just out of luck?
If you have long-term disability benefits, it should be straightforward enough to transition into those benefits if you meet the new definition of disability for your long-term plan. The definition for disability under a long-term plan is typically subtly different than the definition for short-term disability.
Some insurers require new paperwork from the claimant and new medical records before they will begin paying a long-term disability benefit, says McDonald.

Benefits For A Disabled Child
A child under age 18 may be disabled, but we don’t need to consider the child’s disability when deciding if he or she qualifies for benefits as a dependent. The child’s benefits normally stop at age 18 unless he or she is a full-time student in an elementary or high school or is disabled.
Children who were receiving benefits as a minor child on a parents Social Security record may be eligible to continue receiving benefits on that parents record upon reaching age 18 if they are disabled.
Will My Employer Know If I File For Disability
If you are currently working and planning on applying for disability, you probably have a simple question. Will your employer know that you have applied for disability? The short answer to this question is maybe.
The disability examiner who analyzes your case will review your past and current work and see how it aligns with your disability. And in the course of their investigation, the examiner may contact previous and current employers.
This may result in them contacting your employer and your employer discussing it with you. To mitigate any awkwardness, it may be worth mentioning to your employer that you have applied , and it may be worth emphasizing that it could be years before you are approved or disapproved.
