Employers may provide New York State Disability and Paid Family Leave benefits to their eligible employees under a Board approved Plan. All Plans must be accepted by the Board and will need to adhere to the statutory requirements of the New York State Disability and Paid Family Leave Law . Once a Plan has been accepted by the Board, the employer must provide administration of these benefits from a licensed NYS insurance carrier, or by obtaining the Boards approval to administer benefits as a Self-Insured employer.

New York Disability Benefit Law And Paid Family Leave

The New York state program provides short-term disability benefits through the Disability Benefit Law and Paid Family Leave wage replacement benefits to eligible employees who need time off from work for qualifying reasons. Employees may be eligible for DBL if they are unable to work due to a non-work-related injury or illness, during pregnancy and/or childbirth. Employees may be eligible for PFL to bond with a new child, care for a sick family member, which could include organ donation, and address a qualifying military exigency.

Coverage Options: MetLife provides fully insured and self-insured coverage options. In most cases, NY PFL is a rider on the fully insured NY DBL policies.

Job Protection: NY PFL is job protected and NY DBL is not job protected. However, job protection may be provided through other laws such as the federal Family and Medical Leave Act .


A total of 26 weeks is available under NY DBL and NY PFL combined in a 52-week lookback period.

Each business that is a legal entity has its own, unique Federal Employer Identification Number assigned to it. The FEIN is the Board’s primary identification for that business.

Employers must notify their insurance carrier of FEIN when

  • Obtaining or modifying disability and Paid Family Leave benefits coverage.
  • Changing their legal entity type.
  • Adding new legal entities to their business operations.

When an employer obtains an insurance policy, it is the insurer’s responsibility to electronically notify the Board of that coverage using the employer’s FEIN.

If the FEIN on your notice is the correct legal FEIN , contact your insurance carrier and request they submit the correct FEIN to the Board.

What States Require Short Term Disability Insurance

Some states require employers to provide partial wage replacement insurance coverage to their eligible employees for non-work related sickness or injury.

Currently, if your employees are located in any of the following states, you are required to purchase disability insurance:

    State Taxes On Disability Benefits

    Most states do not tax Social Security benefits, including those for disability. As of 2020, however, a total of 13 states tax benefits to some degree. Those states are Colorado, Connecticut, Kansas, Minnesota, Missouri, Montana, Nebraska, New Mexico, North Dakota, Rhode Island, Utah, Vermont, and West Virginia. Most of these states set similar income criteria to the ones used by the IRS to determine how much, if any, of your disability benefits are taxable.

    How Does Short Term Disability Work In New York

    Benefits are paid weekly to the employee and are equal to 50% of the average weekly wage of the employee over the last 4 weeks prior to the disability. The maximum weekly benefit is $170.

    Benefits become payable on the 7th consecutive day of a disability and continue for up to 26 weeks. The maximum benefit period is 26 weeks disability or during any consecutive period of 52 weeks. Benefits are partially taxable to the recipient depending on the percentage of contribution by the employee.

    Filing A Claim For Nys Disability Benefits

    If you are currently employed, or if you have been unemployed for less than four weeks from the date the disability began, file the claim with your employer or his/her insurance carrier, using form DB-450. This form is available on-line or you may obtain a copy for the nearest Workers Compensation Board district office. Keep a copy of this form to submit again if your claim is not paid properly.

    If you have been unemployed for more than four weeks from the date the disability began, file the claim with the Disability Benefits Bureau, using form DB-300.

    You must file your claim within 30 days after you become disabled. If you file late, you will not be paid for any disability period more than two weeks before the claim is filed.

    You must be under the care of a physician, chiropractor, podiatrist, psychologist, dentist or certified nurse midwife in order to qualify for benefits. Your health care provider must complete and sign the Health Care Providers Statement as proof of your disability.

    Before filing your workers comp claim, be sure that you have completed and signed the Claimants Statement and your health care provider or practitioner has completed and signed his/her portion. Submit this information promptly to avoid delaying your claim.

    Pregnancy And Maternity Leave

    If you are disabled due to pregnancy, you may be entitled to up to 26 weeks of disability benefits.

    You will need to submit a medical report completed by a doctor or certified nurse midwife stating your disability is due to pregnancy.

    • The medical report should describe specific pregnancy complications if your disability
    • started more than four weeks before the anticipated birth date OR
    • lasts more than four to six weeks after the actual birth date.

    New York State Disability

    Disability benefits are temporary cash benefits paid to an eligible wage earner, when he/she is disabled by an OFF THE JOB injury or illness. The Disability Benefits Law provides weekly cash benefits to replace, in part, wages lost due to injuries or illnesses that do not arise out of or in the course of employment. Although New York State Disability is generally for off-the job injury or illness, there are exceptions:

    If you have received a written rejection of your Workers Compensation claim , and you have been disabled from working for more than five days, you may apply for New York State Disability Benefits and you may continue to pursue your Workers Compensation claim at the same time.     When Workers Comp Benefits Could Be Taxed

    When you receive both Social Security Disability and Workers Compensation benefits then Social Security benefits are taxable to a certain extent. If you receive both Social Security disability benefits and Workers Compensation, then Social Security may be reduced by a certain amount due to your receipt of Workers Compensation benefits .

    If this is your situation, then the IRS will tax you on the FULL amount of the Social Security benefit, even if it has been reduced by Workers Compensation.The Internal Revenue Service has confirmed this in its widely used Publication 17 that helps explain a multitude of issues, including the Workers Compensation Benefit Non-Taxability:

The exemption also applies to your survivors.
