Social Security Disability Benefits

Social Security administers two disability programs: Social Security Disability Insurance and Supplemental Security Income . SSDI is available to those who have worked a certain numbers of years while paying Social Security taxes. SSI is available only to those with low income and resources.

Medical eligibility for SSDI and SSI is the same, and it depends on whether you can do a substantial amount of work, or what Social Security calls “substantial gainful activity” . Social Security usually counts earning $1,220 per month or more as being able to do SGA.

After your local Social Security office reviews your application for SSDI or SSI financial eligibility, Social Security sends it to Utah’s Division of Disability Determination Services . DDS is a state agency that makes disability determinations for Social Security. DDS is administered by the Utah State Office of Rehabilitation.

    How To File Your Utah Workers Compensation Claim

    According to the Utah Labor Commission, follow the steps below to file your workers comp claim:

  • Notify your supervisor about your workplace illness or injury immediately. We strongly recommend you do this in writing. If you dont report it within 180 days, then you may forfeit your right to benefits.
  • Tell the doctor your injury or illness is work-related. In most cases, youll seek medical treatment from your employers designated doctor. Your doctor then submits Physicians Initial Report of Injury Form 123 to your employers insurer and the Utah Labor Commission.
  • Your employer must file Employers First Report of Injury or Illness Form 122 within 7 days. After notifying their insurer, your employer files Form 122 with the Utah Labor Commission.
  • Your employers insurer then has 14 days to notify the Industrial Accidents Division. State law requires your employers insurer to give you a copy of this report.
  • The employers insurer has 21 days to approve or deny your claim. That insurer can also request a 45-day extension if they need more info to make a decision.
  • If the insurer denies your claim, contact your claims adjuster first to try and resolve it. If that doesnt work, request an ALJ appeals hearing from the Labor Commissions Adjudication Division.
  • To appeal an unfavorable ruling at your hearing, file a Motion for Review within 30 days. Then, the Utah Labor Commissioner or Commission Appeals Board reviews your case to reverse or affirm the judges ruling.
  • Appealing A Denied Claim

    If your disability application is rejected, you have the right to appeal the decision within 60 days. You can submit your appeal online.

    During the appeals process, you can upload additional supporting documents, such as medical reports or written statements. This allows you to address the reasons your application was initially denied, and offer any new, relevant changes to your medical history that could strengthen your appeal.

    Every year, the Bureau of Labor Statistics publishes a workers compensation statistical report covering most U.S. states and territories. Youll see total workers compensation claims, which employees missed work or changed jobs, as well as filings by job industry.     How To Qualify For Ssdi In Utah

    Physical Impairments and Disability Benefits

    Because SSDI is a federal program, an applicant must meet general guidelines to be eligible for the program. However, the amount you receive each month may be different in Utah than in other states to account for variances in the cost of living.

    Generally, a claimant must fall within earned income guidelines, have an eligible disability, and be under the age of 65. Applicants must also have enough work credits at least 40 to claim SSDI benefits. You receive up to four work credits per year that you work or have self-employment income, and your credits are based on how much you earn. Once you’ve earned at least $5,880 in a year, you’ve earned your four credits.

    A disability must also be a total disability, meaning that you won’t qualify if your disability is presumed to be partial or short-term. The SSA considers your medical condition, work history, and ability to complete the work you once did when determining your eligibility.
