Can you work if you are receiving Social Security Disability benefits?

You can claim spousal benefits as early as age 62, but you wont receive as much as if you wait until your own full retirement age. How Are Disability Insurance And Supplemental Security Benefits Funded

Disability Insurance is funded by payroll tax contributions from workers and their employers. Workers currently pay a tax of 0.9 percent of their wages up to $113,700, and their employers pay an equal amount. These tax contributions go into the Disability Insurance trust fund. Funding for Supplemental Security comes from the federal income tax and other federal revenues.

The Social Security Administration administers both of these programs. State agencies, usually called disability determination services, make the initial determination of whether applicants meet the disability standard. These state agencies are federally funded and follow federal guidelines.

What Is The Disability Standard For Disability Insurance And Supplemental Security

Disability Insurance and Supplemental Security are reserved for workers with the most severe disabilities and conditions, and both use the same strict disability standard: inability to engage in substantial gainful activitydefined as being able to earn $1,040 a month in 2013due to one or more severe physical or mental impairments that are expected to last at least a year or could result in death. A workers impairment or combination of impairments must be so severe that the applicant is not only unable to do his or her previous work but also unableconsidering his or her age, education, and work experienceto engage in any other kind of substantial gainful work that exists in significant numbers in the national economy.

Medical evidence is the cornerstone for the determination of disability in both programs. To qualify, there must be medical evidence from a doctor, specialist, or certain other licensed or certified medical sources that documents a severe impairment. Evidence from other health care providerssuch as nurse practitioners or clinical social workersis not sufficient to document a severe medical impairment. And statements from the applicants themselves, their families, co-workers, friends, or neighbors are not treated as medical evidence.

Does Disability Pay More Than Social Security

Applying for Disability benefits has a reputation as a time-consuming and inefficient process. Consequently, many people entering their 60s who could potentially qualify for disability benefits may opt to just elect for Social Security a couple of years early to avoid the hassle. However, this strategy has the potential to cost you a lot of money in the long run. Whether opting for disability would be the more remunerative strategy will depend on your age. A financial advisor could help you weigh the best options for your retirement goals.

Canada Pension Plan Disability Benefits

The Canada Pension Plan provides monthly payments to people who contribute to the plan during their working years.

You may be eligible for CPP disability benefits if:

  • you contributed to the CPP for a certain number of years
  • you’re under 65 years old
  • you have a severe and prolonged mental or physical disability
  • your disability prevents you from working on a regular basis

The benefits include payments to children of a person with a disability.

Apply as early as possible if you think you’re eligible for CPP disability benefits. Quebec residents may be eligible for a similar program called the Quebec Pension Plan . It may take several months to process your application.

If you applied for CPP or QPP disability benefits and were told that you’re not eligible, you can ask to have your application reviewed or considered again.

Once you reach age 65, your CPP disability benefit will automatically change to regular CPP payments. Your regular CPP payments may be less than the CPP disability payments you got before.

If so, consider:

You Have Been Convicted Of A Crime

Certain conditions related to conviction of a crime or imprisonment will prevent you from receiving Social Security disability insurance benefits. They are as follows.

  • You are in prison after being convicted of a felony, unless you are in a court-approved rehabilitation program that is likely to result in your getting a job when you get released, and your release is expected to occur within a reasonable amount of time.
  • You were injured while committing a felony and were convicted of the crime. The impairmentor the worsening of an existing impairmentthat you suffered during the commission of a felony cannot be used as a basis for applying for disability benefits.
  • You were injured while in prison. The impairmentor the worsening of an existing impairmentthat you suffered while you were in prison cannot be used to obtain benefits. But you can generally receive benefits after being released from prison.

However, it’s worthwhile to apply for SSDI benefits even if one of the above situations apply to you, because even if you can’t get cash benefits, you may be granted a period of benefit-free disability that will “freeze” your earnings record, keeping your eventual disability, retirement, or dependents benefits from decreasing.

Note these situations do not prevent you from receiving SSI disability benefits, although being incarcerated does keep you from collecting SSI benefits.

If you file your claim after the 49th day, include a letter explaining why you couldnt submit your claim on time.

How Is The Sdi Benefit Calculated

Can I Collect Social Security Retirement and Social Security Disability?

The SDI program generally pays 60-70% of the average wages you earned before the start of your disability. To calculate your average income, SDI looks at a yearlong period that starts around 17 months before your disability, and ends around 5 months before your disability. Those 12 months are called your base period. SDI divides your base period into 4 quarters and uses the quarter when you had the highest wages to figure your average income, and your benefit amount.
