If You Get A Negative Disability Decision
- When you fill out your Marketplace application, answer âyesâ when asked if you have a disability. Weâll forward your application to your state Medicaid agency. If you qualify, theyâll help you enroll.
- If you donât qualify for Medicaid, you may qualify for savings on a Marketplace health plan.
Get A Medical Certification
Your physician/practitioner must certify to your disability by completing and submitting the medical certification using either SDI Online or the DE 2501 Part B Physician/Practitioners Certificate of the paper claim form. It is your responsibility to have your physician/practitioner complete and sign the form and submit it to us within 49 days from the date your disability begins or you may lose benefits.
Have your physician/practitioner complete the medical certification portion of your disability claim.
- A nurse practitioner may certify to a disability within his/her scope of practice however, he/she must perform a physical examination and collaborate with a physician or surgeon.
- A licensed midwife, nurse-midwife, or nurse practitioner may complete the medical certification for disabilities related to normal pregnancy or childbirth.
- If you are under the care of an accredited religious practitioner, you may download and print the Claim for Disability Insurance Benefits-Religious Practitioners Certificate .

Most of the time it wont, but its possible depending on your case.
There are two things that can stop your disability benefits.
First, if Social Security found out that you have medically improved and that youre no longer considered disabled.
Second, if they found out that youve engaged in a substantial gainful activity . This means that you can already earn what you used to earn before your disability. Or youre earning more than the SGA threshold. The amount changes every year but for 2021, its $1,310 per month.
In general, if youre still disabled and unable to work, you wont have to worry about losing your benefits.

If you continue to receive an E311, E313, or E318 error message, you may request assistance through Ask EDD:

Most Social Security Disability Reviews Are Short
The great majority of Disability Reviews begin by the SSD claimant receiving a notice in the mail instructing them to fill out the Short Form questionnaire called a Disability Update Report. The information the SSA wants you to provide includes how often you visit your doctor, whether you are following the recommended treatment, whether your health has improved, and whether you and your doctor have discussed your returning to work.
Based on the responses you provide as well as the nature of your impairments, the Social Security Disability program will notify you of its decision to conduct a medical review or to waive it until the next period of review.

Checking Your Claim Status After You Request A Hearing
After reconsideration, the next level of appeal is a hearing before an administrative law judge . Once you submit a request for an ALJ hearing, the claim no longer stays with the DDS. The case will move on to the hearing office, called the Office of Hearings Operations , where it awaits a hearing date.
After you file a request for a disability hearing, you may not hear anything for many months. Many Social Security disability hearing offices are so backlogged with cases that it takes a year to get a hearing. But it’s still worth it to check on the status of your case at least once after you request a hearing, to make sure the hearing office hasn’t lost your appeal paperwork.
If your case is at the hearing level, contacting the Social Security office where you filed your claim to check the status of your hearing request won’t help. The hearing office functions independently from Social Security. Social Security office personnel will typically have little information about the status of a hearing request.

Prior Or Pending Claims
It is common for individuals to have filed one or more applications for SSI or SSDI before the SOAR worker becomes involved. Sometimes individuals do not know or remember if they have recently applied and have an application pending at the initial application or appeals level.
Applicants can request information from SSA in-person or over the phone about prior or pending applications. The SOAR practitioner can also make the inquiry using the SSA Consent for Release of Information.
Apply For Benefits Online
You should apply for disability benefits as soon as you develop a disability. Follow these easy steps to apply online for disability:
- To start your application, go to our Apply for Benefits page, and read and agree to the Terms of Service. Click Next.
- On that page, review the Getting Ready section to make sure you have the information you need to apply.
- Select Start A New Application.
- We will ask a few questions about who is filling out the application.
- You will then sign in to your personal mySocial Security account, or you will be prompted to create one.
- Complete the application.
You can use the online application to apply for disability benefits if you:
- Are age 18 or older.
- Are not currently receiving benefits on your own Social Security record.
- Are unable to work because of a medical condition that is expected to last at least 12 months or result in death.
- Have not been denied for disability in the last 60 days.

You may be able to file online for SSI at the same time that you file for SSDI benefits. Once you complete the online process described above, a Social Security representative will contact you if we need additional information.

What Is The Difference Between Part A And Part B And What Do They Cover
Medicare Part A is known as hospital coverage. Part A covers inpatient hospital care, inpatient care in a skilled nursing facility following a hospital stay, some home health care, and hospice care. If you paid FICA taxes while you were working, Part A coverage is free except for coinsurance and deductibles.
Medicare Part B covers outpatient services. These services include doctors’ services, diagnostic tests, durable medical equipment, ambulance service and many other health services and supplies not covered by Medicare Part A. In order to sign up for Part B coverage, you must be 65 years of age and pay a monthly premium. You may sign up for Part B by contacting your local Social Security office.
Please note that Medicare does not cover custodial care in or out of a nursing home.
I Have A Receipt Number For Submitting My Disability Insurance Or Paid Family Leave Claim What Do I Do Now
The receipt number means you have successfully submitted your Disability Insurance or Paid Family Leave claim form online. Provide your receipt number to your physician/practitioner for DI claims or the care recipients treating physician/practitioner for PFL care claims for them to submit the medical certification. You should make a note of your receipt number for future reference.
PFL bonding claims and military assist claims do not require a medical certification so you do not need to provide the receipt number to your physician/practitioner.
Most claims are processed within 14 days of receipt of a completed claim. You can log in to your account to check the status of your DI claim at any time.

How Applications Are Processed
The local SSA office initially determines Social Security Disability Insurance eligibility based on Social Security “credits” earned by working in covered employment, and eligibility for Supplemental Security Income based on income/assets level.
The local SSA office gets information from the claimant on the nature of the disability and past medical treatment. If the claimant meets the work credit or income/asset criteria , the case file is sent to the Disability Determination Services in Boston or Worcester for development of medical and other evidence and for a medical determination of eligibility.

When Will I Receive A Benefit Payment If I Just Filed Online
Most benefits are issued within two weeks after a completed claim is received.
There is a seven-day, non-payable waiting period for Disability Insurance benefits. Benefits start on the eighth day.
The Governors Executive Order N-25-20, signed March 12, 2020, waives the one-week unpaid waiting period for COVID-related DI claims with a start date of January 24, 2020, through September 30, 2021. You can collect DI benefits for the first week you are out of work.
Note: The Governors Executive Order N-08-21, signed June 11, 2021, returns the requirement to serve the one-week unpaid waiting period for COVID-related DI claims with a start date on or after October 1, 2021. You can collect DI benefits starting on the eighth day you are out of work.
If you are eligible, the EDD processes and issues payments within a few weeks of receiving a claim.
Paid Family Leave does not have a waiting period.
