The Basics About Disability Benefits

Social Security representatives in the field offices usually obtain applications for disability benefits in person, by telephone, by mail, or . The application and related forms ask for a description of the claimants impairment , treatment sources, and other information that relates to the alleged disability.
The field office is responsible for verifying non-medical eligibility requirements, which may include age, employment, marital status, or Social Security coverage information. The field office then sends the case to a DDS for evaluation of disability.
The DDSs, which are fully funded by the Federal Government, are State agencies responsible for developing medical evidence and rendering the initial determination on whether or not a claimant is disabled or blind under the law.
Funding Opportunities For Students With Learning Disabilities
Qualified applicants with learning disabilities may be entitled to special provisions for educational loans, sponsorship and grants from funding agencies such as Student Financial Assistance , Employability Assistance for Persons with Disabilities , and other funding sponsors. Documented assessment and diagnosis are required to access these provisions. The Canada Student Grant for Services and Equipment for Persons with Permanent Disabilities and the Saskatchewan Student Grant for Services and Equipment for Persons with Permanent Disabilities and Canada Student Grant for Persons with Permanent Disabilities, for those who areeligible for a student loan will cover special learning support costs . See current Student Loans Handbook. EAPD may cover these costs for students with learning disabilities who have unmet needs which have not been covered by the Grants or who are ineligible for student loans. To be eligible for the Canada Student Grant for Persons with Permanent Disabilities, an applicant must identify a disability and provide documentation prior to negotiating a Student Loan .

Toilet Rooms And Bathing Rooms
EXCEPTIONS: 1. In alterations where it is technically infeasible to comply with 603, altering existing toilet or bathing rooms shall not be required where a single unisex toilet room or bathing room complying with 213.2.1 is provided and located in the same area and on the same floor as existing inaccessible toilet or bathing rooms.
2. Where exceptions for alterations to qualified historic buildings or facilities are permitted by 202.5, no fewer than one toilet room for each sex complying with 603 or one unisex toilet room complying with 213.2.1 shall be provided.
3. Where multiple single user portable toilet or bathing units are clustered at a single location, no more than 5 percent of the toilet units and bathing units at each cluster shall be required to comply with 603. Portable toilet units and bathing units complying with 603 shall be identified by the International Symbol of Accessibility complying with 703.7.2.1.
4. Where multiple single user toilet rooms are clustered at a single location, no more than 50 percent of the single user toilet rooms for each use at each cluster shall be required to comply with 603.
213.2.1 Unisex Toilet and Unisex Bathing Rooms
C Hiring And Onboarding
Under the ADA, prior to making a conditional job offer to an applicant, disability-related inquiries and medical exams are generally prohibited. They are permitted between the time of the offer and when the applicant begins work, provided they are required for everyone in the same job category.
C.1. If an employer is hiring, may it screen applicants for symptoms of COVID-19?
Yes. An employer may screen job applicants for symptoms of COVID-19 after making a conditional job offer, as long as it does so for all entering employees in the same type of job. This ADA rule applies whether or not the applicant has a disability. For information on the ADA rules governing such inquiries and examination, see Section A
C.2. May an employer take an applicant’s temperature as part of a post-offer, pre-employment medical exam?
Yes. Any medical exams are permitted after an employer has made a conditional offer of employment. However, employers should be aware that some people with COVID-19 do not have a fever.
C.3. May an employer delay the start date of an applicant who has COVID-19 or symptoms associated with it?
Yes. According to current CDC guidance, an individual who has COVID-19 or symptoms associated with it should not be in the workplace.
C.4. May an employer withdraw a job offer when it needs the applicant to start immediately but the individual has COVID-19 or symptoms of it?
Guest Rooms With Communication Features
Guest rooms required to provide communication features shall comply with 806.3.
Advisory 806.3 Guest Rooms with Communication Features. In guest rooms required to have accessible communication features, consider ensuring compatibility with adaptive equipment used by people with hearing impairments. To ensure communication within the facility, as well as on commercial lines, provide telephone interface jacks that are compatible with both digital and analog signal use. If an audio headphone jack is provided on a speaker phone, a cutoff switch can be included in the jack so that insertion of the jack cuts off the speaker. If a telephone-like handset is used, the external speakers can be turned off when the handset is removed from the cradle. For headset or external amplification system compatibility, a standard subminiature jack installed in the telephone will provide the most flexibility.
Where emergency warning systems are provided, alarms complying with 702 shall be provided.
806.3.2 Notification Devices
Visible notification devices shall be provided to alert room occupants of incoming telephone calls and a door knock or bell. Notification devices shall not be connected to visible alarm signal appliances. Telephones shall have volume controls compatible with the telephone system and shall comply with 704.3. Telephones shall be served by an electrical outlet complying with 309 located within 48 inches of the telephone to facilitate the use of a TTY.
Relationship To Accessible Routes
Parking spaces and access aisles shall be designed so that cars and vans, when parked, cannot obstruct the required clear width of adjacent accessible routes.
Advisory 502.7 Relationship to Accessible Routes. Wheel stops are an effective way to prevent vehicle overhangs from reducing the clear width of accessible routes.

Developing A Support Plan
The person, or SDM if any, the persons primary caregiver, DSO, DS agencies, if applicable, the LTC home in which the individual will be residing and the placement co-ordinator should all be involved in the identification of support and transition needs. The placement co-ordinator is responsible for a successful transition into a LTC home. Furthermore, the LTC home in which the individual will be residing will co- ordinate the development of a support plan for the person.
- This plan will be based on information obtained through relevant health and DS assessments.
- It may also be enhanced by additional information obtained from the person or their SDM, if any, as well as the primary caregiver, family, friends, supporting DS agency, and primary health care provider .
- The plan is to be shared with the person or their SDM, if applicable, and, with the consent of the person or any SDM, it may be shared with a primary caregiver, family, friends, DSO and DS agency staff as applicable, for consideration/revision. The final version should then be distributed to the LTC home that will be involved in supporting the person going forward as well as the DS agency if developmental services and supports will be provided.
- DS agencies may provide developmental services and supports to LTC home applicants while they wait for a LTC home bed as well as to individuals already residing in a LTC home to support their transition or for a longer period of time depending on their needs.
Guest Rooms With Mobility Features
Guest rooms required to provide mobility features shall comply with 806.2.
Advisory 806.2 Guest Rooms. The requirements in Section 806.2 do not include requirements that are common to all accessible spaces. For example, closets in guest rooms must comply with the applicable provisions for storage specified in scoping.
806.2.1 Living and Dining Areas
Living and dining areas shall be accessible.
806.2.2 Exterior Spaces
Exterior spaces, including patios, terraces and balconies, that serve the guest room shall be accessible.
806.2.3 Sleeping Areas
At least one sleeping area shall provide a clear floor space complying with 305 on both sides of a bed. The clear floor space shall be positioned for parallel approach to the side of the bed.
EXCEPTION: Where a single clear floor space complying with 305 positioned for parallel approach is provided between two beds, a clear floor or ground space shall not be required on both sides of a bed.
806.2.4 Toilet and Bathing Facilities
806.2.4.1 Vanity Counter Top Space
If vanity counter top space is provided in non-accessible guest toilet or bathing rooms, comparable vanity counter top space, in terms of size and proximity to the lavatory, shall also be provided in accessible guest toilet or bathing rooms.
Advisory 806.2.4.1 Vanity Counter Top Space. This provision is intended to ensure that accessible guest rooms are provided with comparable vanity counter top space.
806.2.5 Kitchens and Kitchenettes

General Holding Cells And General Housing Cells
General holding cells and general housing cells shall be provided in accordance with 232.2.
EXCEPTION: Alterations to cells shall not be required to comply except to the extent determined by the Attorney General.
Advisory 232.2 General Holding Cells and General Housing Cells. accessible cells or rooms should be dispersed among different levels of security, housing categories, and holding classifications to facilitate access. Many detention and correctional facilities are designed so that certain areas can be adapted to serve as different types of housing according to need. For example, a shift area serving as a medium-security housing unit might be redesignated for a period of time as a high-security housing unit to meet capacity needs. Placement of accessible cells or rooms in shift areas may allow additional flexibility in meeting requirements for dispersion of accessible cells or rooms.
Advisory 232.2 General Holding Cells and General Housing Cells Exception. Although these requirements do not specify that cells be accessible as a consequence of an alteration, title II of the ADA requires that each service, program, or activity conducted by a public entity, when viewed in its entirety, be readily accessible to and usable by individuals with disabilities. This requirement must be met unless doing so would fundamentally alter the nature of a service, program, or activity or would result in undue financial and administrative burdens.
232.2.1 Cells with Mobility Features
Bus Boarding And Alighting Areas
Bus boarding and alighting areas shall comply with 810.2.
Advisory 810.2 Bus Boarding and Alighting Areas. At bus stops where a shelter is provided, the bus stop pad can be located either within or outside of the shelter.
Bus stop boarding and alighting areas shall have a firm, stable surface.
Bus stop boarding and alighting areas shall provide a clear length of 96 inches minimum, measured perpendicular to the curb or vehicle roadway edge, and a clear width of 60 inches minimum, measured parallel to the vehicle roadway.
Note to Reader: The Department of Transportations ADA standards indicate that compliance is required to the extent construction specifications are within a public entitys control:
810.2.2 Dimensions. Bus boarding and alighting areas shall provide a clear length of 96 inches , measured perpendicular to the curb or vehicle roadway edge, and a clear width of 60 inches , measured parallel to the vehicle roadway. Public entities shall ensure that the construction of bus boarding and alighting areas comply with 810.2.2, to the extent the construction specifications are within their control.
Bus stop boarding and alighting areas shall be connected to streets, sidewalks, or pedestrian paths by an accessible route complying with 402.
Dining Surfaces And Work Surfaces For Childrens Use
Accessible dining surfaces and work surfaces for childrens use shall comply with 902.4.
EXCEPTION: Dining surfaces and work surfaces that are used primarily by children 5 years and younger shall not be required to comply with 902.4 where a clear floor or ground space complying with 305 positioned for a parallel approach is provided.
902.4.1 Clear Floor or Ground Space
A clear floor space complying with 305 positioned for forward approach shall be provided. Knee and toe clearance complying with 306 shall be provided, except that knee clearance 24 inches minimum above the finish floor or ground shall be permitted.
The tops of tables and counters shall be 26 inches minimum and 30 inches maximum above the finish floor or ground.
Shower Spray Unit And Water
A shower spray unit with a hose 59 inches long minimum that can be used both as a fixed-position shower head and as a hand-held shower shall be provided. The shower spray unit shall have an on/off control with a non-positive shut-off. If an adjustable-height shower head on a vertical bar is used, the bar shall be installed so as not to obstruct the use of grab bars. Bathtub shower spray units shall deliver water that is 120°F maximum.
Advisory 607.6 Shower Spray Unit and Water. Ensure that hand-held shower spray units are capable of delivering water pressure substantially equivalent to fixed shower heads.

505.10.1 Top and Bottom Extension at Ramps
Ramp handrails shall extend horizontally above the landing for 12 inches minimum beyond the top and bottom of ramp runs. Extensions shall return to a wall, guard, or the landing surface, or shall be continuous to the handrail of an adjacent ramp run.

505.10.2 Top Extension at Stairs
At the top of a stair flight, handrails shall extend horizontally above the landing for 12 inches minimum beginning directly above the first riser nosing. Extensions shall return to a wall, guard, or the landing surface, or shall be continuous to the handrail of an adjacent stair flight.

505.10.3 Bottom Extension at Stairs
At the bottom of a stair flight, handrails shall extend at the slope of the stair flight for a horizontal distance at least equal to one tread depth beyond the last riser nosing. Qualifications of Diagnostician
Professionals diagnosing learning disabilities must have comprehensive training in differential diagnosis and direct experience with adolescents and adults with learning disabilities.
The following professionals are considered qualified:
- Certified/licensed psychologists
- Learning disability specialists
- Educational therapists.
Diagnostic reports should include the names, titles, professional credentials, addresses, and phone numbers of the evaluators as well as the date of testing.
