NYS OTDA Emergency Rental Assistance Program

NYDocSubmit may save you a trip to the local social services district to provide documentation. Now, an individual can take a picture of a document, enter identifying information and submit the document to their social services district, anytime. Its convenient, quick and easy. After you submit your application to the Federal Social Security Administration your claim will be sent to the NYS Division of Disability Determinations and a Disability Analyst will review your case and determine whether or not you meet the federal medical guidelines to qualify for Social Security Disability. IMPORTANT NOTE: The functionality to continue a saved application is available for applicants who have created an account. Applicants are encouraged to needed before starting an application including income of household members and rental amounts. Applicants who previously started, but did not complete, sign and submit an application, must create an account in order to resume an incomplete or unsubmitted application.

Applicants who have completed, signed, and submitted an application can upload required documentation at any time.

The New York State Emergency Rental Assistance Program will provide significant economic relief to help low and moderate-income households at risk of experiencing homelessness or housing instability by providing rental arrears, temporary rental assistance and utility arrears assistance.

Certain communities that received funding for emergency rental assistance directly from the federal government opted to administer their own programs. Residents, with income up to 80 percent of the Area Median Income , of the towns of Hempstead, Islip and Oyster Bay are not eligible for assistance from the state-administered program and should apply with their local programs for emergency rental assistance. Residents of these communities may be eligible for assistance from the state-administered Emergency Rental Assistance Program if their locally-administered program spends all of its money.

How Do I Apply For Temporary Assistance

To find out if you are eligible to receive Temporary Assistance, including help with an emergency, you need to file an application with your county Department of Social Services or, if you live in one of the five boroughs of New York City, with your local Job Center.

You can find the location of your online, or by calling the toll-free OTDA Hotline at 1-800-342-3009.

You can apply online at myBenefits.ny.gov or fill out the and file it at your local department of Social Services. You should identify any emergency needs you may have at this time. If you have an emergency, you will be interviewed and told in writing about the decision on your emergency the same day you apply.

For Temporary Assistance, your interview should be within seven working days of your filing an application. You should be told within 30 days of the date you filed your application if your application for Family Assistance is approved or denied, or be told within 45 days of the date you filed your application for Safety Net Assistance if your application is approved or denied.

Renters will need to provide:

  • Copy of gas or electric utility bill, if applying for help paying for utility arrears at the same rental unit.
  • Applicants will be asked to attest that on or after March 13, 2020, a member of the household received unemployment benefits or experienced a reduction in household income, incurred significant costs or experienced other financial hardship, directly or indirectly, due to the COVID-19 pandemic. The applicant will need to sign the application form and associated certifications agreeing that the information provided in the application is accurate.

    What Proof Will I Need To Provide To My Worker

    When you are applying for, or getting, help for yourself or for someone else, you will be asked to provide proof of certain things, such as those listed below. Your worker will tell you which of these things you must provide. If you bring proof with you when you first come in to apply for assistance, you may be able to get help sooner.

    If you drop documentation off at your local department of social services, you should ask for a receipt to prove what documentation you left. The receipt should have your name, the specific documentation that you dropped off, the time, date, county name and the name of the social services worker who provided the receipt.

    If you cannot get the proof you need, ask your worker to help you. If the local department of social services already has proof of the things that do not change, such as your social security number, you do not need to provide them again.

    New York State Office Of Temporary And Disability Assistance

    The Office of Temporary and Disability Assistance is responsible for supervising programs, with local departments of social services, that provide assistance and support to eligible families and individuals. OTDAs functions include: Providing temporary cash assistance providing assistance in paying for food providing heating assistance overseeing New York States child support enforcement program determining certain aspects of eligibility for Social Security Disability benefits supervising homeless housing and services programs and providing assistance to certain immigrant populations.

    Specific Jurisdictions With Projected Available Funding

    Certain municipalities received ERAP funds directly from the federal government and some have not fully committed these funds. As a result, resources are likely available to fund applications received beyond June 30, 2022, in the areas listed below. Therefore, tenants in these areas are encouraged to apply.

    Areas are expected to be removed from the above list as funds are exhausted.

    IMPORTANT NOTE: Applications from subsidized housing tenants whose rent is limited to a certain percentage of income are not currently able to be paid. State law requires that these applications be paid after all other eligible applicants have been reviewed and paid. Therefore, at this time, none of the subsidized housing applications can be paid regardless of the date their application was submitted. Residents of public housing are urged to contact their public housing authority to determine if their rent can be adjusted retroactively based on a previous change in circumstances, including a reduction in income.

    NYDocSubmit should not be used to submit initial applications, recertification applications, periodic reports or documents that include sensitive information, such as:

    • Child Protective Services case information or to report suspected child abuse or maltreatment,
    • Documents that contain HIV information,
    • Domestic violence information,
    • Addresses that must remain confidential to safeguard any member of an applicants or recipients household.

    Petitioners are renters who owe rent to their landlords. Several are currently facing eviction proceedings. Now, petitioners seek an injunction barring respondent, the NYS Office of Temporary and Disability Assistance, from refusing to accept new applications for the State’s Covid-19 Emergency Rental Assistance Program , codified at 2021 N.Y. Laws Ch. 56, part BB, amended by 2021 N.Y. Laws Ch. 417, Part A. Petitioners allege that if the respondent’s ERAP portal is not reopened, “potentially hundreds of thousands of tenants will become subject to eviction and homelessness”.

    The only issue before the court is whether to grant petitioners a preliminary injunction, as the parties have agreed to adjourn the balance of the petition to March 2022.

    Certain facts are not in dispute. Respondent is currently overextended, with a budget shortfall of approximately $850 million due to provisionally approved applicants in addition to other liabilities. Thus, respondent stopped accepting applications for ERAP on November 15, 2021.

    There is a 60-month limit on the receipt of Family Assistance benefits funded under the federal TANF program, some Safety Net Assistance , or the Child Assistance Program . Additionally, payments made under Emergency Assistance to Families with Children after December 1, 1996 are included in the 60-month count. Participants in CAP are also restricted to the 60-month lifetime limit.

    Additionally, cash Temporary Assistance in New York State is limited to a cumulative period of 60 months for any adult. No cash assistance benefit is granted to a family that contains an adult who has received a combined total of 60-month benefits under FA or cash SNA.

    In accordance with Social Services Law § 36-a and 18 NYCRR § 300.11, the OTDA Office of Administrative Hearings initiated a demonstration project to ascertain the viability of conducting fair hearings to the greatest extent possible utilizing telephone, video, and other means of communication. We are holding most fair hearings telephonically. OAH will attempt to call you on the date of your scheduled hearing, between 9AM and 1PM, if your hearing was scheduled in the morning, or between 1PM and 5PM, if your hearing was scheduled in the afternoon. The Hearing Officer will call from a blocked number. Please ensure your telephones can accept a call from a blocked number. For hearings conducted by telephone, Hearing Officers will leave voice messages when possible for Appellants and their authorized representatives who fail to answer their phones.
