Adults Disabled Before Age 22

How to Apply for Social Security Disability

An adult who has a disability that began before age 22 may be eligible for benefits if a parent is deceased or starts receiving retirement or disability benefits. We consider this a “child’s” benefit because it is paid on a parent’s Social Security earnings record.

The disabled “adult child” including an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild must be unmarried, age 18 or older, have a disability that started before age 22, and meet the definition of disability for adults.

Example

It is not necessary that the disabled “adult child” ever worked. Benefits are paid based on the parent’s earnings record.

  • A disabled “adult child” must not have substantial earnings. The amount of earnings we consider “substantial” increases each year. In 2021, this means working and earning more than $1,310 a month.

What Are Social Security Disability Benefits

Social Security disability benefits come from payroll deductions required by the Federal Insurance Contributions Act to cover the cost of Social Security benefits such as retirement, as well as spousal and survivor benefits. Some of this funding goes into the Disability Insurance Trust Fund and pays for disability benefits.

According to the Social Security website, to qualify for Social Security disability benefits, you must have worked a certain length of time in jobs covered by Social Security. Generally, you need 40 credits, 20 of which were earned in the last 10 years, ending with the year when you became disabled. You must also have a medical condition that meets Social Securitys definition of disability.

Social Security Disability Insurance should not be confused with Supplemental Security Income , which pays benefits to those who have financial needs regardless of their work history. Although these two names sound similar, the qualifications to get the payments and what you might receive are very different.

The 1st Way: Getting Approved Through The Impairment List

Online Application Disability

If you have a physical or mental condition that is in the Social Security list of impairments , you can be approved for disability if your medical records satisfy the listing criteria. There are two things to remember about listing approvals.

1. Most claims do not get approved this way because the approval criteria is very specific. Often, your medical records wont provide the right information.

2. Not all conditions are in the listings. For example, carpal tunnel syndrome, which is common, is not in the listings. Nor is Lyme disease.

If you have a condition that is listed, such as depression or seizure disorder, and you meet the listing requirements, then your case ends there. But what if your case doesnt fit this criteria?

How Many People Currently Receive Social Security Disability Benefits And What Is The Value Of The Benefits They Receive

    Social Security Disability

About 8.8 million workers with disabilities currently receive Disability Insurance. The amount of Disability Insurance benefits that a disabled worker receives is based on his or her earnings before becoming disabled. As Table 1 shows, Disability Insurance benefits typically replace less than half of a disabled workers previous earnings.

As of March 2013, the average monthly benefit for a disabled worker was about $1,129, with male workers receiving $1,255 per month and female workers receiving $993 per month on average. About 1.9 million children of disabled workers and 160,000 spouses of disabled workers also receive supplemental benefits from Social Securityroughly $300 a month on average.

For most beneficiaries of Disability Insurance and Supplemental Security, disability benefits make up most or all of their income. For the vast majority of Disability Insurance beneficiariesabout 71 percenthalf or more of their income comes from Disability Insurance. And for nearly half of beneficiaries, 90 percent or more of their income comes from Disability Insurance. Given the modest extent to which benefits replace lost earnings and the limited sources of other income upon which they can depend, people who receive Disability Insurance are rarely able to maintain the same standard of living they had before becoming disabled. Disability Insurance provides a floor, however, that moderates the decline in their living standards.

Does A Medical Condition Have To Be In The Listing Of Impairments

How to Apply for Social Security Disability

An applicant doesn’t need to have an impairment that is listed in Social Security’s Blue Book to be awarded disability benefits. For instance, migraine headaches are not included in a listing, but if an applicant’s migraines are severe enough and are well documented, Social Security may grant disability benefits if the migraines make it impossible for the disability applicant to work a full-time job. Other common impairments that aren’t listed in Social Security’s blue book include carpal tunnel syndrome, fibromyalgia, chronic regional pain syndrome, reflex sympathetic dystrophy, celiac disease, and degenerative disc disease.

The keys to getting benefits for a condition that doesn’t have a listing are that the condition must:

Social Security determines your RFC by looking at how much you can lift and carry and how long you can walk and stand. Then the agency assigns you an “exertional level”âheavy, medium, light, or sedentary. If your exertional level doesn’t allow you to do any jobs that you’re suited for, you can qualify for benefits vocationally.

    Do You Qualify For Ssdi

Who can claim disability benefits? Errors in the application form are the most common reasons for the denial.

Simple clerical mistakes can lead to rejection. Your application form should be clear and complete to boost your chances of approval.

Another factor is the lack of medical evidence. After all, some applicants provide insufficient medical records supporting their condition. Others fail to get consistent medical treatment.

If you feel the process is tedious, do your best to cooperate. Failing to work with the SSA can also lead to rejection. Give them whatever document they ask for without complaints.

Sometimes, failing to seek legal help can also affect your chances. If youre not confident in going through the process, hire a disability lawyer.

Applying for the wrong type of SSD program can also delay your benefits. The Social Security Disability Insurance applies to people with enough work history and paid enough taxes throughout their career.

Meanwhile, the Supplemental Security Income is for applicants with limited income. These are people struggling with their disability, even in their younger years.
