Limitations For Specific Jobs

Lupus and Social Security Disability

If you suffer from joint pain, you may find yourself unable to lift, bend, carry, squat, or reach so you cannot do physical jobs such as work in shipping or receiving, stocking merchandise, or work in a warehouse. The malaise may make sitting or standing long periods impossible because of your pain and discomfort without frequent repositioning. Fevers and fatigue can make concentrating or staying focused for long periods almost impossible, so you cant maintain records as required in administrative positions.

Your inability to concentrate and stay focused can make it impossible to work as an educator, in the healthcare field, or as a first responder. Your impaired mobility and lack of concentration can make working with equipment and machinery even more dangerous for yourself and coworkers. Kidney failure that requires dialysis, or lung problems that requires regular breathing treatments, can make handling any kind of work virtually impossible.

If you have lupus, which is an autoimmune disorder, and the condition is so severe that you are unable to work, you may qualify for disability benefits from the Social Security Administration . The chronic condition can lead to disabling symptoms, or you may experience symptoms that worsen over time. Lupus causes youre an individuals autoimmune system to attack itself. The severity of the condition affects its impact on the patient, but it can damage the heart, lungs, skin, joints, blood, and kidneys.

    The Path To Disability Approval

Do not be too worried if you talk to your lawyer but dont hear back until a month later to start because they are trying to get the well-needed documentation to fight for your case, including medical history such as:

    • X-rays
    • How many times you were admitted into the hospital
    • How long you stayed in the hospital
    • What you went to the hospital for

These things will be needed to help. It always is best, to be honest about depression, anxiety, and every emotion you experienced with your lawyer. Then you will receive a date to appear in court to have a chance to fight. When the judge asks the questions answer with all honesty and also lets your lawyer speak facts from the paperwork he has. He should make sure you can get every help possible. This will determine whether you will get long-term or short-term disability.

    Was Your Claim Denied

You have gone through the entire rigorous process you have gathered every piece of relevant evidence that you can, and youve completed each and every piece of paperwork you had to, but you still get rejected disability benefits for lupus. After the countless hours you spent filling in every detail you thought you could, you still stand in the same place that you started.I understand that this experience can be completely demoralizing. It is alway tough for me to see my clients, who seemed to have done everything right, get denied any benefits.Even the smallest detail that is missing allows the insurance companies to deny you benefits, even if you do have lupus. They need to have clear proof anything less will result in a denial.

    Impacting Your Ability To Work

If you suffer severe symptoms from lupus, your ability to work and function normally can be significantly impacted. The joint damage can make your mobility be challenged. Damage to your skin can increase bruising and skin tears. The malaise, exhaustion, and fevers can impact your ability to concentrate and focus, plus your overall physical and mental capacity can be severely affected. This can prevent you from maintaining accurate records or handling administrative tasks as you would do in a managerial or executive role.

Damage to your kidneys or lungs can make standing or sitting for long periods a challenge. Regular repositioning may be a necessity for comfort. You may require frequent breaks and must undergo time-consuming treatments, such as regular dialysis for your kidneys or use of a nebulizer because of breathing problems. These two treatments can impact your availability for work tasks throughout the day. This would render you unable to work in manufacturing, sales, or customer service roles.

    Different Types Of Lupus

  • Discoid Lupus Erythematosus:
  • Discoid Lupus Erythematosus, or DLE, is a type of cutaneous lupus. DLE is a chronic skin condition resulting in rash, sores, and scaly, crusty skin of the face, ears, head, and other parts of the body. This type of lupus is chronic and incurable, but can go into remission with appropriate treatment.

Unlike other types of lupus, DLE does not typically target the internal organs though a small number of people might develop a related disease of the internal organs. The cause of DLE is not yet medically understood, but there is a strong genetic correlation among family members and it is diagnosed in females three times more than males. Getting disability for lupus may be necessary if your condition contributes to other disorders and risk factors.

  • Systemic Lupus Erythematosus:
  • Systemic Lupus Erythematosus, or SLE, is the most common type of lupus disease. SLE attacks the tissues throughout the body, causing inflammation of multiple organs. This condition can cause significant damage to several parts of the body and internal organs, including blood clots, anemia, fluid retention and inflammation of the heart, damage to lung tissue, stroke, pregnancy complications, intestinal inflammation, and others. Multiple body parts may be affected simultaneously.

How Does Social Security Evaluate Lupus?

Social Security acknowledges that lupus can cause a person to become affected to the point they can no longer work and earn a gainful living. But a diagnosis of lupus is not enough to qualify for and receive Social Security Disability Insurance benefits, or SSDI.

Social Security offers two ways to qualify for SSDI:

  • The first way is by proving you meet or equal the medical listing for lupus in SSAs Listing of Impairments. Systemic lupus erythematosus appears in the Immune System Disorders section 14.00.
  • SSAs medical listing gives you two paths:

  • You have to show that lupus affects two or more organs or body systems, and you have at least two of these constitutional symptoms: fatigue, fever, malaise, or involuntary weight loss. or
  • You must show repeated evidence of SLE with at least two of the constitutional symptoms plus marked limitation of one of the following:
    • Activities of daily living
    • Ability to function socially
    • Ability to timely complete tasks due to deficits in concentration, stamina, or keeping pace.
  • If you do not meet or equal the above medical listings, Social Security also has rules that apply to every kind of disability. You may still be able to prove you are disabled through a residual functional capacity evaluation. This is known as a medical-vocational allowance. SSA needs to find that your condition causes enough functional problems that you cannot do your past work or any other work.

I Have Lupus Can I Get Disability Benefits

If your doctor provides you with a lupus diagnosis, you may qualify for Social Security Disability Insurance once you can no longer work due to impaired physical function. To get approved, youll need to meet the Social Security Administrations criteria under the Lupus listing in their Blue Book. The official criteria only cover systemic lupus erythematosus and not discoid lupus. That doesnt mean, however, that the SSA wont approve you for SSDI benefits.

Social Security Disability is the federal program, supported by payroll taxes, that pays benefits to people who cannot work due to a medical condition. In order to qualify, you must have a medical condition that meets Social Security’s definition of disability and is expected to last at least one year or result in death.

You will be considered disabled if you can provide medical evidence that are unable to do the work that you did before and you cannot adjust to other work because of your medical condition. No benefits are payable for partial disability or for short-term disability.

Generally, to be eligible for disability benefits, you must have worked long enough and acquired enough work credits. The number of work credits required will depend on your age when you become disabled. There are different eligibility rules for children under the age of 18.

Different Areas Where You Can Get Arthritis

Arthritis is an inflammation of the joints, the tissue around the joints and surrounding tissues. Since there are joints all over the body, its possible to get arthritis in many locations even though its most common in the hands, knees and back.

Over time, the cartilage in joints will break down, which leads to inflammation and arthritis. Thats why the condition is so common in hands and knees since those are two areas that are used all the time.

Arthritis can also be caused by injury, such as an old sports injury or a repetitive motion injury. The latter is one of the reasons arthritis can make doing work so difficult. Imagine working in a factory that requires you to pull levers or assemble parts.

Arthritis in the hands would make this work difficult, and so some people find themselves unable to perform their jobs and must seek out assistance.

You can file a claim for Social Security disability benefits with arthritis. You will need to demonstrate that your condition makes you unable to perform the requirements of your job, which is why collecting medical evidence is the most important part of your application.
