Fifth 3m Earplug Bellwether Trial: Defense Verdict

A Federal Court Jury found 3M not guilty in the fifth bellwether trial involving U.S. Veteran Michelle Blum. Blum alleged that her loss of hearing and tinnitus were related to the use of defective 3M dual-sided earplugs that she was issued when she served in the U.S. Army Reserves National Guard and Army between 1989 and 2009.

While the outcome of this trial may be disappointing for plaintiffs in this matter, this was a case selected by the defense for trial. The facts, in this case, were unusually strong in favor of the defense.

According to court documents, the second female bellwether plaintiff did not report her loss of hearing for almost ten years after she left the service. This fact alone is in striking contrast to the overwhelming majority of pending cases where military members sought treatment while they were enlisted or soon after discharge.

Our Soldiers Deserved Better Than Defective 3m Earplugs

First and foremost, defective equipment as the 3M dual-sided hearing protection may prove to be hazardous to our soldiers and veterans. Political and ideological differences have always been put aside when the health of our war heroes is the matter at hand. Economic and private interests should never interfere with providing those who serve the country in uniform with the best quality equipment. After all, theyre risking their very lives countless miles away from their homes for one single purpose granting us the safety and freedom we enjoy every day.

But thats not all. The U.S. government spends nearly $500 billion on defense and international security every year almost 20% of the federal budget. According to a Department of Defense report released by Senator Bernie Sanders, the Pentagon has paid $1.1 trillion in 10 years to defense contractors who had defrauded the government. When a private contractor such as 3M commits fraud, and this money is lost, the price is paid American taxpayers as the government must face additional expenses that could be reinvested into additional services such as Veteran health care or other army welfare departments.

In 2007, 3M entered into a definitive agreement for the acquisition of Aearo for a total purchase price of $1.2 billion. They took over the contract with the U.S military and supplied the earplugs. Version 4 earplugs overtook Version 2 earplugs in 2015, and thousands of 3M Combat earplugs were supplied to the United States Defense Logistics Agency between 2007-2015. The product was extensively used by the U.S. Air force, Army, Marines, and Navy during this period.

Defective Earplug Claim

Following the controversial allegations raised in the U.S. Department of Justice investigation, a number of 3M earplug class action lawsuits and individual hearing loss lawsuits were filed throughout federal courts by former and active military service members.

By May 2021, more than 600 cases had been filed in U.S. District Courts nationwide, which prompted the U.S. Judicial Panel on Multidistrict Litigation to establish coordinated pretrial proceedings in the federal court system. All 3M earplug claims have been centralized before U.S. District Judge Casey Rodgers in the Northern District of Florida for common discovery and pretrial proceedings, where the litigation has been managed in a manner similar to a 3M earplug class action lawsuit. However, each claim remains an individual lawsuit, where plaintiffs must established that their hearing loss was caused by the 3M earplug.

More than 257,000 former military service members are still awaiting their day in court to obtain a 3M earplug lawsuit payout.

Has 3m Settled Any Defective Earplug Lawsuit

In 2016, Moldex-Metric filed a false claims act case that was later joined by the Department of Justice . The 3m earplug lawsuit provided evidence that when the earplugs were not adequately sealed, the devices created a high risk of hearing injury when soldiers falsely believed they were blocking out dangerously loud sounds.

A $9.1 million 3M earplug settlement was entered into with the Federal Government to resolve allegations related to the whistleblower claim over 3M’s failure to disclose defects to the military. The company refused to admit liability.

At the time of this writing, there have not been any settlements related to soldiers who suffer hearing damage or a loss of hearing from dual-ended combat arms as part of the pending class-action lawsuit.

However, the repeated jury verdicts on behalf of many plaintiffs have caused a noticeable drop in 3M’s stock prices, which might serve as the needed motivation to resolve most future claims in a class-action lawsuit.

Many veterans have photos from their active duty military service. Look through your old photos and see if you can find a picture of you or fellow service members wearing the black and yellow 3M earplugs. If fellow service members are wearing the 3M earplugs and you are also in the photo, it is likely the military distributed the defective 3M earplugs to your unit.

Summary Judgment Wants Mmm To Take Full Responsibility

More than 230,000 lawsuits have been filed from military veterans who complained about its Combat Arms Earplugs Version 2, which left many service members with tinnitus and hearing loss.

The litigation, which started back in 2018, after a whistle-blower filed a lawsuit against 3M revealing allegations that 3M and its subsidiary, Aearo Technologies, had knowingly sold defective dual-ended Combat Arms earplugs to the United States Military. This case resulted in a $9.1m settlement with the Department of Justice.

The new summary judgment comes after 3Ms subsidiary, Aearo Technologies filed for bankruptcy and claimed responsibility for the faulty devices.

The ear protectors, which were standard issue equipment before all deployments between 2004 and 2015, have been the source of many problems for 3M this year and analysts believe that 3Ms only hope is to settle these cases.

3M has every incentive to seek a settlement in that scenario. Litigating these cases is not a realistic scenario, Nigel Coe, an analyst at Wolfe Research said.

The motion for summary judgment was filed on 4 October and said: The Wave 1 Remand Plaintiffs respectfully move for summary judgment on 3M Companys arguments and defences that it is anything but fully and independently liable for all CAEv2-related injuries, whether incurred before or after the 2008 Aearo Defendant acquisition.

Update: 3m Faces Billions In Liabilities Over Defective Earplugs

More than 100,000 U.S. military veterans have filed lawsuits against Minnesota-based 3M over hearing damage linked to allegedly defective military earplugs. The company faces billions of dollars in potential costs from a global settlement or trials after soldiers claimed they returned from war with hearing damage due to the earplugs, which the government purchased for around $7.63 a pair.

3M began court-ordered negotiations in July 2022 with lawyers representing soldiers who used the earplugs. The lawsuits are affecting 3M shares and signal a warning to other companies that liability risks may outweigh the gains from manufacturing similar protective products.

Earplug cases from across the country, involving dozens of lawyers, have been consolidated into an MDL in Florida. There are now at least 107,000 active cases and an additional 127,000 cases that could move over to the active list if filing fees are paid and other steps are taken.

3M argues that the earplugs work when soldiers are given proper training and use them as designed. The company also claimed it has a legal protection known as a federal government contractor defense, meaning that a supplier cant be held liable for manufacturing a product that the government requested.

    3M EARPLUG WAVE TRIAL

Aero Technologies created an earplug designed to work two different ways. When inserted in one direction, the earplugs were claimed to block all noise, protecting users from hearing loss when they were near explosions or heavy machinery. If the user inserted the earplugs the other way, the device was supposed to still protect the user from hearing loss yet allow for conversations between users.

In 2003, the U.S. military contracted with Aearo Technologies to supply Combat Arms Earplugs, Version 2. Most of the earplugs were used by the U.S. Army personnel.

When this happens, thousands of individuals all over the country sue the same defendant around the same time. The outcomes of Bellwether trials reveal patterns in litigation and can assist plaintiffs and defendants in deciding how to proceed with their mass tort claim.

    Mdl Motion To Dismiss

In April 2020, Judge Rodgers has a motion to dismiss these lawsuits sitting in front of him. In its motion for summary judgment, 3M contends that all these cases should be dismissed without a jury trial because the when military received the CAEv2 prototypes 22 years ago, it asked the manufacturer to shorten earplugs by a quarter inch.

They claim this is because they needed it to fit into standard-issue carrying cases and because they feared it might make it hard for the wearer to fasten the chin strap on their helmet. I dont think the court will grant this motion. As I talk about more below, this is all a part of the plan to blame the military or hide behind her skirt. I dont think it will work.
