Social Security FAQ: Does My Child Qualify for SSI Benefits?

Once you and your registered medical practitioner have completed the application for The Child Disability Tax Credit / The Disability Tax Credit Certificate Form T2201, you will be able to send in the application in two different ways.

1) Submitting electronically through CRA My Account

Submitting electronically has many benefits, including being able to check the status of your application. However, it also requires access to a computer and an internet connection.

2) Submitting a physical copy by mailing it to one of the Tax Locations.

Submitting a physical copy means you are able to simply put your application in the mail. However, this method may make it more difficult to track the status of your claim.

It takes, on average, between three to six months to receive a response from the CRA regarding the status of a claim, including if your case has been deemed eligible for benefits, and the reassessment of your previous years taxes if the claim qualifies. This is an estimated number and it can sometimes take longer. In some cases, it can take over a year.

SSI is for individuals with low income who have become disabled; there is an income and resource limit for children to qualify for this benefit.

The income and resources of the child are considered, as well as the income and resources of the family members that the child lives with. For example, a disabled child who lives at home with his parents will be barred from collecting SSI if his parents make above a certain amount of money. Even a child who does not live at home may still have the income and resources of their family members considered if she goes home periodically and is under the care of those family members when at home.

How Does The Ssa Evaluate Parental Income

The amount of money each child receives in SSI support is subject to reduction if the parents are deemed to earn more than the federal maximum threshold.

The SSA encourages parents of beneficiaries to continue earning income by staggering its program reductions at a 2-to-1 ratio. Thus, the SSA reduces SSI benefits by $1 for every $2 the parents earn from other sources. Parents incomes are largely determined using self-reporting at the time an application is submitted. The reported amounts may be checked against tax returns, paystubs and other proof of income documents.

Once the income requirements are met, a child must meet the basic medical eligibility requirements of SSI to be considered for benefits. The child must meet these requirements.

  • The child has “marked and severe” functional limitations. These limitations are ones that severely interfere with the child’s ability to function at the level of other children of the same age.
  • The child has been disabled for the past 12 months, or is expected to be disabled for 12 months or more, or has a disability that is expected to result in death.
  • The child is not working and earning over about $1,200 per month.

Unlike adults, children do not need to prove that they are unable to return to work. For SSI for children, the SSA’s initial review includes the severity of the child’s impairments and whether the child is working a significant amount. The SSA then makes a decision whether or not the child’s functional limitations are severe enough to move forward into a full disability determination.

What Your Va Disability Rating Means

The VA distributes benefits on a sliding scale based on your level of disability. The more disabling your medical condition, the more money youll receive in compensation.

The VA uses the disability rating system to put a number on what it perceives as your level of disability. The rating schedule runs from 0 to 100 percent in increments of 10. A 100 percent rating is the top of the schedule, indicating total disability. Understanding The Dtc Assessment Process

After the Canada Revenue Agency receives;Form T2201 Disability Tax Credit Certificate, it will assess the validity of your claim.

  • If you are approved, the CRA will send a notice identifying the years for which you may claim the DTC. At the end of the identified time period, you will be required to resubmit an application if you want to continue to claim the DTC.
  • If the CRA chooses to deny your claim, you may gather additional information from qualified medical practitioners, send it to the CRA and request an additional review. Alternatively, you can file a formal objection within 90 days after the CRA sends you your notice of determination.

My Child Has A Disability Is My Child Eligible

Not all children with disabilities are eligible for the disability amount. To be eligible a child must have a severe and prolonged impairment in physical or mental functions. An impairment is prolonged if it has lasted, or is expected to last, for a continuous period of at least 12 months. A qualified practitioner must certify on Form T2201, Disability Tax Credit Certificate, that the childs impairment meets certain conditions. What Is An Adult Child Benefit

Adults who became disabled during childhood typically have not worked enough years to have a Social Security earning records that qualifies for disability benefits on their own. But they may still qualify to receive disability benefits based on a parents Social Security earnings record.

Some activities do not count in the 14 hours per week requirement, such as:

  • the time a portable or implanted device takes to deliver the therapy
  • activities related to dietary restrictions or regimes, even when these activities are a factor in determining the daily dosage of medication
  • activities related to exercising, even when these activities are a factor in determining the daily dosage of medication
  • travel time to receive the therapy
  • going to medical appointments
  • buying;medication

Retroactive Payments For Child Disability Tax Credit And Child Disability Benefit

When you are approved for your childs Disability Tax Credit and Child Disability Benefit, you will be able to receive up to the amount 10 years before of both as a retroactive payment. The CRA reassesses you taxes for the previous ten years then decides which years you are eligible for both programs and will pay you the corresponding tax credit amount and disability benefit amounts.

The CRA reserves the right to decline Child Disability benefits based on the information you have submitted. In such cases you have the right to amend your application by submitting additional relevant information. So in summary, if you are eligible for the Child Disability Tax Credit, you can receive:

  • A retroactive lump sum refund for up to the past 10 years that is the total of the Disability Tax Credit refunds for taxes paid during eligible years
  • The CDB payments for up to the past 10 years. You will first receive retroactive payment for the previous two years of the benefit. You will need to submit a written request for the remaining amount.
  • A yearly DTC refund based on your paid taxes when you file your income tax.
  • A monthly CDB payment that is added to the Canada Child Benefit payment you are already receiving.

If You Get Ssi And Are Turning 18

If you get SSI and then you turn 18, the biggest change in SSI eligibility rules is that you are considered an adult, not a child. When SSI decides whether you have a disability, SSI will not use their definition of disability for children. Instead, as an adult, SSI looks at your ability to work, not just your physical or mental limitations. That means that some people stop getting SSI benefits after they turn 18.

During the first year after you turn 18, SSI will automatically check to see if they still consider you disabled. This is called the SSI Age-18 Redetermination. They will say you have a disability if:

  • You have a physical or mental impairment or combination of impairments
  • Your impairments limit your ability to work, and
  • Your condition has lasted or is expected to last for at least 12 months.

SSI may also look at your work and school record to see if you are able to work and may even talk to your teachers, counselors, or employers.

If you are going through the SSI Age-18 redetermination, Social Security may consider you to have a disability, even if you are working and earn less than $1,310 per month.

If you were not getting SSI before you turned 18 and you apply for SSI as an adult, Social Security may consider you to have a disability if you are working, but only if you make less than $1,310 per month, if you aren’t blind. If you are blind, you could earn much more.

You must dedicate the time for the therapy; that is, you have to take time away from your normal, everyday activities to receive it. It includes the time you;need to set up a portable device. For example, you may have to dedicate time for chest physiotherapy to ease breathing or need kidney dialysis to filter blood.

If;the therapy requires a regular dosage of a;medication that needs to be adjusted daily, the time spent on activities directly related to determining the dosage and administering the medication can be;counted in;the 14 hours per week requirement. For example, time spent on the following activities for insulin therapy:

  • checking blood glucose levels
  • preparing and administering the insulin
  • calibrating necessary equipment
  • testing ketones
  • keeping a log book of blood glucose levels

If a child cannot;do the activities related to the therapy because of their age, the time spent by the childs primary caregivers to do and supervise these activities can be counted;in the 14 hours per week requirement.

What Are Child Disability Benefit Eligibility Criteria

You may be eligible for the Child Disability Benefit if you are already eligible and a recipient of the Canada Child Benefit and are eligible to receive the Disability Tax Credit for your child.

To be eligible for the Canada Child Benefit , you must meet all of the following conditions:

  • You must live with the child, and the child must be under 18 years of age.
  • You are primarily responsible for the care and upbringing of the child.
  • You must be a resident of Canada for tax purposes.

Once the CRA has received your DTC application, you will also be assessed to receive the Canada Child Benefit as well as any other relevant provincial or territorial programs.

How Do I Apply For The Child Disability Benefit

If you are eligible for the CCTB but you have not filed Form T2201, Disability Tax Credit Certificate, for a child who may be eligible for the CDB supplement, you must complete Part A and have Part B completed and signed by a qualified practitioner. Send the completed signed form to your tax centre. The Canada Revenue Agency will determine whether or not you are eligible to receive the disability amount and the CDB supplement.

You can send the form to us at any time during the year.;;By sending us your form before you file your tax return, you may prevent a delay in your assessment. We will review the application before we assess the return. Keep a copy of the completed form for your records.

If you have already applied for the Canada Child Tax Benefit for a child who is eligible for the disability amount, the CDB will be calculated automatically for the current and the two previous CCTB benefit years. Beyond these benefit years, a written request to the appropriate tax centre or tax services office will have to be submitted.

If you have not applied for the CCTB for your child, but have already filed Form T2201, complete and mail Form RC66, Canada Child Benefits Application to your tax centre. The CRA will determine whether or not you are eligible for the CCTB and the CDB supplement.
