Just because youre found disabled does not mean the VA is saying its permanent and does not mean that later on they wont try and reduce your rating.

Total disability is good, but Permanent and Total disability is even better. Total Disability Individual Unemployability can be considered temporary, but Permanent and Total disability VA benefits ratings get protection from any future reductions.

The VA deems a disability permanent when it is reasonably certain the veterans condition wont improve. Age is an important factor, if youre 75 years old, its not reasonable to believe that your spine injury is going to get better and youre going to be able to return to work. However, that same person, if they were only 35 years old, might be considered temporary because theyre young enough to improve.

How do you tell if your rating has found you to be Permanent and Total? Look at your Rating Decision. The exact language used in Rating Decisions will vary from Regional Office to Regional Office and each state has its own Regional Office but understanding what to look for can help you figure it out.

• Does the Rating Decision say there are no future exams that are going to be scheduled?
• Does the Rating Decision have a box thats Permanent and Total and its checked?
• Have you read why the VA ruled the way it did? Frequently you can read the Rating Decision itself, and its pretty clear one way or the other what theyve done.

Can Veterans With Schedular 100% Va Disability Ratings Work

If a veteran has a schedular 100 percent disability rating for one or more service-connected conditions, they are fully entitled to continue working. However, veterans should keep in mind that the VASRD is based on average impairment to earning capacity. This means that a veterans ability to work is one of the factors VA considers when trying to determine whether there has been an actual material improvement to a service-connected condition.

Are 100% Va Ratings Permanent

VA disability ratings at 100 percent are notautomatically permanent however, they can be granted permanent status in certain situations.

For example, if a 100 percent rating is in place for 20 years or more, VA is not going to reduce that ratingunless there is evidence of fraud in the initial rating assignment.

If it is less than 20 years, VA can pursue a rating reduction, but there needs to be both material improvement and improvement under ordinary conditions. Importantly, VA cannot rely on a simple examination showing improvement when issuing a rating reduction.

Having a rating for 20 years does not mean it automatically becomes permanent but, if VA determines your rating cannot be subject to reduction after 20 years, your 100 percent rating will remain the same .

Can I Request A Permanent Va Rating

If you believe that your total 100 percent disability is unlikely to improve at any point in the future, you can write a letter to your VA Regional Office requesting a permanent rating. With your letter, you should include medical evidence showing that your medical condition cannot be expected to improve in the future.

Champva Cost And Benefit

With CHAMPVA, you and your family will never pay more than $3,000 per year out of pocket for covered services. There may be a 25% cost-share for services depending on Medicare coverage .

Example: A family member has a $10,000 medical procedure performed. You pay 25%, CHAMPVA pays 75%. This would cost you $2,500. If another procedure costing $10,000 is needed after this, youve already hit $2,500 of your $3,000 deductible so you would only pay $500 more. The deductible is $3,000 per year for all dependents.

You can choose from treatment at a VA Medical Center, the CHAMPVA in-house treatment initiative program, or treatment from non-VA providers.

Most TRICARE and MEDICARE providers also accept CHAMPVA patients.

The only way to know for sure is to review your VA Rating Decision Letter, which is mailed to you in a yellow enveloped via regular US mail. You can also review your VA Benefit Summary letter by logging into your eBenefits account. Once logged in, click Manage across the top, then Documents and Records, then VA Letters, and finally Benefit Summary Veteran Benefits. Scroll down and check the section that says, You are considered to be totally and permanently disabled due solely to your service-connected disabilities. It will either say YES or NO in this block. This letter will also show if you are in receipt of Special Monthly Compensation due to the type and severity of your service connected disabilities.

Continuous Ratings: 20 Years Or More

Service-connected conditions that have been rated at or above a certain disability rating level for 20 years or longer are considered continuous. VA cannot reduce a continuous rating below the original level . For example, if a veterans service-connected depression was originally rated at 50% disabling and fluctuated between 50% and 70% over the next 20 years , VA could not reduce the rating below 50%.

How Do I Know If My Va Rating Is Considered Permanent And Total

VA regional offices have varying methods of letting veterans know theyve been awarded P& T status.

To determine if you have P& T status, look at the VA decision letter you received from the VA. Some decision letters may display a checkmark for P& T status. Another indication of permanent status is if your letter informs you that no future exams are scheduled. Either of these notations confirm that you have permanent status.

How To Know When Your Disability Rating Is Permanent

Take a look at the decision letter VA sent you when granting benefits . On some Rating Decisions, there is a Permanent and Total box that will be checked if your 100% disability is permanent. On others, there may be language like eligibility to Dependents Chapter 35 DEA / CHAMPVA are established or no future examinations are scheduled both of which can indicate permanence. The exact language may vary with different VA Regional Offices.

If the letter says that future examinations are scheduled, then your disability rating is not considered permanent by VA.
