Tricare After Divorce Or Remarriage

In the case of divorce, a former spouse will lose their TRICARE benefits and eligibility, and it will be necessary to find a new health insurance provider. In some scenarios, former spouses can qualify for their own TRICARE plan and benefits . Former spouses who received their own TRICARE coverage can lose their benefits upon remarrying, or by obtaining insurance through another provider. Stepchildren who were covered during marriage will also lose benefits if the sponsor and childs parent divorce.

Notice To New & Expectant Parents

If you are expecting and you need to establish CHAMPVA eligibility for your new child, the following must be accomplished before you can submit an application.

  • Obtain a Social Security Number for the newborn by applying to the nearest Social Security Administration office.
  • Establish dependency of the newborn to the veteran sponsor by contacting the local VA regional office.

Since the payment of claims for this child is contingent upon his/her eligibility status, as new parents you are encouraged to take the above action as early as possible.

The VA may provide a one-time payment of not more than $21,488.29 to help you buy a specially equipped vehicle.

In some situations, one or more adaptive-equipment grants to change a vehicle so it has features like power steering, brakes, seats, windows, or lift equipment to help you get into and out of the vehicle

You must already be service-connected for these conditions before purchasing a vehicle to receive the payment.

The VA may grant the money directly to the veteran OR they may pay the equipment seller directly.

Eligibility:

  • Loss, or permanent loss of use, of 1 or both feet, or
  • Loss, or permanent loss of use, of 1 or both hands, or
  • Permanent decreased vision in both eyes: 20/200 vision or less in your better eye with glasses, or greater than 20/200 vision but with a visual field defect that has reduced your peripheral vision to 20 degrees or less in your better eye, or
  • A severe burn injury, or
  • Amyotrophic lateral sclerosis , or
  • Ankylosis in 1 or both knees or hips

Va Home Loan Funding Fee Waiver For Disabled Veterans

Disabled Veterans with a VA disability rating of 10% or higher qualify for a waiver of the VA home loan funding fee. In 2020, VA home loan funding fees range from 1.4% to 3.6% of the total loan amount . For example, lets say a first-time veteran home buyer purchases a $300,000 home and makes a down payment of $15,000 . Youll pay a VA funding fee of $4,702.50, or 1.65% of the $285,000 loan amount. Note the funding fee applies only to the VA loan amount, NOT the purchase price of the home. Now, if youre a disabled veteran with a service-connected disability rating of 10% or higher, you are exempt from the VA home loan funding fee! Tricare For Divorced Former Spouses

In some instances, former spouses may be eligible to receive TRICARE benefits based on their marriage status and the amount of time their spouse spent in the military. To qualify, spouses cannot be remarried, and they cannot have access to health insurance through an employer. Former spouses must also meet the 20-20-20 rule, which determines they are eligible if:

  • The sponsor has 20 years of service towards retirement pay
  • The former spouse and sponsor were married for at least 20 years
  • All 20 years of marriage were during the 20 years of a sponsors service
  • If this criteria is not met, a former spouse must meet the 20-20-15 rule, which determines they are eligible if:
  • The sponsor has 20 years of service towards retirement pay
  • The former spouse and sponsor were married for at least 20 years
  • 15 years of marriage were during the 20 years of a sponsors service
  • If a former spouse meets these conditions, they are eligible to receive TRICARE benefits with their own policy, separate from those of their divorced spouse. If a former spouse chooses to remarry or obtain other insurance, they will lose their TRICARE eligibility.

    Example. Martha and Paul were married for 23 years during Pauls 25 year Air Force career. After they divorced, Martha applied for TRICARE benefits. Because Paul had more than 20 years of service, and the couple was married for more than 20 years which overlapped Pauls service time Martha qualified for her own TRICARE health benefits plan.

    How Tfl And Medicare Coordinate

    If you have Medicare and TFL, Medicare is the primary insurer and TFL is the secondary insurer for services covered by both plans. For example, after a Medicare-covered doctors visit, Medicare would pay 80% of the Medicare-approved amount and TFL would pay the remaining 20%, up to its allowable charge.

    If you have other supplemental health insurance in addition to Medicare and TFL, Medicare pays first, followed by your other insurance and then by TFL. For example, after a Medicare-covered doctors visit, Medicare would pay first and your other health insurance would pay second. If there was still a balance you wanted TFL to pay, you would need to file a claim with the TFL contractor online or by phone at 1-866-773-0404 or 1-866-773-0405 . Note: The TFL contractor covering California is Wisconsin Physicians Services, Inc.

    For services covered by TFL but not Medicare , TFL is the primary payer and you are responsible for the TFL standard annual deductible and cost sharing, unless you have other health insurance.

    For services covered by Medicare but not TFL, Medicare is the primary payer. If there is a balance after Medicare pays, you are responsible for it unless you have other supplemental health insurance. TFL will not cover any part of these services.

    For services not covered by TFL or Medicare, you are responsible for the cost, unless you have health insurance that covers these services.
