New Partnership To Provide Free Legal Services To Veterans On Va Claims
RENO, Nev. – A new partnership between the Nevada Department of Veteran Services and the National Veterans Legal Services Program will allow free access to legal representation for Nevada veterans and their families in appeals before the U.S. Court of Appeals for Veterans Claims.
The NVLSP will provide free legal representation if the Department of Veterans Affairs denies a veteran a disability claim. They will also assist Nevada veterans with discharge updates.
This new partnership results in the best of both worlds for the veterans we are honored to serve and our department, said NDVS Director Fred Wagar. Nevada veterans will now have access to an outstanding national legal team who will defend their rights at the highest legal levels to ensure fairness in the disability benefits arena. Additionally, NDVS will capitalize on access to the extensive training and professional development portfolio that NVLSP will offer to members of our team. This training will be invaluable as we continue to serve Nevada veterans now and into the future.

The National Veterans Legal Services Program is a 501 nonprofit organization that has worked since 1981 to ensure that the government delivers to our nation’s 22 million veterans and active-duty personnel the benefits to which they are entitled.

New Partnership To Bring Free Legal Assistance For Veterans On Certain Claims
The process begins once the legal program reviews a claim and determines if there are grounds for an appeal.
Today, the Nevada Department of Veterans Services announced a historic new partnership with the National Veterans Legal Services Program to create incomparable free access to legal representation for Nevada veterans and their families in appeals before the U.S. Court of Appeals for Veterans Claims .
This strategic partnership marks the first time this free legal service will be available to veterans in Nevada.
When the U.S. Department of Veterans Affairs denies disability claim, veterans have the right to appeal. The National Veterans Legal Services Program will provide free legal representation in support of appeal cases.
The process begins when the NVLSP reviews a claim in which a veterans appeal to the Board of Veterans Appeals , the highest authority within the U.S. Department of Veterans Affairs, is denied and determines there are grounds for an appeal to the CAVC.
When this occurs, NVLSP offers to represent the veteran or the veterans family at no cost. NVLSP will provide free legal representation in support of appeal cases through this partnership.
In addition to NVLSPs assistance to veterans with claims appeals, NVLSP will also assist Nevada veterans with discharge upgrades, which will help veterans access benefits they may be wrongfully denied due to a less-than-honorable discharge.

Burn Pits Claims Assistance Program
NVLSP is expanding its representation of veterans to include cases before the VA on claims for service-connected disability benefits for diseases arising from exposure to burn pits overseas. If you or someone you know served on a base where burn pits were used to dispose of paint, medical/human waste, metals, plastics, rubber, etc., and you are currently seeking service-connected compensation for a condition, respiratory or otherwise, that you believe resulted from your exposure to these burn pits, NVLSP may be able to help.
What We Aim To Solve
There are 4.5 million veterans have a service-connected disability. Disability benefits, which are provided by the Department of Veterans Affairs and branches of our military, are a step toward restoring the lives of these men and women. Yet each year, thousands of veterans have their claims for disability benefits wrongly denied or evaluated incorrectly. For many veterans, securing the proper amount of compensation due after returning home can be a discouraging and drawn-out process. Of the veterans who file appeals each year, thousands do not have a lawyer to represent them, mainly because it is unaffordable. For many others, navigating the system proves too big a challenge. As a result, many veterans are left behind, wondering where to turn for help.

National Veterans Legal Services Program V United States No 19
Nonprofit organizations that have downloaded public court records via the Public Access to Court Electronic Records system brought a class action, alleging that the incurred PACER fees exceeded the amount that could lawfully be charged under a note to 28 U.S.C. 1913 because the fees did not reflect the cost of operating PACER alone. Asserting subject-matter jurisdiction under the Little Tucker Act, 28 U.S.C. 1346, the plaintiffs sought the return or refund of the excessive PACER fees. After denying the governments motion to dismiss, the district court certified an opt-out class consisting of all individuals and entities who had paid PACER fees, April 21, 2010-April 21, 2016, excluding federal government entities and present class counsel.The Federal Circuit affirmed. The statute authorizes the government to collect a fee for certain purposes. It is alleged that the government collected fees in excess of the statutory authorization, so the necessary implication is that the fees can be recovered through an illegal exaction claim. There is no need for a separate express money damages provision in the fee-authorizing statute for a plaintiff to proceed under the Little Tucker Act. The Section 1913 Note limits PACER fees to the amount needed to cover expenses incurred in services providing public access to federal court electronic docketing information. Those fees cannot be used to promote access purely for select entities or individuals.
