VA disability payments are not automatic – as with everything else in the military, there is a process, and this one requires that the retiree affirmatively apply for disability payments. 38 U.S. Code § 5101. The specific form used is the VA Form 21-526, Veteran’s Application for Compensation and/or Pension. While disability applications often come contemporaneous with separation from the military, as long as the condition was service-connected, there is no deadline to apply. So when addressing VA disability and divorce issues, do not assume there will be no future VA benefits simply because the veteran is not currently receiving them.

A VA disability election is revocable, per DOD Financial Management Regulation, Volume 7B, Section 120205. Presumably a veteran would have little incentive to do this, unless to facilitate receipt of Combat-Related Special Compensation . Revoking a VA disability election requires filling out the same VA Form 21-526.

Expedited Processing For Those With Va Disability Ratings At 100%

Some veterans who possess a VA rating of 100% permanent and total disability may qualify for expedited Social Security claims. Be sure to ask about this when applying for SSA options and make sure you self identify on all application paperwork as a 100%-VA-rated disabled veteran.

Other veterans may qualify for help, too. Any veteran with disabling mental or physical health injuries on active duty on or after Oct. 1, 2001 are eligible for expedited SSI/SSDI application processing. This does not need to have occurred during combat, but the issue must be noted on the SSI/SSDI application.

So if you are the veteran, when calculating post-divorce child support or maintenance, you will want to make sure that your income includes the reduced amount, and not the higher amount based upon being married.

Taxability Of Military Retirement Pay

Military retirement pay based on age or length of service is taxable and must be included as income for Federal income taxes. The amount of your pay that is deducted for the Survivors Benefit Plan is excluded from taxable income. For Social Security tax purposes, military retirement pay is not considered earned income and no Social Security is withheld.

Military Disability Retirement Pay shouldn’t be included in taxable income if your disability or injury was caused by combat or if you get military disability instead of VA disability for your injuries.

Can 100% VA Disability Be Garnished for Child Support?

The VA awards a disability rating between 10% and 100%, which, along with the number of family members, determines the amount of the servicemember’s. The VA publishes Veterans Compensation Benefits Rate Tables annually in December.

The minimum disability payment, for a 10% rating is $153/mo in 2021, and the benefits increase up to $3653.89 for a 100% disabled veteran who has a spouse and child, and even more with more children or qualifying parents.

Note that a members rank, while affecting the retirement payment, does NOT affect the amount of disability paid. So a married member with no children and a 30% disability rating will receive the same payment regardless of whether he was an Army Specialist or a Colonel .

In other words, a 40% disability rating is not somehow multiplied against the military retirement itself – after all, veterans who did not retire also receive it. Instead, the monthly disability payment is determined solely by the VA rate table. And a retiree who receives $800/mo in VA disability benefits for a 40% rating will waive $800/mo of retirement, regardless of how much retirement she is actually receiving.

Veterans Affairs Disability Pension Is Property Not Income

In a case called Manuge, the Federal Court was asked to decide on a class-action brought on the government by 4,500 former members of the Canadian Forces. These members were receiving an insurance amount each month. The member was also awarded a monthly disability pension through Veterans Affairs. As a result, the monthly insurance award was reduced by the amount of the disability pension. The Court ruled that this wasnt proper. The Veterans Affairs Disability pension was not income replacement. Rather, the pension was property. It was compensation for loss of amenities of life and for the personal limitations and sacrifices that arise from disabling injuries.

After this decision, courts across the country remain divided on the impact of this ruling on family law matters. It appears as though the first time this issue was decided after Manuge was in Alberta in 2013, where the court that the VAC disability pension was not to be included as income for support purposes. The one exception was for the monthly amount received for the children of the veteran.

This reasoning has been followed by other courts across the country, for example in Manitoba and British Columbia.

Va Disability May Be Garnished For Child Support & Alimony

Disability payments from the Veterans Administration are not normally subject to garnishment or assignment. 38 U.S. Code § 5301. However, there is a limited exception in 42 U.S. Code § 659 which authorizes garnishment only to the extent that military retirement was waived to receive VA disability. So there are two preconditions to garnishing VA disability payments for family support:

  • The veteran has retired, not simply ETS’d, and
  • The veteran has a disability rating of 40% or less, so there is a VA waiver in effect against the military retirement.

In cases where there are multiple disabilities, the percentages are added together but can never be cumulatively more than 100% total regardless.

The VA claims process takes time. Some veterans may find it faster to get signed up for Social Security disability benefits, but its not necessary to decide which to apply for first as a general rule. There are always exceptions to that, but since these two programs are completely separate, applicants are subject to the waiting times required due to demand and other factors.
