How Often Do I Need To Check The Status Of My Claim

How To Check Your VA Disability Claim Status | Disability Claims | Jackson & MacNichol

When you are waiting for the SSA to decide on your initial claim, we recommend checking the status of your case regularly. While the SSA should notify you if it needs any extra information or additional medical evidence to process your claim, you can usually learn about it faster by checking your status.

Why Should You Check On The Status Of Your Disability Application

There are several reasons why you should check on your application status. These include:;

    • You may find that the Social Security Administration fails to notify you about a denial of your claim. This is important because you only have 65 days from the denial date in which to file an appeal. If you dont know that your claim was denied, you may miss the appeal date.;
    • It is possible for paperwork to get lost. This can halt the progress of your case and in extreme circumstances, require you to reapply. This happens when the SSA determines that you missed the appeal date, even if the fault was their own.;

    What We Mean By Disability

    When and How to Check the Status of a Disability Claim or Case

    The definition of disability under Social Security is different than other programs. Social Security pays only for total disability. No benefits are payable for partial disability or for short-term disability.

    We consider you disabled under Social Security rules if all of the following are true:

    • You cannot do work that you did before because of your medical condition.
    • You cannot adjust to other work because of your medical condition.
    • Your disability has lasted or is expected to last for at least one year or to result in death.

    This is a strict definition of disability. Social Security program rules assume that working families have access to other resources to provide support during periods of short-term disabilities, including workers’ compensation, insurance, savings, and investments.

    What Is The Disability Tax Credit

    The disability tax credit is a non-refundable tax credit that helps persons with disabilities or their supporting persons reduce the amount of income tax they may have to pay. An individual may claim the disability amount once they are eligible for the DTC. This amount includes a supplement for persons under 18 years of age at the end of the year.

    The purpose of the;DTC is to provide for greater tax equity by allowing some relief for disability costs, since these are unavoidable additional expenses that other taxpayers dont have to face.

    Adults Disabled Before Age 22

    An adult who has a disability that began before age 22 may be eligible for benefits if a parent is deceased or starts receiving retirement or disability benefits. We consider this a “child’s” benefit because it is paid on a parent’s Social Security earnings record.

    The disabled “adult child” including an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild must be unmarried, age 18 or older, have a disability that started before age 22, and meet the definition of disability for adults.

    Example

    It is not necessary that the disabled “adult child” ever worked. Benefits are paid based on the parent’s earnings record.

    • A disabled “adult child” must not have substantial earnings. The amount of earnings we consider “substantial” increases each year. In 2021, this means working and earning more than $1,310 a month.

    How Long Does It Usually Take To Process Cpp Disability Applications

    There is no way to know for sure how long it will take for your CPP disability application to be processed. Earlier this year, Service Canada estimated that a decision on CPP disability applications would take four months, or 120 days, to reach. Lots of people still think this is the case; however, the website currently says that the approximate processing time is 170 days. This is between 5-6 months quite a bit longer than the estimate at the beginning of the year!;

    This 170-day estimate means that from the time Service Canada has your CPP disability application and all the necessary medical documentation, it should take around 170 days to process. This is not a guarantee of anything, however.;

    Delays can happen for a number of reasons, causing your CPP disability application to take longer than 170 days. Here are some of the possible reasons for a delay:;

    • the volume of applications received, especially if you live in a more populous area
    • staffing issues
    • human error ;
    • more information or documents needed from your doctors.;
