The Problem With 3m Combat Arms Earplugs

Plea agreement reached for veteran at center of controversial arrest

The allegedly defective 3M earplugs were the result of a collaboration between U.S. military representatives and Aearo in the late 1990s before 3M acquired the company. The result was the second version of the Combat Arms Earplug .

CAEv2 was designed to eliminate the need for soldiers to carry two different sets of earplugs. They are dual-ended earplugs that if worn one way are supposed to block sound like traditional earplugs and if worn in reverse are to block only certain types of loud battlefield noise while allowing the wearer to hear softer, closer sounds.

The alleged problem with the CAEv2 earplugs is that they can be too short in a particular wearers ear canal and can fail to form the proper seal to effectively protect the inner ear from the damaging noise.

M Defense #: Hide Behind Militarys Skirt

Here is what 3M has said about the earplug lawsuit:

3M has great respect for the brave men and women who protect us around the world, and their safety is our priority. We have a long history of partnering with the U.S. military, and we continue to make products to help protect our troops and support their missions. The company worked in close coordination with the U.S. military on the Combat Arms Earplugs Version 2 product, and its design reflected the direction and feedback of individuals acting on the militarys behalf. We deny this product was defectively designed and caused injuries, and we will vigorously defend ourselves against such allegations.

Since then, 3M has said in federal court filings that the militarys involvement in designing the defective earplugs went beyond merely establishing standards. Its involvement also included such operational features.

So the defense is that the product was not defectively designed. But if you wont believe this nonsense, 3M argues alternative that they were really putting out the exact product the Department of Defense wanted. This, my friends, is what failure to take responsibility looks like.

What Is The Average Payout

In the current litigation against 3M, veterans and active-duty members who used the 3M earplugs and who were harmed, as a result, are suing 3M to recover for those injuries.

This lawsuit will not involve dividing up the $9.1 million, but rather a service member affected due to the earplugs have their own individual cases against 3M.

Litigation against 3M is still ongoing and a final amount has not been determined yet.

Based on the small sampling of cases the average value of a claim for partial hearing impairment seems to range from $50,000 to $300,000 depending on the severity.

The average value of hearing loss claims in the Combat Arms earplug cases may be notably higher than this which could lead to larger individual payouts if these cases go to trial.

Most of the sample cases below involve car accidents where settlement values are typically lower because of max limits on the applicable insurance policies.

On the other hand, 3M is one of the largest manufacturing companies in the world, so there wont be any insurance limits.

Payouts In Similar Product Liability Cases

While there are no guarantees and we cannot be certain that 3M earplug lawsuits will result in settlements, to get an idea of the kind of settlements we might reasonably anticipate, we can look at some examples of similar product liability and dangerous drug cases and their settlements.

Roundup

In a similar product liability mass tort action concerning allegations that Roundup caused non-Hodgkins lymphoma and other cancer, a global Roundup settlement was reached in mid-2020, totaling roughly $10 billion. While individual payouts are not guaranteed and may vary widely, the New York Times reported that plaintiffs might expect between $5,000 and $250,000, depending on the specific facts and circumstances of their case.

Talcum Powder

While there has not been a global settlement of thousands of talcum powder lawsuits alleging Johnson & Johnson talc-based baby powder caused cancer, individual cases have resulted in multi-million dollar jury awards. It is unlikely in a case involving as many plaintiffs as in 3M litigation and lesser injuries compared to life-threatening and even deadly cancer that verdicts or settlements will result in comparable compensation, but talcum powder lawsuits reveal just how seriously judges and juries are taking defective product claims.

History Of 3m Combat Earplugs

Going into the history of 3M earplugs, let us check out the shocking statistical data.

Do you know? The most prevalent service-connected disability for men and women in the military is hearing loss. According to the Veterans Benefits Administration, more than 1.3 million veterans received disability compensation for hearing loss in 2020, while more than 2.3 million received compensation for tinnitus. I am sure you may be wondering about these statistics.

What makes veterans more prone to hearing loss and tinnitus than civilians? Constant exposure to high-intensity noise, such as blasts, small-arms fire, IEDs, artillery fire, etc., causes hearing loss in veterans. Tinnitus is the persistent ringing in the ears, closely associated with hearing loss.

Loud noises disrupt the eardrum and also the inner ears small bones and the cochlea that translate sound into electrical impulses. Research studies have proven that tinnitus in veterans can lead to Post-Traumatic Stress Disorder and traumatic brain injury in veterans.

What Is The Issue With 3m Combat Arms Earplugs

3M Combat Arms earplugs are dual-ended earplugs that promise to allow service members to hear orders, information, and normal conversation while also blocking out dangerous loud noises. Thousands of members of the armed forces relied on the black and yellow earplugs to protect their hearing when working around aircraft, during artillery fire, or when other loud noises might occur.

However, according to the lawsuits filed against 3M Company, the earplugs failed to seal tightly and did not include instructions for proper use. The veterans who are pursuing compensation from 3M allege the company knew their Combat Arms earplugs would not protect soldiers from hearing damage as early as 2000, but they continued to market the product anyway. The lawsuits claim this is what led to:

  • Difficulty with balance
  • Other issues caused by exposure to loud noises or repetitive noises

While there is no exact number on how many members of the U.S. Armed Forces may have suffered this type of injury, the total could be in the thousands. If you have hearing damage or other related symptoms and recognize the unique double-ended black and yellow earplugs, reach out to the Berger and Green team today. Plaintiffs Allegations Argue Product Liability

Plaintiffs have initially prevailed in 10 of the 16 test cases. They are alleging 3Ms liability for their hearing damage based on a legal theory of product liability. Product liability holds the manufacturer of a product responsible for the unexpected damage it causes others when it is used as directed by the manufacturer.

In product liability claims, plaintiffs must prove the product was defective. A product can be defective in several ways, including:

  • Defective design. Plaintiffs allege the CAEv2 earplug was too short to form an effective noise barrier inside the ears of some wearers.
  • Defective manufacturing. Plaintiffs charge the CAEv2 design as defective, not an error during the production of the earplug.
  • Defective labeling or failure to provide sufficient warning. Plaintiffs have alleged the CAEv2 did not come with sufficient instructions as to proper insertion and failed to warn of the potential consequences of improper insertion.

The plaintiffs that have been successful in the 3M earplug lawsuit test cases tend to have longer service records and significant exposure to combat noise while wearing the CAEv2 earplugs. Many have been successful in arguing that 3M knew or should have known about the defect and failed to warn the service members about it.

How Much Money Can I Get In A 3m Settlement

Chances are that, if the first few bellwether cases end with a victory for plaintiffs, the defendant may opt to settle other cases on an individual basis, offering each other soldier injured by earplugs a certain amount of money before reaching trial. In any case, since 3M has already paid a $9.1 million fine to the Justice department, it is unlikely that new documents will be found in the discovery phase that could sway the jury from reaching a verdict against the company. Eventually, most tinnitus claims are resolved as new settlements are reached with the company.Contact us at for more info.

Records Are Essential To Establishing Your Claim

On May 11, 2022, a federal judge overseeing the multidistrict litigation dismissed a group of over 20,000 3M earplug lawsuits from the MDL class action because the plaintiffs failed to produce certain documents to keep their case active. Most of the dismissals were due to the lack of official military service records.

Earplug Lawsuits Against 3m

Whenever a manufacturer publicly admits that a product was defective and may have caused harm, a large wave of individual product liability claims always follows. There is typically a period of several years following a manufacturers admission during which potential plaintiffs who were harmed by the product gradually come forward and starting filing suits across the country.

This is exactly where we are right now with the Combat Arms Earplugs lawsuits. 3Ms forced acknowledgment that its earplugs were defective just recently occurred in July 2018.

The admission came in the form of an agreement to pay $9.1 million to the U.S. Department of Justice to settle claims that the company violated the False Claims Act by knowingly selling its defective earplugs to the U.S. Military.

The field of potential plaintiffs in the Combat Arms Earplugs litigation is potentially very large. Keep in mind that the Combat Arms Earplugs were standard issue equipment for all branches of the U.S. Military for over a decade. During that time period, hundreds of thousands of soldiers may have used the defective earplugs daily to protect them from extreme noise exposure.

Diagnosis And Treatment Of Hearing Loss

General screenings for hearing loss can reveal potential declines in hearing. If a doctor suspects you have hearing loss, you might meet with a specialist called an audiologist. The audiologist will conduct tests to measure the severity of hearing loss and what level of sounds you can hear.

Often, medical treatment cannot reverse hearing loss. However, there are options available to help improve symptoms. For example, a person with hearing loss might benefit from hearing aids or cochlear implants. Because of the potentially permanent damage, hearing loss prevention is critical. Prevention is an effective strategy for reducing hearing loss.

Agent Orange Registries and Why They Matter | Department of Veterans Affairs | theSITREP

Anyone who served in the U.S. armed forces between 2002-2015 and suffers from tinnitus or hearing damage may be entitled to financial compensation from 3M. To have a valid earplug action, you will need to meet the following additional requirements:

  • You were issued Combat Arms Earplugs
  • You were exposed to high noise levels at some point during your service and suffered an ear injury
  • You used the Combat Arms Earplugs for ear protection
  • If you meet these requirements, you should have a valid claim for compensation against 3M. The amount of financial compensation you may be entitled to will depend on the length and severity of your hearing damage. Damage to the inner ear resulting from 3Ms defective earplugs has been linked to:

    • Tinnitus: a persistent ringing in the ears that impair hearing function
    • Loss of Hearing: generalized impairment of hearing not related to tinnitus
    • Auditory Processing Disorder: a condition in which a person cannot normally process and interpret audible sounds

Potential plaintiffs in the earplug litigation include service members who were regularly exposed to loud noise as part of their duties. This would include gunners, artillery, pilots, aircraft support personnel, infantry, mechanics or engineers, and any other jobs involving high continuous high-level sound exposure. For most law firms to consider your case, including ours, you need test results that show a hearing injury.

    Design Defects With Dual

A whistleblower lawsuit filed under the False Claims Act Case brought against 3M in 2016 alleged that 3M manufactured and knowingly sold defective hearing protection devices to armed forces.

The 3m earplug lawsuit claims that the company knowingly sold defective dual-ended military earplugs to the military, putting soldiers at extreme risk of extensive loss of hearing.

The design of the defective 3M military earplugs Version 2 included a faulty seal that allows dangerously loud noise to penetrate military members’ ears unknowingly. In turn, the loud noises resulted in hearing loss claims.

In July 2018, the US Government reached an agreement with the manufacturer to pay a $9.1 million 3m earplug lawsuit settlement to resolve the allegations.

However, this only resolved the dispute between 3M and the government. The company is still financially liable to thousands of current and former military personnel harmed by 3M’s earplug devices.

Service Members And Veterans Most Likely Affected

Any United States military personnel who received government-issued earplugs might be affected by the damage caused by these defective devices.

The Department of Defense issued millions of CAEv2 devices to servicemen and women in the United States and abroad. Also, 3M Company sold these devices for civilian commercial applications, including those by the U.S. Border Patrol.

How Many People Are In The 3m Earplug Lawsuit

The number of people hurt by defective 3M earplugs may reach the hundreds of thousands. The New YorkTimes reports that, as of January 2022, nearly 300,000 military service members and civilians are involved in litigation against 3M over its earplugs.

Service members who used earplugs in the Iraq, Gulf, and Afghanistan wars all used defective earplugs. These earplugs provided insufficient protection from loud noises, such as the discharge of firearms or explosive devices during military interventions such as:

    • Operation Iraqi Freedom
    • Operation Enduring Freedom
    • Operation Ocean Shield

Some estimates put the total number of people affected by the earplugs may be in the millions. Soldiers who used the defective earplugs often developed tinnitus or even deafness. Unfortunately, medical professionals have no cure for these ailments, though some people can use hearing aids and other assistive devices to retain some portion of their hearing.
