New Jersey: Disability Insurance Lawyers Helping Disability Claimants Nationwide

If youre a disabled New Jersey resident, and your medical condition prevents you from being able to work, you may be an excellent candidate for monthly disability benefits. These benefits are administered by the Social Security Administration, or SSA, and are available in two varieties known as SSI and SSDI . Some people even qualify to receive both at the same time, which is known as receiving concurrent benefits. However, before you can receive assistance, you must file a disability claim, which must then be approved by the SSA. While the SSA approves millions of Americans for benefits every year, even more people will be rejected than will be accepted into social security programs.

According to statistics, only about 43% of all New Jersey claimants are approved on their first try, while the average acceptance rate drops even lower during the first stage of the appeals process. In order to maximize your chances, it is critically important to have a good understanding of the SSA eligibility requirements for SSI and SSDI applicants. Wherever you are in the process, the experienced New Jersey social security benefits attorneys of Young, Marr & Associates can help review your materials, guide you through the system, and represent you if your claim is denied. To set up a free and confidential legal consultation, call us today at 755-3115 in New Jersey or 701-6519 in Pennsylvania.

How Is Permanent Disability Pay Calculated

While you could use the same formula he SSA uses to calculate your own benefit amount, this would require first figuring out the numbers used in the formula, including your:

  • Average Indexed Monthly Earnings and
  • Primary Insurance Amount .

In addition to requiring several steps, is often difficult to know exactly which numbers the SSA is using, making it hard to get an accurate answer.

Earning Limits In 2021

The income limits for Social Security disability benefits change annually, based on the annual wage index. In 2021, the monthly earning limit for SSDI is $1,310 for a non-blind individual and $2,190 for blind applicants. If you earn above this amount each month, then you are said to be engaging in substantial gainful activity, and will no longer qualify for SSDI.

For qualifying for SSDI some types of earnings are not counted. This includes a spouses income and unearned income from sources like investments and interest. These types of income dont affect eligibility because they are unrelated to your ability to work.

Because SSI is a needs-based program, more types of income are counted. The SSA considers many types of earnings to be countable income for SSI. This includes earned income, unearned income, in-kind income , and deemed income . Some types of income are excluded from the SSI calculation, such as grants or scholarships, the value of Supplemental Nutritional Assistance Program benefits , certain work expenses, and home energy assistance.

Generally, if you earn $794 per month, plus $20.00 , then you will not be eligible for SSI benefits. If you work and earn less than this threshold, you may still qualify for SSI. However, your monthly benefit amount will typically be lower than the maximum federal benefit rate. This is due to the fact that SSI is designed for people with low income and relatively few assets.

How Long Does It Take To Get Approved For Social Security Disability

According to the SSA, an initial decision on a disability application is usually made within 3 to 5 months. However, if your initial application is denied and you appeal the denial, it could take much longer to receive a final determination. Cost Of Living Increases In New Jersey

How Much Do You Really Know Developmental Disability ...

The purpose of the cost of living adjustments was to ensure that the purchasing power of SSI recipients was not eroded by increasing inflation. In 1972, Congress enacted the COLA provision as part of the Social Security Amendments. The annual COLAs were enacted in 1975. Before the amendments, the only increase SSI recipients saw was when Congress enacted special legislation.

The Social Security Administration just announced the highest cost of living adjustment for Social Security benefits in more than a decade. Every year, SSI benefits are increased to reflect the increase in the cost of living expenses. In 2022, residents of New Jersey will receive a 5.9% increase in their SSI benefits.

New Rules For Nj Paid Family Leave Temporary Disability Insurance: What You Need To Know

On Tuesday we reported that the state made some changes to how you apply for pregnancy-related temporary disability and family leave benefits.

The new rules are meant to make it easier to apply and faster to receive a payment.

You had lots of questions, and we tackled some of them below.

What is family leave insurance?

Family leave insurance is a state-run program that pays benefits to new parents taking time off work to bond with a child or to a worker who is caring for a seriously ill family member.

Ten years ago, New Jersey became the second state to offer paid family leave. But over the years, researchers have found the program is greatly underutilized. Thats why there are major updates in store next summer.

What is temporary disability insurance?

Temporary disability insurance acts as state-run short-term disability for New Jersey workers who cannot work because of an illness, injury, pregnancy or some other disability that is not work-related. The program will temporarily replace some, but not all, of your lost wages.

Who qualifies for temporary disability and family leave insurance?

Youre eligible to receive benefits if you are paying into the programs through an automatic payroll deduction at work.

You must also have to have been working for at least 20 weeks with at least $172 in weekly wages or you have to have earned at least $8,600 in the preceding 12 months.

Previously, only children, parents, spouses, domestic partners and civil union partners were eligible.

When Do I Have To File My Claim

You must file your claim within 30 days from the first day you become disabled. If you file later than this, you will have to show good cause for why you didnt file the claim on time. To do this, attach an explanation of why the filing was delayed to your claim form. If good cause isnt shown, you may be ineligible for benefits, or your benefits may be reduced.

Note that you cannot file your claim before you become disabled even if you know, for example, the date of the disabling event that will prevent you from working.
